An Ordinance to Establish u Board of |
Health.
SECTION 1. Be it ordained, by the
Mayor and the Aldermen of the city of Co?
lumbia, in Council assembled, That a
Board of Health bo, and the same is
hereby, established, whioh shall consist
of twelve members, to be chosen by bal?
lot by the City Oonncil/at their first
meeting in May of each and every year;
and said Board shall be so chosen, that
three of them shall be elected from Ward
No. 1, three from Ward No. 2, three
from Ward No. 3, and three from Ward
No. 4, seven of whom ?hall constitute a
quorum; and if any penon so elected a
member of the Board of Health, shall
refuse or neglect to perform the duties
hereafter required, he shall, opon con?
viction thereof before the City Council,
forfeit and pay the som of forty-two dol?
lars: Provided, That no person shall be
compelled to servo more than one year
in every three years.
SEO. 2. Be it further ordained. That
the said Board of Health, of whom seven
shall constitute a quorum, shall meet at
least once a -fortnight from the first day

eaoh and every year, and at such other
times and at such places as they may
deem necessary and convenient, for the
purpose of receiving and communicat?
ing all possible information relative to
the health of the city, and to advise and
oonsalt together respecting the preserva?
tion of the same; and shall have fall and
ample powers to adopt and carry into
effect all such measures, rules and regu?
lations as they may deem necessary to the
discharge of the trust hereby confided
to them; and each and every. practical
physician within the city is hereby re?
quired to give immediate information of
the existence of any contagious or malig?
nant disease to the Board, or to any mem?
ber thereof, and at all convenient times
to aid and advise the said Board in the
preservation of the health of the city,
and in the preservation or suppression
of contagions or malignant diseases.
SEO. 3. Be it further ordained, That it
shall be the duty of each and every
member of tho said Board to causo to be
removed, from the streets within the
Ward under his or their charge, all of?
fensive substances or nuisances tending
to endanger the health of the citizens of
the city; and the Chief of Police and his
assistants, and the Superintendent of the
Streets, are hereby required, without de?
lay, to obey all orders or precepts that
shan bo given them, or either of them,
by either of the members of the said
Board respecting the removal of such
nuisances.
SEO. ?. Be ii further ordained, That
the said Board of Health, or any mem?
ber thereof, shall have power, and are
hereby invested with full authority, to
enter into and npon any lot, ground or
possessions of any person or persons,
and thoroughly examine the same; and
whenever the said Board, or any mem?
ber thereof, shall have cause to suspect
that any fool or noxious efl!avia origi?
nates, or is oolleoted in any honse, cel?
lar, or in any enclosure whatever, shat
ap from public view, they, or any of
them, may demand entry therein, and
direct the samo to be opened and venti?
lated, or tho cause of saoh effluvia to bc
removed, as may be deemed necessary;
and if the owner or occupant of snob
lot, honse, cellar or enclosure shall refuse
or delay to open the same, or suffer it to
be examined and ventilated, or removed,
as aforesaid, or shall in any wiso ob?
struct the said Board, or nny member
thereof, or any polioeman or other officer,
in discharge of his or their official duty,
such owner or occupant shall be fined
not exceeding twenty dollars for each
and every day he, she or they shall BO
neglect, refuse or delay, after demand by
said Board, or any member thereof; and
shall also defray all expenses incurred in
the removal or suppression of saoh nui?
sances, under the direction of said
Board, or any member thereof.
SEO. 5. Be it further ordained, That it
shall be the duty of the City Clerk to
act as clerk of the said Board of Health.
SEO. G. Be it further ordained. That it
shall be the duty of the Chief of Police,
or acting Chief of Police, to make dili?
gent inquiry os to all nuisances which
may exist within the oity; to receive all
complaints which may be made to him
concerning the same, and to report im?
mediately to any member or members of
the Board of Health having charge of
the Ward in which such nuisance ex?
ists; and it shall be tho duty of the snid
Chief of Police, O? acting Chief of Po?
lice, to attend the meetings of the Board
of Health when required, and obeybuoh
instructions as said Bourd of Health
maygivo relative to the health of the city
SEO. 7. Be il further ordained, That
the Chief of Police, or noting Chief of
Police, shall havo power, and is hereby
authorized and required, to demand
entrance into any lot, building, cellar or
enclosure, wherein ho may suspect any
nuisance to exist, for tho parp?se of
ascertaining whether any such nuisance
doeB exist therein; and if tho owner or
occupant of any such lot, building,
collar or enclosure shall refuse to permit
said Chief of Police, or acting Chief of
Police, so to enter for tho purpose afore?
said, or shall cthorwiso obstruct or hinder
him in the discharge of the abovo duty,
such owner or ocjupaut shall forfeit arid
pay for each and every offoncc a sum not
exceeding twenty dollars.
SEO. 8. Be il further ordained, That
tho second section of an ordinance,
passed on tho lGth day of April, A. D.
1851, entitled "An ordinance to esta?
blish a Board of Health," be so amended
as to require that evory physician in the
city of Colombia shall report to the said
Board of Health, within twenty-four
hours, the ocoarrenoo of any caso of
contagious or malignant disenso in his
practice, under a penalty of ten dollars
for each and every caso which ho shall
neglect, within twenty-four boars after
his knowledge thereof, to report; said
fine to bo collected by information bo
fore tho Mayor, or eny ono of tho Alder?
men.
SEO. 9. Be it further ordained, Thal
this ordinance shall take effect from and
after its ratification, and that all ordi?
nances herotoforo of force repugnant tc
