Pealed by the General Assembly of Soutb Carolina, Regular Beuton, 1871 and 18791. AN ACT TO KENEW AND A M END THE CHARTER OP THE TOWN OF Ii0WNDB8VrUjE, ABBE YILIiE COUNTY, S. O. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and silling in General Assembly, and by the authority of Qie same, That from and after the pas? sage of this Act, all citizens of this State, having resided sixty days in the town of Lowudosville, shall be deemed, and are hereby declared to be, a body politic and corporate, and the said town shall be called and known by the name of Lowndesville, and its corporate limits shall extend one-half mile within its pre? sent limits, to be fixed as a centre by a majority of the inhabitants of the said village. SEO. 2. That the said town Bhall be governed by an Intendant and four Wardens, who shall be citizens of the United States, and shall have resided in this State twelve months, and shall have been residents of the said town for sixty days immediately precediug their elec? tion, who shall be elected on the second Monday in September, 1872, and every year thereafter on the first Monday iu April, ten days' public notice being pre? viously given; and that all male inhabi? tants of the age of twenty-one years, oitizens of the State, and who shall have resided in the State twelve months and in said town for sixty days immediately preceding the election, shall be entitled to vote for Intendant and Wardens. SEO. 3. That the election for Intend? ant and Wardens of said town shall be held in some convenient boase or some other convenient public place in the said town, from 6 o'clock A. M. nntil 6 o'clock P. M., and, when the polls shall be dosed, the Managers shall forthwith count the votes and proclaim the eleo tion, and give notice, in writing, to the personB elected. The Intendant and Wardens shall appoint three Managers to hold the ensuing and subsequent eleo* tiona. Whenever there shall not be an Intendant and Wardens, or Intendant and Warden, from any cause whatever, it shall be the duty of the Clerk of the Court of Abbeville County to order Boob eleotion forthwith, and appoint three Managers for the same. The Managers in each case shall, before they open the polls for said eleotion, take an oath fairly and impartially to conduct the same; and that the Intendant and Wardens, before entering upon tho duties of their respective offices, shall take the oath prescribed by the Constitution of this State, and also the following oath, to wit: "As Intendant (or Warden) of the town of Lowndesville, I will equally and impartially, to the best of my ability, exeroiso the trust reposed in me, and I will use my best endeavors to preserve the peaoe and carry into effect, accord? ing to law, the purposes for which I have been elected. So help me God." The said Intendant and Wardens shall hold their offices from the time of their eleotion nntil the first Monday in April ensuing, and until their successors shall be elected and qualified. SEO. 4. That if in any case a vacancy shall occnr in the office of the Intend? ant, or any of the Wardens, by death, resignation, removal, or otherwise, or :z case of a tic in said eleotion, an eleo? tion to fill such vacancy shall be held by the appointment of Intendant and War? dens, (or Warden as the case may be,) or the Clerk of the Court of Abbeville County, if there should bo no Intendant or Wardens, ten days' notice thereof be? ing previously given; and in case of the sickness or temporary absence of the Intendant, the Wardens, forming a Counoil, shall be empowered to elect one of their number to act in bis stead dur? ing the time. SEC. 5. That the Intendant and War? dens, duly elected and qualified, thal!, during their term of servioo, severally and respectively, be vested with all the power and jurisdiction of Magistrates within the limits of the said town, and the Intendant shall, and may, as often as he may deem necessary, summon the Wardens to meet in Council, any two of whom, with tho Intendant, may consti? tute a quorum to transact business; aud they shall be known by tho name of the Town Council of Lowndesville; and they, and their successors hereafter to bo elected, may have a common seal, which shall be affixed to all the ordinances; and the said Town Council shall have author? ity to appoint, from time to time, as they may see fit, such and so many pro? per persons to aot as Marshals or Con? stables of the said town, as the said Town Council may deem necessary and expedient for the preservation of the peaoe, good order and police tboreof; wbioh persons, so appointed, shall, within the limits of said town, have tho powers, privileges and emoluments, and be subjeot to all the obligations, penal? ties and regulations provided by law for the office of Constable, and shall be re? moved at tbe pleasure of tho said Town Counoil; and tbe said Town Council shall