Acts and Joint lleno luttons Passed by the General Assembly of South Carolina, Regular Session, 1871 and 187?. AN ACT TO INCORPORATE THE CHARLESTON, GEORGETOWN AND CONWAYBORO RAIL? ROAD COMPANY. SECTION 1. Be it enacted by the Senate and House' of Representatives of the State of South Carolina, now mel and sitting in General Assembly, and by the authority of the same, That for the purpose of con? structing a railroad of one or more tracks from some point, at or near the oity of Charleston, through the Coun? ties of Charleston and Georgetown, to some point at or near the town of Georgetown, and thence throngh Horry ** County, to some point at or near Gon wayboro, thence to the North Carolina State line; that O. B. Stuart, H. M. Drane. E. R. Wiggin, 8. P. Viok, W. A. Greenleaf, W. H. McDowell, John Douglas, W. F. Johnston, J. Walker and their associ?tes, BuoceBSors and assigns are hereby oreated a body politio and oorporate, nuder the name of the Charleston, Georgetown and Conway boro Railroad Company, and by such title ahall have a oorporate existence for the term of thirty (30) years; and may sue and be sued, plead and be impleaded in every proper court of tho State of South Carolina, and may have and use a common seal, which it may ohange or alter at pleasure; and shall be capable of purchasing, holding, using, leasing and conveying estate, real, personal and mixed, and other property, and acquir? ing the same by gift or devise; and may make all necessary by-laws and regula? tions for its government, not inconsist? ent with the Constitution and laws of tho State of South Carolina, and of the United States. SEC. 2. That the said company be, and is hereby, authorized and empower? ed to oonstruot, maintain and operate a railroad of one or more tracks, extend? ing from some point at or near Charles? ton to a point at or near Georgetown, thence to some point at or near .Conway boro, thenoo to some point on the North Carolina State line, in Horry County, the particular route of same to bo de? termined upon by the company after the same shall have boen formed. SEC. 3. That the oapital stock of said company shall be throe millions of dol? lars, in shares of- one hundred dollars each, with the privilege of increasing the said capital stock to suoh an amonnt as may be found necessary to oonstruot, equip and maintain the said railroad; and the shares shall be personal pro porty, transferable in suoh manner as the by-lawB may direct; and, for the raising of suoh oapital stock, it shall bo lawful to open books of subscription, at such t\mcs and places, and under the direotiou of such persons, as said com? pany may determine; that the subscrip? tions to tho oapital stock may be made in money, bonds, lands, materials or work, at suoh rates and on such terms as may be agreed upon at the timo of suoh subscription. A copy of any articles of aseooiation, signed by the incorporators named in this Aot, or any number of them, not less than five, may be filed in the office of the Secretary of State, and, thereupon, the persons subscrib? jg such articles of association, and all persons who shall become stockholders in such company, shall be a corporation in deed and in law for the purposes heroin sot forth, and shall be considered organized by suoh aot of association. SEO. 4. That tho company hereby au? thorized shall bo allowed six months from the passage of this Act in which to file the articles of association in the of? fice of the Seoretary of State, BB pro? vided for in Section 3, and tho said road hereby authorized to bo constructed shall bo commenced within two years after the passage of this Aot, or other? wise the charter shall bo void. SEC. D. That the said railroad compa? ny is hereby authorized to construct and operate one or moro liuos of tolegraph dong its railway, charging and oolleot iu? such remuneration for nil mossngos or despatche* aa th? SEO. 6.