Acts anti Joint Resolutions I'aiird by the General Aucmbly of South Carolina, Regular Session, 1871 and. 187?. AN ACT TO AMEND THE OHABTEB OP TUB TOWN OF BEAUFORT. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That tbe Act incorporating tho town of Beaufort be BO amended that the Town Oounoil of Beaufort be, and they are hereby, authorized to establish a guard, or police, for tho better seourity and regulation of the said town ; and to pass snoh ordinances as they may deem expedient, to defino the duties, fix the compensation, and impose fines and penalties for negleot, or improper dis? charge of duties of said guard, and, gen? erally, to perform all acts necessary and proper to effectuate the intention of this Aot, and to make and establish all rules and orders relative to enid guard, not in? consistent with the laws of the State. That the Intendant and Wardens, duly cleated and qualified, shall, duriDg their term of service, have the same powers whioh ? Trial Justice now has to compel the attendance of witnesses, and require them to give evidenoe upon the trial be? fore them of any person for the Violation of any of the by-laws or ordinances of the town; that the Intendant ahull, as often as occasion may require, summon the Wardens to meet in Oounoil, a ma? jority of whom shall constitute a quorum for the transaction of business, and shrill be known by the name of the Town Oonncil of the town of Beaufort; and they and their succesBors in office shall have a common seal, and shall havo power to appoint, from time to time, suoh and so many proper persons to act as Marshals or Constables, as they shall deem expedient and proper, which of? ficers shall have all powers, privileges and emoluments, and be subject to all the duties, penalties and regulations, provided by the laws of this State for the office of Constable; and the Intend? ant and Wardens in Council shall hare power and authority, under their corpo? rate seal, to ordain and establish all suoh rules and by-laws, and ordinances, respecting the streets, ways, publio wells and springs, or fountains of water, mar? kets and polios of said town of Beaufort, and for preserving peace, health and order and good government within the same, as they deem expenient and pro? per, not inconsistent with, or repugnant to, the laws of the State; and all such by? laws and ordinances shall, at all times, bo subject to r?visai or repeal by the General Assembly of the State, and tbe said Council may affix fines for offences against suoh by-laws and ordinances, and appropriate the same to the uso of said corporation; but no fine shall exceed thirty dollars, and when fines shall ex? ceed twenty dollars, they may be reco? vered in a Trial Justice Court of the County of Beaufort, and when they are of the amount of twenty dollars, or under, they may be recovered before said Intendant and Wardens in Oounoil. SEO. 2. That the said Town Oounoil may have power to require all persons owning a lot or lots, in the said town, to build a lawful fenoe, and keep in good repair side-walks in front of said lot or lots, whenever the same shall front or adjoin any of the publio streets of said town, if, in the judgment of the Oounoil, snoh side-walks shall be necessary; the width thereof, and the manner of their construction, to be designated and regu? lated by the Town Oonncil; and for de? fault or refusal to keep in repair snoh side-walks, the Town Council may causo the same to be put in repair, and require the owner to pay the price of repairing: Provided, That such contraot for repair? ing the same be let to the lowest bidder. SEO. 3. That tho said Town Oounoil shall have power to abate all nuisances within the corporate limits, and also to appoint a Board of Health and a Harbor Master, when deemed necessary, for the said town; aud to pass snob ordinances as may be necessary to define the duties and powers of tho said board, and to impose fines and penalties upon the members of tho said board for neglect of duty or refusal to serve, SEO. 4. That the power to grant or re? fuse licenses for ten-pin or other pin alleys, bagatelle tables, to keep taverns, or to retail spirituous liquors, within the limits bf the said corporation, be, and the samo ia hereby, vested in tho Town Oounoil of Beaufort; and the said Town Oounoil may grant licenses to retail spi? rituous liquors to such persons, and in snoh quantities, at suoh rates and upon such terms and conditions as the said Town Oounoil may see fit and proper: Provided, That no suoh lioenso shall ex? ceed the sum of two hundred dollars. Provided, further, That in no instanco Bhall the price of. a license to keep a tavern or to retail spirituous liquors be fixed at a less sum than is established by tho law of this Stato. SEO. 5. That tho said Town Council are hereby empowered