AN ACT TO IN0ORFOSATB THK VHiIiAQB OF
IiITTZiB ROCK, IN THB COUNTS OP MA?
RION, AND FOB. OTHEBPUBPOSBS THEREIN
MENTIONED. " ,
SECTION 1. Be ii enacted by the Senate
and House of Representatives of the State
of Soutit Carolina, novo met and sitting in
General Assembly, and by the authority of
the same. That from and after the pasa-,
age of this Act, all oitizens of this State,>
having resided twelve months within!
this State, and sixty days in the town! of
tuttle Bock, shall bs deemed, and are
hereby declared to be, a body politic
and corporate, and the said town shall
be called by the name of Little Book,
and ita corporate limits sholl extend
three-fourths of a mile in each direction j
from the Methodist Church, in said
town: Provided, That the corporate
limits of said town sholl not extend be?
yond the Little Pee Dee Biver.
SEO. 2. That the said town sholl be
governed by an Intendant and four
Wardens, who sholl be oitizens of the
United States, and who shall have re?
sided in this State twelve months, and
shall have been residents of the said
town Sixty days immediately preceding
their election. The said Intendant and
Wardens shall be elected on the seoond
Saturday in April, in every year, five
days' notioo being previously given,
and shall continuo iu office for one year,
and until the election and qualification
of their successors; and all mole inhabi?
tants of said town, who shall hove at?
tained the age of twenty-one years, pau?
pers and persons under disabilities for
infamous crimea exoepted, and shall
have resided therein sixty days imme?
diately preceding the election,.shall be
entitled to vote for said Intendant and
Wardens.
Bxo. 3. The Bald election shall be hold
' in some convenient public place in said
town, from six o'clock in the morning
until four o'clock iu the evening, and
when the polls shall be closed, the Ma?
nagers shall forthwith count the votes
ana declare the election, and give notice
thereof in writing to the persons elected.
The Intendant and Wardens, before en?
tering upon the duties ot their offloes,
snell each take the oath prescribed by
the Constitution of this State, and also
the following oath, to wit: "Aa In?
tendant, (or Warden, as the case may
be,) of tho town of Little Book, I will
equally and impartially, to the best of
my ability, exercise the trust reposed in
me, and will Use my best endeavors to
preserve tho peaoe, and oarry into effect,
according to law, the purposes for
which I have been elected: So help me
God." 'And if any person, upon being
elected Intendant or Warden, shall re?
fuse to aot BB such, he shall forfeit and
pay to the Town Counoil the sum of ten
dollars, for the use of said town : Pro?
vided, That no person who has attained
the age of sixty years shall be compelled
to serve in either of said offices, nor
shall any other person be compelled to
serve more than one year in any term of
three years. The Intendant and Ward?
ens, for the time being, shall always ap?
point a Board of three Managers to
conduct the eleotion, who, before they
open the polls, shall take au oath fairly
and impartially to oondaot the same.

second Saturday in Maroh, one thou?
sand eight hundred and seventy-two.
SEO. -i. That ia case a vacanoy shall
ocouf in the office of Intendant or any
of the Wardens, by death, resignation,
removal or otherwise, an eleotion to fill
such vacancy shall be held by order of
the Intendant and Wardens, or a ma?
jority of them, five days' publio notice
being previously given; and in case of
sickness or temporary absenco of tho lu?
te adaut, the Wardens, forming the
Council, shall ho empowered to elect ono
one of their number to aot os Intendant
for the time being.
SEO. 5. That the Intendant and War?
dens, daly elected and qualified, shall,
during their term of office, severally and
respectively, be vested with all tho pow?
ers heretofore granted to Magistrates,
Trial Justices or Justices of the Peaco,
as the case may bo, in this Stato, within
tho limits of the said town, except for
the trial of causos small ond mean. And
the Intendant shall and may, as often as
may be neoessary, summon the Wardens
to meet in Counoil, any two of whom,
with tho Intendant or any threo War?
dens, may constitute a quorum to trans?
act business, and they shall be known as
tho Town Council of Little Book, and
they and their suooessors, hereafter to
be elected, may hove a common seal,
which shall bo affixed to all their ordi?
nances; may su? and be sued, plead and
bo impleaded, in any court of law or
equity in this Statei and may purchase,
hold, possess and enjoy, to them and
their successors, in perpetuity, or for
any term of years, any estate, roal, per?
sonal, or mixed, and sell, aliou or con?
vey the same: Provided, The same shall
not exceed, at any ono time, the sum of
teu thousand dollars. And tho Intend?
ant and Wardons shall have full power
to moko and establish nh such rules, and
by-laws, and ordinonco?, respecting tho
rotula, fctieetiv market and police of said
town as shall appear,to theta neoessary
and requisito for the security, welfare
and convenience of the said town, or
for preserving health, peace, order and
good government within the samo. And
the said Town Connell may fix and im-'
pose fines and penalties for tho violation
thereof, and appropriate the same to tho
publio uses of the said corporation:
Provided, That no flue shall exceed fifty
dollars for any offence; and, also, that
nothing herein contained ?Indi authorize
the a?id Council to mako any by-laws
inconsistent with or repugnant to the
Constitution and laws of this State; and
all by-laws and ordinances the Council
may make shall, at oll times, bo Bnbjeet
to revision or repeal by tho Legislature
ot this State.
