AH ACT TO AMEND AN ACT ENTITLED "AN ACT TO RENEW AND AMEND THE Oil A UTE It OP THE TOWN OF MOUNT PLEASANT." SECTION 1. Be ii enacted by the Senate . and Bouse of Representatives of thc State of South Carolina, tiow met and sitting in G?n?ral Assembly, and by the authority of the same. That the said Town Council shall havo power to borrow money for the pnblio use of the corporation, by is? suing, from time to time, as occasion may require, the bonds of said corpora? tion, bearing interest at a rate not to ex? ceed ten per contum per annum, to be paid semi-annually, for an amount not to exceed the sum of two thousand dol? lars; and for the payment of tho interest, and the ultimate redemption of the principal, aoeording to the terms of tho loan, the said corporation shall, at all times, bo liablo: Provided, That the private property of the inhabitants of said town shall be bound for the redemp? tion of said loan in no other way than by tho imposition of an annual tax, ac? cording to the provisions of this Act. SEC. 2. That the corporate limits of the town of Mount Pleasant be, and the same is hereby, extended by continuing the Eastern line of Boundary street Northwardly to Shem Creek, from which point the said creek and the waters of Charleston harbor shall be the boundary. SEC. 3. That the Town Council cf Mount Pleasant shall have power to im? pose and collect an anunal tax upon the assessed property of said town: Pro? vided, No tax shall be imposed in any one year to exceed the rate of fifty cents on each hundred dollars of such assessed property; and that the money so raised shall be applied to the use of the said town. The said Town Connoil shall have the power to onforoe the payment of all taxes levied by the said Town Council, to the same extent and in the same manner as is now or hereafter shall be provided by law for the collection of the general State taxes. SEO. 4. All Aots and parts of Aots in? consistent with the provisions of this Aot are hereby repealed. Approved March 12, 1872. AN ACT FOB THE PROTECTION AND PRE? SERVATION OF USEFUL ANIMALS. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by tho authority of the same. That it shall not be lawful for any person in this Stato to kill any deer, or worry them with dogs or otherwise, with the intention of destroying them, between the 1st day of January aud tho 1st day of September, in any year here? after. SEO. 2. That any person violating tho foregoing provisions of this Act shall, upon conviction thereof, be fined not lesa than twenty dollars, or be impri? soned not less than twenty days, which fine, if imposed, shall be recoverable be? fore any court of competent jurisdic? tion; one-half thereof shall go to the . informer, and the other half thereof to the sohoo) fund of the said County. SEO. 3. That any person in whoso pos? session reoently killed venison or fresh deer skins shall be found, between the dates above mentioned, shall be liable to the same penalty as those violating Sec? tion 2 of this Aot. SEO. 4. That it shall not be lawful for any person in this State, between the 15th day of. February and the 15th day of Ootobor, in any year hereafter, to catch, kill or injure, or to pursue with suoh intent, or sell, or expose for Bale, any wild turkey, partridge, dove, wood? cock, snipe or pheasant; aud any porson found guilty thereof shall bs fined not less than ton dollars, or be imprisoned not less than ten days; which fine, if im? posed, shall go one-half thereof to the informer, and the other half thereof to the school fond of the County whoro the offence was committed. SEO. 5. That it shall not bo lawful for any person in this State to wan (.only shoot, or entrap, for the parp?se of killing, or in any other manner destroy any bird whoso principal food is insects, or take or destroy tho eggs or young of any of the species or varieties of birds that aro protected by the provisions of this Act, comprising all the species and varieties of birds represented by the several families of swallows, bats, whip-poor-wills, fly catobers, thrash? ers, warblers, finches, larks, orioles, nut-hatchers, wood-peckers, humming birds, mocking birds, blue birds, red birds and, robbins, and all other species and varieties of land birds, whether groat or small, of evory de? scription, regarded as harmless in their habits, and whose flesh is unlit for food, including the turkey buzzard, but exoluding tho jaokdaw, the orow, the orow blackbull, the eaglo, and all hawks and owls, whioh prey upon other birds; and any person violating tho provisions of this section shall, on conviction there? of, forfeit and pay a fine of ten dollars, or be imprisoned not less than ten days, which fine, if imposed, shall go, one half to the informer, and the other half thereof to tba school fuud of tho Conn ty in whioh tile offence was committed: Provided, That no porson shall be pre? vented from protecting any crop of fruit or grain on bis own lauds from tile depredations of any birds herein in tended to be protected. SEO. 6. Whenevor a person ?ball have made or created an artificial pond on bia own