have powet to establish, or to au? thorize the establishment of, the market house in said town; and the said Town Council shall have full power and au? thority, under their corporate seal, to make all such mles, by-laws and ordi? nanees, respecting the streets, roads, market house, and the business thereof, and the police system of Baid town, aa shall appear to them neoeseaay and pro? per for the seourity, welfare and conven? ience, and for preserving health, order and good government within the same; and the said Town Counoil may impose fines for offences against their by-laws and ordinances, and appropriate the same to the public use of said town; and the said Counoil shall have the same power which Magistrates now have, to compel the attendance of witnesses, and require them to give evidence upon the trial before them of any person for a violation of any of these by-laws or ordinances; but no fine above the sum of twenty dollars shall be colleoted by the Town Counoil, except by suit in the Court of Common Pleas: And provided, also, That no fine shall exceed fifty dollars; and, also, that nothing herein contained Bhall authorize the said Coun? oil to make any by-laws or ordinanoes inconsistent with, or repugnant to, the laws of this State; and all the by-laws, rules and ordinanoes tho said Council may make, shall, at all times, bo subject to r?visai or repeal by the General As? sembly of this State. SEO. G. That tho said Intendant and Wardens Bhall have full pbwer to abate and remove nuisances in tho said town; and it shall also bo their duty to keep all roads, ways and streets, within the corporate limits of the said town, open and in good repair; and for thnt purpose they are invested with all tho powers heretofore granted to Commissioner's of Roads; and shall huve full power to classify and arrange the inhabitants of said town liable to street, roud or other pnblio duty therein, and to force the performance of snell duty, under such penalties as are now, or shall hereafter be, prescribed by luw: Provided, That the said Town Counoil may compound with persons liable to perform such duty, upon such terms, and on the pay? ment of such Bums, as may be esta? blished by laws or ordinances: And pro? vided, also. That the individuals who compose the said Town Council shall be exempt from the performance of road and police duty; and the inhabitants ol said town are hereby exempt from road and police duty without the corporate limits of said town. SEO 7. That the power to grant 01 refuse licenses for billiard tables, to keep tavern, or retail spirituous liquors, with? in the limits of Baid corporation, be, and the same is hereby, vested in the Town Council of Lowndesville, and the said Town Council may grant licenses tc retail spirituous liquors to such persons, and in such quantities, at such rates, and upon such terms and conditions, at the said Counoil may deem best sud pro? per. And the said Intendant and War? dens Bhall have the full and only powei to impose'a tax on all shows or exhibi? tions for gain or reward, within tho city limits. And all money paid for licensee for retailing spirituous liquors, keeping taverns and billiard tables, and the tas for all shows for gain or reward, within the said limits, shall be appropriated tc the publio uso of said corporation: Pro? vided, That in no instance shall the price of a license to keep a tavern, or retail spirituous liquors, bo less than the amount that is established by tho State And provided, further. That the Intend? ant and Wardens duly elected shall nol have power to grant any license to keep tavern or retail spirituous liquors to ex? tend beyond the term for which they have been elected. SEO. 8. That the said Town Council of Lowndesville shall have full powei and authority to require all persone owning a lot or lots in said town to make and keep in good repair side-walks ic front of said lot or lots whenever tin same shall front or adjoin any of the publio streets of said town, if, in the judgment of the Council, such side? walks shall be necessary, the widtli thereof and the manner of construction to be designated and regulated by the Town Counoil. And for default or re? fusal to make and keep in repair suck aide-walks, the Council may cause the Hame to be made or put in repair, and require the owner to pay the price ol making or repairing: Provided, Thal Buch contracts for making or repairing be let to the lowest bidder. SEO. 9. That the said Town Council of Lowndesville shall have power to ai? rest and commit to jail, for a space oj time not exceeding twelve hours, and i fine not exeeeding twenty dollars, or, it lien thereof, to work the publio roads streets, bridges, &o., within said corpo rate limits, twenty days, any person oi persons who may bo guilty of disorderly conduct in said town, to the auuoyauc< of citizens thereof; and it Bhall bo th< duty