SEC. 6. That the Intendaut and War?
dens of said town shall have full power
tq grant or refuse licenses to keep, ta?
verns,' or to retail spirituous li quorn,
within tho corporate limits of said town,
upon.-each conditions and under such
circumstanced as to them shall seem
proper and right: Provided, That in no
instance shall the pri?e of a licenso to
keep a tavern, or to retail spirituous li?
quors, be at a lesa eura than is esta?
blished by the laws of thia State; and all
moneys paid for licenses, and for fines
and forfeitures for retailing spirituous
liquors, keeping taverns and billiard
tables within the said limits without li?
censes, shall be appropriated to the pub?
lic uses of caid town: Provided, That
the Intendant and. Wardens shall not
have power to grant any license to keep
taverns, or to retail spirituous liquors,
to extend beyond the term for which
they have been elected.
SEO. 7. That it shall bo the duty of
the said Intendant and Wardens to keep
all roads, ways, bridges and streets,
within the cor poi ate limits, open, and in
good repair; and they may lay out now
streets, close up, widen or otherwise
alter those now in use, and for that pur?
pose they are invested with all the pow?
ers and duties of County Commissioners,
or Oommissioners of Hoads, for and
within the corporate limits of said town.
They shall have power to compound
with ali persons liable to work the streets,
ways and roads of said town, upon such
terms as they shall, by ordinance, esta?
blish ; the moneys so received to be ap?
plied to the publio use of said town ; and
all persons refusing to labor, or failing
to pay such commutation, shall be liable
to such fine, not exceeding twenty dol?
lars, as the Town Counoil may impose.
SEO. 8. They shall have tho power to
impose au annual tax, not exceeding
fifty cents on every hundred dollars of
the value of all real and personal pro?
perty, lying within the corporate limits
of said town, the real and personal pro?
perty of churches and school associa?
tions excepted. The said Town Counoil
shall have power to regulate tho price of
licenses upon all publio shows and exhi?
bitions in said town, to erect a powder
magazine, and compel any person hold?
ing moze than twenty-five pounds of
powder to store the same therein, and to
make regulations for rates of storage
thereof, and for keeping and delivering
the same. The said Town Counoil shall
have power to enforce the payment of all
taxes and assessments levied under the
authority of this Act, against the pro?
perty of defaulters, to tho same extent
and in the same manner oe is provided
by law for the collection of the general
State tax, exoept that executions to en?
force the payment of the town taxes
shall be issued under the seal of tho cor?
poration, and directed to the Town Mar?
shal, or other person especially appoint?
ed by the said Town Counoil to collect
the naine; and all property upon whioh a
tax shall bo levied and assessed is horoby
declared and made liable for the pay?
ment thereof in preference to all other
debts against the enid property, excopt
debts due the State, which shall bo first
paid.
SEO. 9. Tho said Town Council shall
have power and authority to require all
persons owning a lot or lots in said
town, to dose in, and to make and keep
in good repair, sidewalks in front of said
lot or lots, whenever the same shall front
or adjoin any publio street of said town,
if, in the judgment af tho Council, such
sidewalk shall bo nocessary, the width
thereof and the manner of construction
to be designated and regulated by tho
said Council; and for default or refusal,
after reasonable notice, to make and
keep in good ropair such sidewalks, und
to olose in suoh lot or lots, the Town
Counoil may cause tho same to be made,
or put in repair, and require the owner
to pay the prico of making and repair?
ing. And tho said Town Council are
hoteby empowered tosuo for and receive
the same by action of debt in any oourt
of competent jurisdiction: Provided,
That such oontraot for making or repair?
ing bo let to tho lowest hiddor. Tho

SEO. 10. Tho said Town Council shall
have power, with the consent of the ad
jaount land-owners, to closo all such
roads, streets and Ways within the said
town as thoy may deem necessary, hy
sale of tho lroehold therein, either ut
private or publio sale, us they may ad?
judge boat for tho interest of tho said
town; and they shall have, niuo, power
to lay out, adopt, widen or otherwise
alter those streets now la nse, open and
koop in repair all such new streets, roads
und ways, as they may, from timo to
time, deem necessary for tho improve?
ment or oonveuieuoo of ?aid town: Pro?
vided, That no street, road or way shall
be opened without first having obtained
the consent of the land-owner or ownors
through whoso promises auy ouuh new
street, road or way may poss.
