TER OS* THE TOWN OF GREENWOOD,
SOUTH CAROLINA.
SECTION 1. Be it enacted by the Senate
and House of Representatives of the Slate
of South Carolina, now met and silting in
General Assembly, and by the authority of
the same, That all persons, having resided
twelve months in the town of Green?
wood, in the Gonnty of Abbeville, are
hereby declared to be a body politio and
corporate, by the name and style of the
town of Greenwood, and its oorporate
limits Bhall be an irregular polygon, the
vertices of whose angles shall be at, or
near, the following points, to wit: 1st.
A large pine tree near J. It. Tarrant's <
residence, on the Abbeville Road. 2d. ,
A point on the New Market Road, in a <
flat just beyond James Cr es we H's resi- i
dence. 3d. The point on the road that ?
leads to W. A. Blake's, where tho Green- ?
Tille and Columbia Railroad crossed. '
4th. The first small branch on the New '
Ont Road, beyond J. W. Rycard's. 5th. 1
The hollow bridge, on the Abbeville :
Road, just beydhd J. H. Oldham's resi?
dence. '6th. The junction of the Cokes- 1
bary and Stoney Point Road.
SEO. 2. The said town shall bs go- '
verned by an Intendant and four Ward- !
ons, who shall be elected on the second j
Monday in January next, and in every I
year thereafter, ten days' notice being
previously given, and all male inhabi- .
tauts of said town, who aro qualified .
under the Constitution of this State to <
vote for members of tho Legislature, i
and who have resided therein twolve <
months immediately preceding the elec- <
tion, shall be eligible to tho office of In- i
tendant or Wardens. Malo inhabitants, i
who are qualified to vote for members of
the Legislature, and who shall havo re?
sided within the limits of the corpora?
tion for sixty days immediately preced?
ing the election, shall be entitled to vote
for said Intendant and Wardens.
SEC. 8. The eleotion of Iutcndaut
and Wardens of tho said town shull be
held at sumo convenieut publie place
therein, from six o'clock in the. morning
until six o'clock in the evening, aud
when the polls are closed, tho mauagers
shall forthwith count tho votes, declaro
the eleotion, and give notico in writing
to the parties elected. It shall bo tho
duty of the Clerk of tho Court for Abbe?
ville County to give legal notico and ap?
point managers for tho first election.
And the Intendant and Wardens, for
the time being, who shall bo known as
the "Town Council of Grcnwood," shall
give the legal notico and appoint three
persons to manage all subsequent elec?
tions, who Bhall manage and declare tho
same as herein provided for the first
time of election. The managers shall,
before they open the polls for any such
eleotion, take an oath fairly and impar?
tially to condaot tho same, and tho In?
tendant and Wardens, before entering
upon tho duties of their office, shall take
the oath prescribed by tho Constitution
of this State, and also tho following
oath, to wit: "As Intendant and Ward?
ens of Greenwood, I will equally and
impartially, to the best of my ability,
exercise the trust reposed in me, and
will use my best endeavors to preservo
the peace and good order, and carry
into effect, according to law, tho pur?
poses for which I have been appointed
or elected: So help mo God." And if
any person elected Intendant and Wurd?
en Bhall refuse to serve ns such, ho shall
forfeit and pay to tho Town Oouncil of
Greenwood the sum of twenty dollars,
for the uso of said town: Provided, That
no person shall be compelled to serve
more than one year in any term of three
years.
SEO. 4. In ease a vacancy should oo
onr in the office of Intendant or Warden,
by death, resignation or otherwise, an
eleotion to fill such vacancy shall be
held by the appointment of the remain?
ing members of the Town Council, ten
days' previous notice having been given;
and in case of sickness or temporary ab?
sence of the Intendant, the Wardens
forming a Council shall havo power to
eleot one of their number Intendaut pro

SEO. 5. That tho Intendant and Ward?
ens duly eleoted and qualified shall, dur?
ing their term of office, severally and re?
spectively, be vested with all the powers
of Justices of the Peace, within the lim?
its of said town, except for the trial of
small and mean cases; and the Intendant
shall, ns often as he may deem neces?
sary, summons tho Wardens to meet in
Council, any three of whom shall consti?
tute a quorum to transact business; aud
shall bo known by the name of tho
"Town Council of Greenwood," as afore?
said; and they and their successors in
office may have and uso a common seal,
which shall bo affixed to all their ordi?
nances; and by their said corporate name
may sue and be sued, plead and bo im
pleaded, in any court of law or equity in
this State. Tho said Town Council shall
have full power, under its corporato
seal, to make all suoh rules, by-laws and
ordinances respecting the roads, streets,
markets and police of said town, as shall
appear to them necessary and requisite
for the security, welfare, good govern?
ment and convenience of the same, and
for preserving the health, peace and
good order thereof; but no fine abovo
the sum of twenty dollars shall be col?
lected by said Council, except by suit iu
the Court of Common Picas for Abbe?
ville County: Provided, That no fine
exceeding fifty dollars shall bo imposed,
and that nothing herein contained shall
authorize the said Council to make any
by-laws inconsistent with or repugnant
to the laws of this State.
SEO. G. That the Intendant and Ward?
ens shall have tho full and only power of
granting licenses for billiard tables, to
keep taverns, or retail spirituous liquors,
within tho said limits, which licenses
shall be granted in the Borne manner and
upon the same condition as they now
are, or may hereafter be, granted by thc
County Commissioners under the laws
of this State; and the powers vested iu
the County Commissioners aro hereby
granted to the said Intendant and Ward?
ens within the said limits; and all mo?
ney paid for licenses, and for fines and
forfeitures for retailing spirituous li?
quors, keeping taverns and billiard ta?
bles within the said limits without li?
cense, shall be appropriated to thc
publio use of said corporation.
SEO. 7. That it shall bo the duty ol
the said Intendant and Wardens to keep
all roads, ways and streets within theil
corporate limits open and in good re?
pair; and for that purpose, they are in?
vested with all the powers granted tc
County Commissioners; and for neglect
of duty therein, they shall bo liablo tc
the same penalties as are imposed ot
County Commissioners. The Intendant
and Wardens shall have power to cern
