AN A OT TO AMEND THE CHARTER OF THE TOWN OP LANCASTER. SECTION 1. Be it enacted by the Senate and House of Representatives of the Slate ,of South Carolina, now mel and sitting in General Assembly, and by the authority of the same, That from and after tho pas? sage of this Aot all oitizens of this State, having resided sixty days in the town of Lancaster, shall be deemed, and are hereby declared to be, a body politic and corporate, and the said town shall bo called and known by the name of Lancaster, and its corporate limits shall extend one mile in each direction from the Court House in said town. SEO. 2. That the said town shall be governed by an Intendant and four Wardens, who shall be oitizens of the United States, and shall have been resi? dents of the said town for sixty days immediately preceding their election, who shall be elected on the second Mon? day in April, in every year, ten days' publio notice thereof being previously given, and that all male inhabitants twenty-one (21) years of age, oitizens of the State, and who shall have resided in the said town for sixty days immediately preoeding the election, shall be entitled to vote for said Intendant and War? dens. SEO. 3. That the election for Intend? ant and Wardens of said town shall be held in the Court House, or some other placo convenient in said town, from eight o'clock in the morning until five o'clock in the afternoon; and when tho polls shall be closed, the Managers shall forthwith count the votes, and proolaim the election, and give notice in writing to the persons oleoted. The Chairman of the Board of County Commissioners shall appoint throe Managers to hold the ensuing and any subsequent election. The Managers, in each case, before they open the polls for said election, shall take an oath fairly and impartially to conduct tho same. And tho Intendant and Wardens, before entering on the duties of their respectivo offices, shall take the oath prescribed by tho Constitu? tion of this State, and also tho follow? ing oath, to-wit: "As Intendant (or Warden) of the town of Lancaster, I will equally and impartially, to the best of my ability, exercise tho trust reposed in me, and will uso my best endeavors to preserve the peace, and to carry into effect, according to law, the purposes for which I have been elected. So help mo God." The said Intendant and War? dens shall hold their offices from the time of theil election, until the second Monday in April ensuing, and until their successors shall bc elected and qualified. SEO. 4. That .tho said Town Council of Lancaster shall have power to arrest and commit to jail, for a space of time not exceeding twelve hours, and to fine,' not' exceeding twenty ($20) dollars, any person or persons who shall be guilty of disorderly conduot in said town, to tho annoyance of citizens thereof. SEC. 5. That this Act shall be deemed a publio Aot, and shall continue in force nntil repealed. Approved March 9, 1872. AN ACT TO ALTER AND AMEND THE CHAR? TER OF THE TOWN OF PENDLETON. SECTION 1. Be if enacted by the Senate and House of Representatives of the Slate cf South Carolina, now met and sitting in General Assembly, and by the authority of the same, That all persons, oitizens of the United States, who now reside, or may hereafter reiide, in the village of Pendleton, shall bo deemed, and are hereby declared, a body corporate and politio; and the said village shall be called ?nd known by tho name of Pen? dleton; and its limits shall be held and deemed to extend for one milo in every direction irom the Fanners" Hall. SEO. 2. That the said village shall bo governed by an Intendant and four Wardens, who shall bo eleoted on the fourth Monday in September, and con? tinue in office until tho second Monday in September next, or until their suc? cessors are qualified, on which day, as well as on the second Monday in Sep? tember of every year thereafter, au elec? tion shall bo held for an Intendant and four Wardens, at such place as tho In? tendant and Wardens shall designate, thirty days' notioe being previously given; and that all malo inhabitants of tho said village, who have attained thc age of twenty-one yoars, and have re? sided therein throe mouths previous to .tho election, shall bo entitled to vote for the said Intendant and Wardens; tho eleotion to be held from ten o'clock in the morning until two o'clock in tho afternoon; and when the polls shall be closed, tho Managers shall count tho ballots, and proolaim tho eleotion, nud give notice thereof, in writing, to tho persons eleoted; and that tho Intendant and Wardens, for tho timo being, shall always appoint throe Managers to hold tho ensuing olection; that tho Intendant and Wardens, before