- That the said, company is hereby authorized and empowered to mortgage any or all of its property and ?ranohise?, -atad issue bonds and pre ferred stoak to an amount, and on such conditions, and for such uses and pur? poses of the:.said corporation,. as the President and 1) i reo to rs thereof deem expedient for the best interest of the company. . ,, SEO. 7. That1 this said company is hereby authorized and empowered to merge and consolidate its capital stock* estate, real, personal and mixed, fran? chises, rights, privileges and property, into and with the capital stook, estate, real, personal and miked, franchises, rights, privileges or property of any other railroad company or companies chartered by, and organized ander, tho laws of this or any other State or States, whenever tho twe hr more companies BO to be merged and consolidated shall or may form a continuons line of railroad with eaoh other, or by means of any in? tervening railroad bridge or ferry, and Buoh consolidation shall or may bo effect? ed in snoh manner, and on such terms and conditions as the President and Board of Directors may determine. Ssc. 8. That the said railroad compa? ny shall be subject to the provisions of an Aot of the General Assembly of Sonth Carolina, passed September 22, 1868, entitled "An Aot to declaro the manner by which the lands or right of way over the lands of persons or corporations may be taken for the construction and uses of railways and other works of internal improvement: Provided, however, That nothing herein contained shall be so construed as to exempt the said railroad aompany from the payment of taxes." SEO. 9. That thia Aot shall toke effect on and after its passage, and all Aots or parts of Acts inconsistent with any of the provisions of this Aot are hereby re? pealed. Approved Maroh 9, 1872. AK AOT TO ESTABLISH AK INFERIOR COURT FOR THE TRIAL OP CRIMINAL CASES IN THE COUNTY OE CHARLESTON. SECTION 1. Be it enacted by the Senate and Bouse of Representatives of the Stale of South Carolina, noxo met and sitting iii General Assembly, and bu tho authority of tjie sams, That there shall be established in the County of Charleston an Inferior Gonrt for the trial of criminal cases, to be oalled the Griminal Conrt of Charles? ton County, and which shall be organ? ized by the Judge thereof, immediately after his election. SEO. 2. The Clerk of the Court of Common Pleas and General Sessions, and the Sheriff of the County, shall re? spectively be the Clerk and the Sheriff of the Criminal Conrt, and may act in person or by deputy. All prosecutions shall be conducted by the Attorney General, or the Solicitor of the Circuit to which the County of Charleston may be attaohed. These officers shall receive the same fees as are now provided by law, and the Jadge of the Criminal Conrt shall approve their bills for services rendered in the said oourt, in the same manner, and in like cases, as Judges of the Circuit Court are now required by law. SEC. 3. The Jndge of tho Criminal Court, herein provided for, shall bo eleotsd by the General Assembly at tho present session, and immediately after ibo passage of this Act; he shall qualify in the same manner as the Circuit Judgei, and shall hold his ornoo for the term of four years, and until his suc? cessor is elected and qualified. He shall receive, from the Treasury of the State, a salary of two thousand five hundred dollars, payable in the same manner as the salary of Circait Judges. Ho shall have power to praotioe as an attorney in all other courts except the Criminal Court. j SEO. 4. The Criminal Court shall havo 1 exclusive appellate jurisdiction of all oriminal causes from the Courts of Trial Justioes for Charleston County, and ox olasive original jurisdiction of all orimi? nal caa sea less than capital, and not?t present conferred by lav/ upon the Courts ot Trial Justices. lu these cases tho same laws, fees, powers and practice shall prevail in the Oriminal Court as in the Conrt of General Sessions, and tho juries shall bo drawn and empannoled in the same manner as is provided by law for the Oourt of General Sossions: Pro? vided, That the grand juries drawn for tho Court of General Sessions shall also be tho grand juries in tho Crimiual Court. SEO. 5. Tho Criminal Court shall havo the same power and jurisdiction UB the Court of General Sossions in reference to defaulting jurors, estreatiug recogni? zances, taken in all causes within its ju? risdiction, and punishing for contempt, and may issue rules, orders and attach? ments in the same manner and in liko oases as tho Court of General Sessions. The Judges of the Criminal Court shall ex-qfflcio hove all the powers of a Trial Justice. SEC. 6. That th? Jadge of tho Crimi? nal Oourt shall have power to execnte the