land, and shall pnt therein any fish, or the eggs of any fish or oyster, for tho purpose of breeding and culti? vating fish or oysters, and shall give no? tice thereof, by written or printed hand? bills, pat in publie places near said pend; and any person who shall there? after enter in or about such pond for tho purpose of fishing, or shall catch or take away any fish or oysters therefrom, or shall be guilty of oommitting any trespass npon any artificial fish pond by fishing in the samo, or in any manner using any means to destroy tho fish or oysters raised or coll co ted in auch pond, or by breaking the dam or dunn for the purpose of permitting the fish or oysters to escape, or by poisoning the same, or in any manner destroying or injuring the same; and any such person or per? sons, upon conviotion, s?mil be deemod guilty of a misdemeanor, and shall bo subject to a flue o? nut ?ess than twenty dollars nor moro than uno hundred dol? lars, or bo imprisoned at the discretion of the court; which fine, if imposed, shall go, one-half thereof to the inform? er, and the other half thereof to tho per? son or persons whose property shall have beon injurod: Provided, Thai no? thing in this seotion shall bo construed as applying to ponds used as wator pow? er for manufacturing purposes. SEO. 7. That it shall not be lawful for any person in this State, after tho first day of April, 1872, to take any trout from tho streams thereof, by impregnat? ing the waters with poisonous or delete? rious substances; and any person violat? ing this provision shall, upon conviction thereof, be fined ten dollars for every such offence, or be imprisoned not less than ton days, which fine, if imposed, shall go, one-half thereof to the inform? er, and tho other half to tho school fund of tho County in which 6uch offenco shall have been committed. SEO. 8. This Act shall take effect from and after its passage. Approved Maroh 12, 1S72. AN ACT TO INCORPORATE TIIE ORANOEBUHG COUNTY FAIR ASSOCIATION. SECTION 1. Be it enacted by thc Senate and House of Representatives of the Statt or~ South Carolina, now met and sitting is General Assembly, and by the authority oj (lie same, That William F. Barton, Sam? uel Dibble, Harpin Riggs, Laurence R. Beckwith, Wesley W. Culler, James D. Trezevant, Berry Byas, J. L. Jamison, Henry Johnson and T. W. Sasportas, and their associates ard successors, be, and they are hereby declared to be, e body corporate and politic, iu law and in deed, by the name of the "?rangeburg Fair Association," and by tho said name shall have perpetual succession of officer* I and members, and a common Beal, witb power to chango the same as often as thc said corporation shall judge expedient and the said corporation shall bo liable and capable in law to purchase, have, hold, receive, enjoy, possess and refait to itself and its successors in perpetuity, and any and every estate, real or per sonal, whether accruing lo the same bj gift, purchase, devise or conveyance, nol exceeding in value fifty thousand dol lars, and the Bama, or any part thereof to sell, alien, deviso or exchange as oftci as tho said corporation may deem pro per; and by i ts uamo to suo and bo sued implead aud bo impleadud, auswor ant be answered unto, in any court of law ii the State, and to mako all such by-law: and rules for tho government of tho fait corporation as may, from timo to time bo deemed necessary: Provided, Sud by-laws and ruleB be not repugnant tc the laws ?of the land. That tho principal end of th? said corporation shall be tho promotioi of agriculture, mechanical arts, aui other industry and ingenuity, througl an annual fair, and other appropriati measures, according to such roles ant regulations as they may soo fit to estab Heh. That the members of tho sah corporation shall bo, severally, liable fo all debts and contracts of said corpora Hon only to tho extent and amount o their respective shares therein; and th capital stock of tho said corporation ?hal not bo less than live thousand nor mor than fifty thousand dollars. That the said Grand Lodgo shall havo power to oollect its revenue and to apply tho same, according to thc ancient custom of the order, or may loan out tho samo for tho purposo of aiding in benevolent enterprises, or for the purpose of accumulation: Provided, That the funds in money, or choses in action, shall not exceed, in available assets, tho sum of fifty thousand dollars at any ono time, and shall not bo loaned upon usurious iutorest, nor shall thc funds or accretious thereof bo used otherwise than for tho payment of thc expenses of tho 6uid Grand Lodge aud for charitable purposes; and being thus set apart, tho same shall not be liable to taxation. SEC. 3. That all contracts made, or obligations assumed heretofore, which are not inconsistent with tho laws of tho land, by eaid Grand Lodge, be, and thc same are hereby, made valid aud bind? ing upon said Grand Lodge, as organ? ized under this charter, and the accept? ance of this charter by a resolution of said Grand Lodge shall bc all that is re? quired to completo its organization undor thc same. SEC. 4Z.