entoring upon tho duties of their offices, shall tako the fol? lowing oath, to wit: "As Intendant (or Warden) of Pendleton, I will support and * defend the Constitution of tho United States, and this Stato, and equal? ly and impartially, to tho bost of my I skill ?nd ability, exercise- the trust re? posed in' me, aud will Use my best en? deavor to preserve the peaoe, and carry into effect, according to law, the pur? pose of my appointment: So help me God." SEO. 3. That in oase a vacancy shall occur in the officoa of Intendant or Wardens, by death, resignation, removal from offioe, or absenoe from the State, an election shall be held by the appoint? ment of the Iutoudaut and Wardens, as tho case may be, thirty days' previous notice being given; and in case of the siokness or temporary abBenoe of the In? tendant, the Wardens, forming a Coun? cil, shall bo empowered to elect one of themselves to act ns Intendant during the time. i SEO. 4. That the Intendant and Ward? ens daly elcoted and qualified shall, I during their term of service, severally and respectively, be vested with all the powers of Trial Justices of tbis State, within the limits of the said village, ex? cept in trials of civil cases; that the In? tendant shall, as often us occasion may require, summon tho Wardens to meet him in Council, a majority of whom shall constitute a quorum for tho trans? action of business, and shall he kuown by the name of the Town Council of Pendleton; and they and their succes? sors in office shall have a common seal, and shall have power and authority to appoint, from time to time, such and so many personB to aot as Constables as they may deem expedient and proper, which Constables shall have all the pow? er, privileges and emoluments, and be Bubject to all the duties, penalties and regulations provided by the laws of this State for tho office of Constable; and the Intendant and Wardens in Council shall have power, under their corporate seil, to ordain and establish all such rule?, by-laws and ordinances, respect? ing the'streets, ways, market and police of such villago, as shall appear to them proper for the security, welfare and con? venience of the village, and for preserv? ing health, peace, order and good go? vernment within the samo; and the said Council may affix fines for offences against such by-laws and ordinances, and appropriate them to tho uso of the corporation; but no fine shall exceed twenty dollars; and when fines shall ex? ceed ten dollars, they may be recovered in the Court of Sessions for Anderson County; and when they aro of thc amount of twenty dollars, or under, they may be recovered before tho In? tendant and Wardens: Provided, No? thing heroin container! shall empowei the said corporation to ordain or estab? lish any by-laws or ordinances, incon sistent with, or repugnant to, tho lawi of this State; and all such by-laws and ordinances shall, at all times, be suhjec to the r?visai or rop?ul of tho Legisla ture. SEO. 5. That the said Intendant am" Wardens shall have power to abate ant remove nuisances withiu tho said limits, and to classify and arrango tho iuhabi tants liable to police duty, and to re quire them to perform such duty a; often as occasion may require, and t< enforce tho performance thereof, uudei tho samo penalties as aro now, or moy bi hereafter established hy law; and thu the said Intendant and Wardens, or anj of thom, upon view thereof, or upor complaint lodged, on oath, aro herebi required and authorized to issun war rants against all offenders, and causi them to be brought heforo them, oi him, and,? upon examination, shall cithei release, admit to hail, (if tho offence bi bailable,) or commit to jail, such offend ers, as the caso may require; and tin Sheriff of Anderson County is hereby re quired to receive and keep the person s< committed until discharged by dm oourse of law. And that the said In tendant and Wardens shall, collcctiveb and severally, have cognizanco withii tho said corporate limits, in all crimino cases, as Justices of the Penco and Quo rom have according to law. SEC. 6. That the Intendant and Ward ens of the said town shall have full am only power to grant or refuse licenses ti retail spirituous liquors withiu the sail limits, which license shall be granted ii the same manner, and upon tho sam conditions, as they are now, or ma; hereafter be, under tho laws of thi State, except that the Town Counci shall have power to regulate tho price o licenses to keep taverns and to reta: spirituous liquors: Provided, That i; no instance the prico of a licenao so t keep tavern or retail spirituous liquor shall be fixed at a less sum than ii est? blished by tho law of the Stato; and a tho powers