Be it enacted by the Senate and House of Representatives of the State of South Carolina, now mel and sitting tu General Assembly, and by the authority of the same, That, for the purpose of estab? lishing a railroad from Spartanburg to Port Royal, a charter*, with all the rights and privileges incidental to the same, be, and is hereby, granted to W. J. "Whipper, R. Smalls, N. B. Myers, James M. Baxter, J. J. Patterson, James N. Heyne, H. O. Corwin, H. Q. Wor? thington, G. Cannon, B. ?. BoBoman, W. H. Jones, James Miller, H. W. Dun? can, J. S. Mobley, J. ?. Bowley, D. R. Duncan, Timothy Hurley, W?: Mun? ro, R. M. Smith, S. J. Lee, J. H. Evana, J. T. B. Jeter, L. Wofford, F. S. Jacobs, R. J. Donaldson, Hardy Solomon, D. A. Childs, S. A. That the Baid company is here" by authorized to construct a railroad from Spartanburg to Port Boya!, by snob route as shall be found most suita? ble and advantageous. Ssc. 3. That the capital stock of said company shall be one and-a-half million dollars, with the privilege of increasing it to two and-a-half millions of dollars, if found necessary, to be divided into shares of fifty dollars each; and, for the purposo of raising such capital stook, it shall be lawfnl to open books of sub? scription, at snob times and places, and to keep them open for such periods of time, and under the direction of snch persons, as may be determined on by a majority of said company. That sub? scriptions to the capital stook may bo made- in land, at a rate, per sore, to be agreed upon at the time of subscription; and that each and every person subscrib? ing land shall execute a deed to the said company; and that all amounts snb Boribed in land or money shall consti? tute the joint stook capital for the pur? pose of constructing and carrying into operation the . railroad provided for by thiB Act ; and the said railroad shall have power to mortgage its property and franchises, and issue bonds, on such terms and conditions, and for such uses and purposes of said corporation, as the Board of Directors thereof may deem ex? pedient. That tho said railroad shall be .subject to the provisions of an Aot of the General Assembly of South Caroli? na, passed September 22, 1P68, entitled "An Act to declaro the manner by which lands, or right of way over the lands of persons or corporations, may be talton for the construction or uso of railways and other works of internal improve* nient:" Provided, however, That noth? ing herein contained shall bo construed as to exempt the said company from the payment of taxes: Provided further, That nothing heroin contained shall bo construed so as to exempt said company from the provisions of Section 1, Chap? ter 63 of the General Statutes. Bradley, Wm. H. Parker, J. S. Cothran, G. MoD. Miller, W. Joel Smith, F. A. Connor, James A. Reid, J. M. Latimer, D. M. Rogers, James Pratt, A. M. Aiken, M. C. Taggart, A. H. Lawson and R, A. Griffin, and'their successors in office and associates, be, and they aro hereby, con? stituted a body politic, undor tho naroo of tho "Abbeville Agricultural Society," with a capital stock not exceeding five thousand dollars, in shares of ton dollars eaoh, with tho right to sue and be sued, to plead and bo impleaded, in any court of competent jurisdiction; to havo and nao a common noni, and tho same to alter at will and pleasure; to purchase and hold real estate and other property; and j with all other rights, privileges and im-1 mani ti es that are now secured by law to incorporated bodies. AN ACT TO SUPPLY THE DEFICIENCY IN THE AFPBOFBIATION POE THE SUPPOBT AND MAINTENANCE OP PEES COMMON SCHOOLS FOB THE FISCAL YEAH ENDINO OCTOBER 81, 1871. SECTION 1. Be il enacted by the Senate and House of Representatives of the Slate of South Carolina, now met arid sitting in General Assembly, and by the authority of | ihsyfame. That tbe sam of soveoty-?ve thousand dollars be, aad the same is hereby, appropriated to supply the defi? ciency in the appropriatioa for the sup? port and maiateuauce of freo common schools for the fiscal year ending Octo? ber 31, 1871. SEO. 2. That oaoh of the several Counties of the State shall be entitled to receive from said deficiency appro? priation, saab a sum of money as is equal to the exact deficiency existing in the free school funds of said Conaty, for the fiscal year eading Ootober 31, 1871, aad ao more. SEO. 3. That tho State Su perin tend? ent of Education, upon his receipt of an official statement, signed by the County School Commissioner aad County Trea? surer of any County, aad showing the deficiency existing ia the free school funds of said County, for the fiscal year ending October 81, 1871, shall, if he ap? prove said statement, issue an order in favor of the County Treasurer of the County aforesaid, payable from the ap? propriation made by Seotion 1 of this Act, for a sam of moaey equal to the defioienoy shown by the aforesaid state? ment. SEO. 4. That no part of tho appropri? ation created by Seotion 1 of this Act shall be disbursed by tho State Trea? surer, except upon order of the State Superintendent of Education, nor shall the said appropriatioa, or any part thereof, be applied, appropriated or used for soy other purpose than is speci? fied by the terms of this Act. SEO. 5. That this Aot shall be deemed a public Act, aad shall take effect imme? diately. Approved March 13, 1872. AN ACT TO INCORPORATE THE TBOSPECT BAPTIST CHURCH, OP LAUBENS COUNTY, SOUTH CAROLINA. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now mei and sitting in General Assembly, and by the authority of the same, That from aad immediately after the passage of this Aot, all persous who now are, or who hereafter shall or may become, members of said society, shall be, aad they aro hereby, incorpo? rated, aad are hereby declared to be a body corporate, by the name aad stylo of the "Prospect Baptist Church," aad by the said name shall have succession of officers and members, aad have a com? mon seal. SEO. 2. That the said corporatiou shall have power to purchase, receive and possess any real or personal ostate, not exceeding in value the sum of twen? ty-five thousand dollars, or to sell tho Bame, aad by its corporate name to BUS and be sued ia any coart of this State, aad to make such rules aad by-laws, (not repugnant to law,) as may be thought expedient.
