COTTON AND LOYAI/TY.-Senator Mor?
rill, of Vermont, some three weeha ago,
introduced on amendment to an appro?
priation bill limiting the jurisdiction of
the Court of Claims upon the cotton
claims, and -which was no better than
what was known BB Drake's amendment
in the Aot of June 25, 1868, by which,
when a person brought suit for the pro?
ceeds of cotton seized about the close of
the war by United States officiais, and
pleaded in support of his title the pro?
clamation restoring him to his rights of
property, tho pardon was to be taken as
quite sufficient to establish the faot that
he had been disloyal, but was altogether
impotent to go further and show he had
been purged and cleansed therefrom* So
monstrous au invalidation by Congress
of the constitutional right of the Presi?
dent to pardon, oould not, of course,
stand the teat of the law, and the Su?
preme Court decided in the case of tho
United States va. Klein, January 29, in
this year, that the Drake amendment
was null and void. Congressional enact?
ment, it was announced, oould not in?
validate the effect of the Executive
pardon, and that pardon having granted
the restoration of property rights, all
property illegally taken must be restored.
Under this decision, the money "co?
vered" into the Treasury was uncovered
ont. In plain words, restitution WBB ad?
judged of the stolen property; and it
seemed as if long-delayed justioo were
about to be fulfilled.
Senator Morrill, in nowise discou?
raged, revived the Drake amendment in
another form, whioh the Senate concur?
red in; bis proposition dedaring in
effect, first, that no judgment for these
cottons now unsatisfied shall be paid,
unless Congress by speoial Act shall find
the claimant waa loyal; and, second, that
in all future suits of the same kind, loy
ally must be proved.
Even ii thic bad passed the House of
representatives, the Supreme Court
would no doubt have deolared it, like its
predecessor, unconstitutional, but the
trouble is that it might have taken years
before tho claimants could realize what
is due them, and that they might have to
barter off their rights for a mere song
before this result was reached, and pos?
sibly this may have been the objeot of
the proposed legislation. The HOUBO of
Representativo, however, non-concurred
in the Senate amendment, and in lieu
thereof a substituto was adopted autho?
rizing and directing the Secretary of the
Treasury to pay to the owners or their
legal representatives of property seized
?ince June 30, 1865, the net proceeds of
the sales, without interest, taking re?
ceipts in full on account of auoh ueiznre,
and appropriating a sufficient amount to
pay snoh claims. This amendment the
Senate, on Wednesday, agreed to. It
will be but soant justice, however, for
the amount which will be allowed said
claimant is far below the actual value of
the property. It is probable that not
more than half the amount of the cotton
robberies went into the Treasury, the
rogues getting the balanee; but it shows
a better disposition in the House than in
the Senate to do justice, this latter body
seeming to have become as demagogical
and partisan as it was formerly conserva?
tive and dignified.-Ballimore Sun.

Summer County, Eanaas, seems to per?
form its functions with remarkable
promptness and despatch. A man
named McCarley shot-down two men
and escaped into the Indian Territory a
short time ago, bnt the committee was
after him and riddled him with bullets
before the sun went down on their wrath.
Hearing then that somebody else had
been indulging in the shooting exercise
some twenty miles away, before they
slept had taken him out of the custody
Of the sheriff and hung him to a tree.
Daniel Webster Appleton, a grand-son
of Hon. Daniel Webster, is expected to
die from the effeots of burning, caused
by himself in an attempt to fire the Dor?
chester lookup, in which he was con?
fined, Monday, for drunkenness.