formerly vestod in the Con missioners of Roads aro hereby gran to to the said Intendant aud Warden within the said limits; and all money paid for license, and for fines au forfeitures for retailing spirituous 1 quor8, keoping taverns and billiar tables within tho said limits withot license, shall be appropriated to the ut of said corporation. SEC. 7. That the said Intendant un Wardens shall havo power to compone with persons liable to work on sai roads, streets and alloys, to releaso RUC persons as may desire it, upon a fa equivalent therefor, to bo applied L them to the use of tho said corporatioi and no person residing within tho sai limits shall bo liable to work on an road without said limits, or to bc taxe or assessed for tho same. SEC. 8. That tho Town Council i Pendleton shall have powor to impoi an aunual tux upon tho keepers of bi liard tables and ton-pin alloys, or at other pin alleys, within tho discretion i onid Council, and to grant or refuse i censes for tho same, upon Bach tor? and conditions, and subject to such r gulations, as they may by orditianco c tahlish. Thoy shall also havo power impose a tax, within their discretion, ( all sales mado hy itinerant traders ai auctioneers, on nil public drays, wngor carriages, omnibuses, or other volt iel kept for biro, and on tho owner or pc scssor of all dogs, hogs, tdiccp, goals ai cattle kept withiu the corporate limits said town, Tho said Town Con nc il shall have power to impose an annual tax on the amount of all sales of goods, wares, merchandize, and also on the amount of income arising from all factorage and mechanical employments, faculties and rofessions, inoluding the profession of entiBtry: Provided, That no 'tax shall be imposed in any one year to exceed the rate of twenty cents on each hun? dred dollars of the value of Bach sides and income; and the said Town Council Bhall also have power tc impose a tax upon all persons who shall open any room or car for the purpose of taking daguerreotypes or other likenesses, within the corporate limits of said town; and the said Town Council shall have the power to impose an annual tax, not exceeding twenty cents on every hun? dred dollars of the value of all real es? tate lying within the corporate limits of said town, the real estate of churches and school associations excepted; and for that purpose they shall appoint three freeholders, resident therein, to assess tho value of said real estate, upon oath, and return tho assessment, within ono month, to said Council, for taxation, and to lill any vacancy occasioned by the death, resignation, rofusal to 6erve or removal from office of tho said assessors; and any person who shall refuse to net as assessor, upon being appointed by tho Council, may be fined any sum not ex? ceeding twenty dollars; and tho said Couucil shall have power to regulato tho prico of license upon all public showB and exhibitions in said town, and to erect a powder magazine, and to compel any person holding moro than twenty iivo pounds of powder to s tor o thc samo therein, and to make regulations for rates of storage thereof, and for keeping and delivering tho same; and tho said Town Council shall have power to en? force the payment of all taxes and as? sessments levied under tho authority of this Act against tho property aud per? sons of defaulters, to tho samo extent and in tho same manner as is provided by law for tho collection of tho general State tax, except that executions to en? force the payment of tho town tax shall he issued under the seal of tho corpora? tion, and directed to tho Town Marshal, or other person specially appointed by tho said Town Council to collect tho sumo; and all property upon which a tax shall be levied and assessed is hereby declared to bo liablo for tho payment of tho same in preference to other debts duo by tho persons owning such property nt the time of tho assessment, except debts due tho State, which shall first be paid; that the said Town Couucil shall have power, with tho consent of tho ad? jacent laud-owners, to close all such roads, streets and ways within the said town, as they may deem necessary, by salo of tho freehold thereiu, either ut public or private sale, as they adjudge best for tho interest of tho said town ; aud they shall have power to lay out, adopt, open and keep in repair all such new streets, roads and ways, from time to time, na they may deem important or necessary for tho improvement of said town: Provided, That no new street, road or way, Bhall bo opened without (irst having obtained the consent Of the laud-owner or owners through whoso premises any such new street, road or way may pass. Jouos; and whereas it is also tho desire of T. J. SEC. 2.
