and House of Representatives of the State

SEO. 2. Whenever tho personal pro?
perty of the head of any family residing
in this State, whether "tho said person
owns a homestead of real estato or not,
is taken or attached by virtue of any
mesoo or final procees issued from any
court, aud said person shalt claim tho
property, or any part thereof, as exempt
from attachment and sule on account of
tho same boiug tho annual product of
his or her homestead, or aa subject to
exemption nuder tho Constitution, and
the creditor and debtor do not agree
abont the same, the dfficer excontiug the
said process shall cause the sumo to be
ascertained, and all exempted property
set out' by appraisers appointed and
sworn for the pnrpose. as provided in
the preceding section for setting ont the
homestead, subject to like limitations
aud providions, uud the residue, if any,
shall be sold, for tho payment of debts,
which proceeding shall be stated in the
officer's return of such process.
SEO 8 That, if the homestead as?
signed under.Suction 1 of this Act, shall
not amount iu value to one thousand
dollurs, then the Sheriff, Ol other officer,
who shall make salo of the residue of
the real estate of the person claiming the
homes!ead, shall pay to stud portion, in
preference to nil tither claims, out ni the
proceeds of said sule, such u sum in
money us will mabu up the one thousand
dollars'.

assigned ns herein prescribed, shall vest