provisions of tho Habeas Corpus Act, and shall also exorcise jurisdiction under habeas corpus at common law, in all cases arising within the County of Charleston: Provided, That during tho sossion of tho Court of General Sedsions for the said County, be shall exoroise no common law jurisdiction nndor habeas corpus. SEC. 7. Tho Criminal Court shall be a ', Court of Record. It shall ordinarily sit in tho court room of the County Court ! House, and when tho Court House may i bo ocoupiod by tho Circuit Court, a suit able placo near by shall bo provided for its sittings by tho County Commission- ' ers. ' SEO. 8. The Criminal Court shall hold four regular terms during each year, on the first Monday of January, April, July and October, each term to be continued so long as business may require, and, if necessary, to be adjourned from time to time, in the discretion of tho Judgo, The Judge shall also have power to hold special sessions at any time, in his dis? cretion, and all processes issued ' and re? cognizances taken for tho next regular term shall be held to refer to such spe? cial term-due notice having boen given by publication in one or more of the newspapers of tho County, et least ten days before tho commencement of such spacial session. V.. SEC. 9. Appeals from tbe Criminal Courts shall lie to tho Supreme Court in all cases within tho jurisdiction of the Criminal Court, in like manner as is pro? vided by law for appeals from the Oirocit Court. SEO. 10. The Judge of tho Criminal Court shall, immediately after his elec? tion, order a special term of tho conrt herein constituted, to be held within ten days after the publication of such order; all cases less than capital now on tho dockets of Courts of General Sessions shall bo transferred to the dockets of the Criminal Court at the special term pro? vided for in this section. SEC. ll. All Acts or parts of Acts in? consistent with this Aot aro hereby re? pealed. Approved March 13, 1872. AK ACT TO INCORPORATE THE ANDERSON FARMERS' AND MECHANICS' ASSOCIATION. SECTION 1. Be il enacted by the Senate and House of Representatives of the Slate of Soutfi Carolina, now met and sitting in Genei'al Assembly, and by the authority of the same, That "B. F. Craytou, J. W. Norris, D. M. Watson, W. J. Lig?n, B. F. "Whitner and W. W. Humphreys, and their successors in offico, and their associates, bo, and thoy aro hereby, de? clared to be a body politic and corpo? rate, under tho name and stylo of the "Anderson Farmers' and Mechanics' Association." SEC. 2. That tho said corporation, by its corporate name aforesaid, shall have succession of officers and members, to be chosen according to the rules and by? laws made, and to he made, for its go? vernment and direction; shall have power to make by-laws, not repugnant to the laws of tho land; to make, have and use a common seal, and the same to alter at will ; to sue and be sued, plead and be impleaded, in the courts of the State; to purchase, hold and enjoy lands, tenements or hereditaments, goods or chattels, which may be necessary, con? nected with, or conducive to, thc objects of said association, and the same to alien sod convey at pleasure. SEC. 3, That this Aot shall be deemed a public Act, and continuo in foroe until repealed. Approved March 9, 1872. AN ACT TO RENEW TJIE CHARTER OF FEAT'S FERRY, OVER THE WATER EE RIVER. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of SoutJt Carolina, now met and sitting in General Assembly, and by the authority cf the same, That the oharter of tho ferry over Watereo River, known as Peay's Ferry, bo, and the Bame is horeby, re? sewed, and continued in force from and siter tho passage of this Act, until amended or repealed; and the same is vested in JD. J. 1). Curoton, his execu? tors, administrators and assigns, subject to like powers, privileges and limitath us as were formerly conferred upon the owner of said ferry by law: Provided, That tho following rates of ferriago only shall be charged and. collected, to wit: Singlo passengers, 5 cents; man aud horse, 15 cents; buggy, 25 cents; ono bbrse wagon, 25 cents; two-horso wagon, 50 cents; four-horso wagon, 75 cents. SEC. 2. All persons uttending public meetings and elections, and children going to and returning from school, shall be exempt from any and all charges of ferriage. Approved March 13, 1872.