SEO. ll. Tho said Town Council shall
have power, and aro hereby authorized,
to elect ono or moro Marshals, to fix
their 'salaries and prescribo their duties,
who shall bo sworn in, and invested with
all tho powers and subjected to all the
duties and liabilities that Constables now
havo, or aro subject to, by law, in addi
fcioo to the duties sod liabilities specially
conferred and empowered ou them by
the Town Oounoil: Provided, That their
jurisdiction shall be confined within the
limits of the said town.
SEO. 12. That tho said Town Council
shall have power to establish a guard
house, and to prescribe, by ordinanao,
suitable rules and regulations for keep?
ing and governing tho same; and the
said Town Council may, by ordinauco,
or tho said Intendant or Wardens iu
person, any ono Or moro of them, au?
thorize and require any Marshal of the
town, or any Constable, specially up
pointed for that purpose, to arrest and
commit to tho said guard house, for a
term not exceeding twenty-four hours,
any person or persons, who, within tho
corporate limits of said town, may be
engaged in any breach of tho peace, any
riotous or disorderly conduct, open
obscenity, publio drunkenness, or in
any conduct grossly ind?cent or danger?
ous to the citizens of said town, or any
of them; and it shall be tho duty of the
Town Marshal to arrest and commit all
such offenders, when required to do so,
who shall have power to call to their as?
sistance tho posas comitatus, if need be,
to aid in making suoh arrests, and upon
failure of said Marshal to perform such
duty, as required, they shall severally
bo subject to such fines and penalties as
tho Town Council may establish. And
all persons so imprisoned ehall pay the
costs and expense incideut to their im?
prisonment, which said costs and ex?
penses shall bo collected in the same
manner aa ie provided by this Act for
the collection of fines imposed for the
violation of ordinances: Provided, That
such imprisonment shall not exempt the
patty from the payment of any fine the
Counoil may impose for the offence
for which he may have been committed.
Seo. 13. The said Town Counoil shall
have power to impose and collect taxes
from all persons representing publicly
within their corporate limits, for gain or
reward, any plays or shows, of what
nature or kind whatsoever, to be
appropriated to tho publio uses of said
town.
SEO. 14. The said Town Council shall
have full power and authority to abate all
nuisances withiu tho corporate limits of
said town.
SEO. 25. The Intendant and War?
dens elect shall, during their term of
office, be exempt from street duty.
Eaoh Town Counoil shall, within ono
month after the expiration of their term
of ofiloe, make out and return to thoir
successors a full account of their receipts
and expenditures during their term,
which account shall be published iu ono
or moro papers in the County, and shall
pay over all moneys in their possession
belonging to the corporation, and shall
deliver up all books, records and other
papers incident to their office, to their
successors; and on failure so to do, they
ehall be liable to bo fined in a sum not
exeeeding five hundred dollars, to be
collected by tho Town Council.
SEO. 16. For any willful violation or
negleot of duty, mal-practice, abuso or
oppression, the said Intendant and War?
dens, jointly and severally, shall be
liable to indictment in the Court of Ses?
sions, and, upon conviction, to punish?
ment as presoribed in tho preceding
Section, besides being liable for damages
for any person or persons injured.
SEO. 17. This Aut shall be doomed a
publio Aot, and continuo in force for tho
term of fifteen years, and until the end
of tho session of tho Legislature then
next ensuing.

Moultrie, Johu Smyley, and their asso?
ciates and successors in office, be, and
they aro boroby, created aud constituted
a body politio and corporate, by and
under the namo and style of the "Star
Fire Eugine Company, of Georgetown,"
with n capital stock not exceeding tho
sum of five thousand dollars, with a
right to sno and be sued, to plead nnd
be impleaded, in any court of competent
jurisdiction, to have and uso a common
seal, and thc same to alter at will und
plensnro, and to have and enjoy all other
rights, privileges aud immunities that
aro now or may bo horoafter secured by
law to like incorporated bodies.
SEO. 2. This corporation shall enjoy
all tho rights and privileges secured to
corporations under tho Act to regulato
tho formation of corporations, and bo
subject to tho liabilities therein dc
scribed, as fur us applicable
SEO. 3. That this Act shall bo deemed
a publio Act, and shall continue in force
for tho term of fourteen years.
