AN A OT TO INCORPORATE THE TOWN OF
NINETY-SIX.
SECTION 1. Be il enacted by the Senate
and House of Representatives of the Stale
of South Carolina, now met and sitting in
General Assembly, and by the authority of
the same, That all persons, citizens of the
United States, who now are, or hereafter
may be, inhabitants of the town of
Ninety-Six, shall be deemed, and are
hereby declared, A body politic and cor?
porate; and said town shall be called and
known by the name of Ninety-Six, and
its limits shall be deemed and held to
extend one-half a milo in each direction
from the Oreen rille and Columbia Rail?
road Depot, at said place. *
SRO. 2. That the said town shall be
governed by an Intendant and four
Wardens, who shall bo elected on the
first Monday in April next, 1872, as well
as on the first Monday in April of every
year thereafter, an election shall be held
for an Intendant and four Wardens, who
shall be oitizens of the United States,
and shall have been residents of the said
town sixty .days next preceding said
election, at such place iu said town as
the Intendant and Wardens shall desig?
nate, ten days' notice thereof, in writing,
being previously given; and that all the
male inhabitants of said town, of the age
of twenty-one years, who have resided
therein sixty days previous to the elec?
tion, shall be entitled to vote for said In?
tendant and Wardens; and tho eleotion
shall be held from seven in the morning
nntil six o'clock in tho evening, when
the poll shall be closed, and the Mana?
gers shall count the votes and proclaim
the eleotion, and give notice thereof to
the persons elected; and that the In?
tendant and Wardens, for tho time being,
shall appoint Managers to hold tho en?
suing election; that the Intendant and
Wardens, before entering upon the du?
ties of their offices, shall take the oath

Six, I will equally and impartially, to the
best of my ability, exeroise the trust re
posed in me, and will use my best en

SEC. 3. That in case a vacancy Bhouh
occur in tho office of the Intendant, o:
any of the Wardons, by death, resigna
tion or removal from the State, or fron
any other causo, an eleotion shall b<
held, by appointment of the Intendan
and Warden, or Wardens, as the casi
may be, ten days' publio notice thereof
as aforesaid, being given; and in caso O
the sickness or temporary absence of thi
Intendant, the Wardens, forming
Council, shall be empowered to elect on

SEO. 4. That the Intendant and Ward

deem expedient and proper; and the
said Council may affix fines for offences
against such by-laws and ordinances, and
'appropriate tbe eamo to the use of the
corporation; but no fine shall exceed
fifty dollars. All fines may be collected
by an action foi; debt before a proper
tribunal.
SEO. 5. That tho said Council shall
have power to abate or remove nuisances
within the limits of said town, and also
to classify and arrange the inhabitants
liable to public duty, and require them
to perform such duty as occasion may
require, and enforce the performance of
the same, under the same penalties ns
are now or hereafter may be established
by law: Provided, ahoays, nevertheless,
That the said Town Council shall have
power to componnd with tho persons
liable to perform such duty, under such
terms as they shall by ordinance esta?
blish.
SEO. 6. That it shall be the duty of the
Intendant and WardenB to keep all
streets and ways in the limits of said
town open and in good order; and for
that purpose, they are hereby invested
with all the powers and privileges grant?
ed by law to the Commissioners of
Roads within the limits of said town.
And for neglect of duty, they shall be
liable to the same pains and penalties
imposed by law upon Commisioners of
Roads for like negleot; and they are
hereby individually exempt from the
performance of road and police duty;
and the inhabitants of said town are
hereby exempt from road duty without
the limits of said corporation.
SEO. 7. That the said Intendant and
Wardens shall have power to compound
with such persons liable to work on the
said streets and ways, and to release
suoh porsona aa may desire it, upon the
payment of such sum of money as they
may deem a fair equivalent therefor, to
be applied by them to the uso of tho cor?
poration .
SEO. 8. That the said Town Council of
Ninety-Six shall also be empowered lo
retain, possess and enjoy all such pro?
perty as they may be possessed of or en?
titled to, or which shall hereafter be
given, bequeathed to, or in any manner
acquired by them; and to sell, alien or
in any way transfer the same, or any
part thereof: Provided, The amount of
property so held, or stock invested, shall
in no caso exceed the sum of twenty
thousand dollars.
SEC. 9. That tho said Town Council
shall have power to impose an annual
tax upon all real and personal property
within the limits of said town: Provided,
Said tax does not exceed the sum of fif?
teen oents on the hundred dollars.
SEO. 10. That tho Intendant and
Wardens of the town of Ninety-Six shall
have power to regulate sales at auction,
within tho limits of said town, and grant
licenses to auctioneers: Provided, That)
nothing herein contained shall extend to
sales by or for Sheriffs, Clerks of Courts,
Judge of Probate, Coroners, Executors,
Administrators, Assignees, or by any
other person, under the order of any
Court or Magistrate.
SEO. ll. That tho Intendant and
Wardens shall havo power and authority
to requiro all persons owning a lot or
lots in the said town of Ninety-Six, to
keep in repair the side-walks adjacent to
their lots, respectively, and for default
n this matter, shall have power and
authority to impose a Ono not exceeding
iftoen dollars.

according to their elections; and to keep

alter at will; to sae aud be sued in any
court of this State; to have and enjoy
every right, power and privilege inci?

enjoy all suoh property, roal and per?
sonal, as may be given or bequeathed to,
or purchased by it, and to sell, convey
or mortgage the same, or any part there?

from time to time, invest their moneys,
assets, or any property which it may ac?
quire, in such real or personal property,
lands, stocks, or iu sureties, in suoh
sums, and on suoh torms and conditions,
as it may deem proper, and to executo

Provided, That the maximum value of
all property held and owned by .said cor?
poration shall not exceed twenty-five
thousand (25,000) dollars.
SEO. 4. That this Act shall continue
in force during fifteen (15) years, and
may be given in evidence without being
specially pleaded.
