AH ACT TO AMEND AN ACT ENTITLED "AN ACT PROVIDING FOR THE ASSESSMENT AND TAXATION OP PROPERTY," PAE8ED BEPTBMDER 15, 1868, AND ALL A018 AMENDATOH? THERETO. BEOTION 1. De it enacted by the Senate and House of Representatives of thc Slate of South Carolina, now met and silting itt General Assembly, and by tho authority of the same, That Section 1U8 of the Act entitled "An Aet providing for the as? sessment uud taxation of property," passed September 15, 1868, bo, and the same is hereby, altered and amended, by striking out all tho proviso, after the words "delinquent laud eulo," in the twelfth line; that Seotion 114 of the same Act bo amended by striking ont the words "two years," and inserting iu lieu thereof tho words "ninety days;" that Seotion 116 of the same Act be, und 'ne same is hereby, amended by striking ont the words "two years," whenever the samo appears therein, and insert in lien thereof the words "ninety days;" that Seotion 117 of the same Act be, aud the same is hereby, amended by striking out the words "one year," whenever tho same may appear therein, and insert in lien thereof the words "thirty duys," and by striking out the words "two years," whenever the same may appear therein, and insert the words "niuety days," in lieu thereof; that Seotion 123 of said Aot be, and the sumo is hereby, amended by striking ont the words "two years," whenever the same may occur therein, and insert in lien thereof the words "ninety days." SEO. 2. That so much of the Act enti? tled "An Aob to farther amend an Act entitled 'An Aot providing for the as? sessment and taxation of property,' " passed March 8, 1871, as provides that all deeds of oonveyaoors of real estate shall be placed on record in the office of the County Auditor, before the same eau be plaood on record in the office of the Register of Menno Conveyance, be, and the same is hereby, amended by adding the following, viz: "And for eaoh and every violation of this provision by u Clerk of Court or Register of Mesne Conveyance, he shall, apon conviction before any court of competent jurisdic? tion, be fined in a sum of not less than five dollars, nor more thad twenty dol? lars, and the costs of the notion, one half of said fino to be paid into the County Treasury for the benefit of tho Connty, and the other half to be paid to the County Auditor. SEO. 3. That all lands which havo been forfeited to the State ander tho provi? sions of the Aot providing for the assess? ment and taxation of property, passed September 15, 186S, and other Acta amendatory thereto, shall bo advertised by the County Auditor, in manner pro? vided by Seotion 107 of said Act, and sold by tho County Treasurer to the highest bidder, and the County Auditor shall exeoute a "warranty deed" to tho pnrohoser. The proceeds of the sale, after deducting foes allowed by law, and paying tho County tho amonnt of taxes and ponalties due from such lund, shall be forwarded to the State Treasurer by the County Treasurer, and shall be cre? dited to the County from which it is re? ceived on account of tho forfeited lands. SEO. 4. That all lands natl real estate within this Stute, whereupon, or in ro .peot whereof, any sum of money re? mains duo or payable after the sale pro? vided for in Section 15, Chapter 13, Title 8, of genorul statures, or which aro lia ble to bo sold for, or on account of any tax laid by or nuder tho authority of this State, for State or County pur? poses, in accordanco with tho provisions of either of tho several Acts, for tho pur? pose of assessing and levying tases for tho support of tho government of the State, and of the several Counties thereof, passed in tho years 1868, 1869, 1870 ai d 1871, shall be exposed to salo, and sold for tho payment of such taxes, uud i ll peualtics, costs and chnrges there? n ac orued, ou the firat Monday in June, 1872, and from day to day thereafter, Sundays only excepted, until tho whole thereof shall bo ?old, at tho place or places, on Ibo terms and iu the manner hereinafter provided; such sale shall be by tho County Treasurer of each Coun? ty, at the County scat, who shall expose and offer thu lauds at publio salo, to be sold and conveyed in fee si m pl , without any right of redemption for the payment thereof. Tf no person shall at said sale offer to purohase or take a less quantity of the land so charged and offered than the whole thereof, at and for tho amount BO charged, for the taxes, penalties, oasts and charges, the said County Trea? surer shall doolam that the State is the purchaser thereof, at and for the amonnt BO charged, and thereupon the State shall beoome invested in feo simple with the titles to said hinds, and the appurte? nances, and all the improvements there? on. If at Baid sale any person shall pub? licly offer to take a less portion than the whole of said lands, for tho said tux< a penalties, costs and charges, then the sud lands shall be sold to such person a? shall offer to take the smallest portion thereof, and pay tho sumo; and upon the payments of the amount so duo to said County Treasure;*, said oQicor shall exeoute and deliver to the said purchaser ? certificate Miling forth tb? fact of s a oh purchase, and tho payment of . the a mon nt bid; anti thereupon Ibo said pu rob aa or shall be entitled to the giant from tbe State of the undivided right, title or interest, in fee simple without re? demption io and to all the lands so sold ; and all lands belonging to any person or persona, or corporation, against whom snob tax was levied and assessed, equal j to the proportion which tho amount bid I holds to the whole of said lands so pur? chased; and the purchaser shall be en? titled Jto demand partition thereof no cording to law, and on such partition tbe said purebaser shall be entitled to a! proportional share and interest in all the j improvements thereon. In addition to the sums now assessed and chargeable upon said lands, there shall be added at tho timo of said salo five per oentum of the amount of oaid taxes, penni tien, oosts | and charges, whiob said sum is hereby appropriated for tho expense of said salo, and tho collection of the moneys thereon. One-half ono per cent, to bo for tho uso of tho County, and tho j balanco tn bo paid into tho Stato Trea? sury. If any person to whom such lauds shall bo struck off bhall fail forth? with to pay the amount bid therefor, said County Treasurer sholl immediately expo ie and offer t>uch lands for ro-snlo us if no such previous onie bnd takeu pince. Tho County Treasurer shall moko weekly remittances of all funds received, ac? cording to the provino IIB of this Act, to tho Stato TreaEurer, und shall forward monthly aooouuts for sui! funds to tho State Treasurer. SEO. 5. It shall bo tho duty of tbe Go? vernor to canse this Act to bo published in such manner as shall, in his judg? ment, bo requisito to givo full informa? tion thereof, tho expenso of said publi? cation to be puid or reimbursed out of tho funds authorized hereby to bo charged as tho expenses of said sale. Seo. 6. It shall be the duty of each County Auditor of each County to ex? hibit the tax booka thereof, showing all delinquent taxes herein provided for, for sixty days next preceding such sale, and all persons Bhall bo entitled to in upeot the same between Ibo hours of 9 o'clock A. M. and 12 M., eaoh day, Sun? days exoepted, and it shall bo bis duty to attend said sale with tbe said tax books, and to furnish to suid County Treasurer, and all persona requiring the same, such information as the records of bis office may afford relativo to tho mat? ters involved in said salo, and upon the delivery of the Treasurer's certificate of sulp, to exeonte a deed in accordance with Section 33, Chapter 13, Titlo 3, of the general statutes of South Carolina. SEO. 7. That this Aot shall take effect from and immediately after its passage, and that all Acts or parts of Aots incon? sistent with tho provisions of this Act be, and tho same aro hereby, repealed.