to require all per? sons, companies and corporations, now engaged, or who may becomo hereafter engaged in business or avocations of any kind whatovor, within the limits of tho said town, to take out a lioenso from tho said Town Council, who aro hereby au? thorized to impose a reasonable charge, or tax, within their discretion, for the conduot o' the same: Provided, No snob li con HO shall exceed the sam of five hun? dred dollars. BEC. 6. That the Baid Town Council ahull have power to impone a tax, within their discretion, on all salea made by itinerant traders and auctioneers, on all drays, certs, wagons, omnibuses, car? riages, and other vehicles kopt for biro. And the said Town Couuoil shall have power to enforce the payment of all taxes and assessments against tho pro? perty and persons uf defaulters, to tho same extent, and in the same manner, ns is provided by law for the collection of the general State tax, except that ex?cu? tions, to enforce the payment of town tuxes, shrill be issued under the seal of the corporation and directed to tho Town Marshal, or other person especially ap? pointed by the said Town Council, tu collect the same. Sm 7. That retui us shall be made, ou oatb, to the Clerk of the Town Council, whenever, and at such times as tho said Council may so require by ordiuauco, of tho amount of all sulcs of morchaudize, professional, mechanical or other in? comes, aod of the quality and kind of all other property, other than real estate, subject to taxation under tho provisions of this Act, by persons who mny bo lia blo to pay the taxes on the same; aud any person in default of payment of such taxes, when such pay meut may bec om o duo, sholl bo subject to the penalties now provided by law for failure to poy tho general State tax. That all moneys paid for licenses and for fines and forfeitures for retailing spirituous liquors, keeping tavern aod billiard tables within the said limits, without licenses, shall be appro? priated to the public uses of said town. SEO. 8. That all Acts, or parts of Acts, in relation to the Town Council of Beau? fort, repugnant to, or supplied by this bill, be, and the eamo are bercby. re? pealed. Approved March 9, 1872. Be il enacted by Vie Senate and House of Representatives of the State of South Carolina, now met and silting itt General Assembly, and by the authority oj the same, That Richard Tozer, John Brutton, Edward Hope, George Sym? mara, T. W. "Woodward, George Dial, J. McKenzie, S. H. Spencer, Wm. Si? mons, A. Goodson, W. B. Nash, F. J. Moses, Jr., Wm. Green, James Davis, S. B. Thompson and R. Tarlton, toge? ther with snob other persons who now are, or hereafter may be, associated with them, bo, and are hereby, incorporated and deolared a body politic and corpo? rate, under the name and style of th? Traction Steam Engine Company, of the city of Columbia, for the purpose of ma nnfaoturing, selling and using the same, and also for the transaction of all sud business aa may be connected with tht same. The capital stock shall consist o: twenty thousand (20,000) dollars, ic shares of fifty (50) dollars eaoh, with th? privilege to increase it to any extent no1 exceeding fifty thousand (50,000) dollars with the consent of a majority of th< stockholders being first had and ob fained. Sec. 2. That the said corporation ebal have suob number and succession of of fleers and members as shall be ordainei and chosen according to the oonstitu tiori, rules and by-laws made, or to b mado, by the said corporation, for it govornment, and shall have power ant authority to make any such constitution rules, or by-laws, as are not repugnan to the Constitution and laws of tho land shall bave and keep a common seal, am alter the same at will; shall sue and b sued, plead and be impleaded in an; court of law in thia State, and shall hav and enjoy all and avery right and privi lego incident and belonging to corporal bodies. SEC. 3. That the said company sba be empowered to purchase, retain an enjoy all such property, real and poi sonal, as it may possess, bo entitled tc or which shall hereafter be given, b< queathed to, or in any manner bo a< quired by it, and to soil, alien or tram fer the same. SEC. 4. That the said company sha have the power to erect maobine shop: and other buildings necessary to cari on tho said business. That they sha have the power to use such engines i any part of the State of South Carolin for tho purpose of drayage, carryii passengers, or cultivating land, and mi use the same in any oorporated cit Provided, No dacgor to life or propon ensues: Provided, That said corpor tiou shall be Hablo for the payment any and all damages done to lifo ac property. SEO. 5. That said company may opt books for subscriptions to tho capit stock in the city of Columbia, or ele where, nt their discretion. S.10. G.