of the Marshal of the town to niaki such arrests, and call to his assistuuci the posse comitatus, if necessary; and upon fuilure to perform such duty, h< shull be fined in a sum not more thai twenty dollars, for each aud every of fence. SEO. 10. That tho said Town Counci of Lowndesvillo shall havo power ti grant or refuso licenses, to parties withii the limits of said town, aud tho partie to whom such licenses uro grautet shall be subject to such regulations a may, by ordinance, bo established. The; shall also have power to impose and col leot an annual tax upon the assessed pro perty of said town: Provided, No ta shall be imposed, in any ono year, to es ceed tho rate of ten cents on each hun dred dollars of such assessed properly and the money so raised shull bo applie to tho use of said town. Tho said Tow Council shall hove power to euforco th payment of all tuxes levied by said Tow Council, to the same extent and in th same manner as is now or hereafter ma be provided by law for the collection t the general Stato taxes. SEC. ll. That tho said Town Couuc of Lowndesvillo shall havo power to rt gu?ate sales at auction within tho limil of said town, and to grant licenses t auctioneers: Provided, Nothing beroi contained shall extend to sales by Sin riff, Clork of the Court, Jadgo of Pro? bate, Coroner, Executor or Administra? tor, Assignee in Bankruptcy or by any j other person out of the order or decree of any Court, Justice of tbe Peace or | Magistrate. SEO. 12. Tbat tbis Act shall be deemed a public Act, und shall coutiuue iu force until repealed. Approved March 13, 1872. AN ACT TO ESTABLISH A CAUSEWAY OVER BJO SALTKEHATCHIE SWAMP, AT WALNUT POINT, CONNECTING THE COUNTIES OP COLLBTON AND BEAUFORT. SECTION 1. Be it enacted by the Senate j and Bouse of Representatives of the Stale of South Carolina, now met and sitting in General Assembly, and by the authority of I the same, That on and after the passage of this Act, it shall be competent for | the parties, hereinafter named, to estab? lish and construct a good aud substan? tial causeway across Big Saltkehatchie Swamp, at Waluut Point, connecting the Counties of Colleton and Beuufort. SEC. 2. That the causeway hereby authorized to bo established, be, and the same is, vested iu C. F. Petit, G. W. Petit, John Burnett aud Wm. Nettles, and their associates aud successors, for the term of fourtccu (li) years: Pro? vided, Suid company, or corporation, Bhall comply with the rcquiremeuts hereinafter named. SEC. 3. That it shall be the duty, and it is hereby mada one of the provisions of this charter, that the causeway herein contemplated to bo established Bhall bo constructed within twelve months from the passage of this Act; shall be built of good und sound material, and always be kept in good repair, and shall be, when constructed, at least twelve inches above tido water, aud its abutments be of such a character as to resist, in tho event of a freshet, its being washed away; and for tho better currying out of this provision, it is hereby mudo the duty of the Com? missioners of Kunda of tho Counties, heretofore named, to inspect said cause? way in course of construction, and after completion, and see that the foregoing specified requirements be complied with. SEO. 4. They shall bo authorized to ask, demand aud receive, for crossing the said causeway when completed, the fol? lowing rutes of toll: For each foot pas? senger, tho sum of five cents; each pas? senger on horseback, ten cents; each carriage or vehicle drawn by ono horse, tweuty cents; euoh carriage or vehicle drawn by two horses, thirty cents; each carriage or vehicle drawn by four horses, fifty cents; each loose horse or mule, five cents; head of cuttle, goats, sheep or hogs, two cents: Provided, however, No toll Bhall bo exacted from a miuister attending his circuit, officers in the discharge of their duties, voters at? tending the poll, and children goiug aud returning from school. Be il enacted by the Senate and House of Representatives vf the Slate of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That from uud immediately after the passage of this Act, Isaac Good? win, A. S. Night, A. Worthy, Dauiel Golden, Peter Jefferson, and all other persous who now ure, or who hereafter shall or muy become, members of the said church, shall be, and they are hereby declared to be, a body corporate, by the name aud style of tho Zion Baptist Church, and by their said Dame shall have succcssiou of officers and members, and have a common seal. SEC. 2. That the uaid coi por.ition shall have power to purchase, receive and possess any real or personal property, uot execcdiug iu value tho sum of twenty thousand dollars, or to sell tho same, and by its oorporato namo to sue and bu sued iu any court of this State, aud to make such rules and by-laws, not repug? nant to law, as may bo thought neces I sary and expedient.
