AN ACT TO QUANT, BENEW AND AMEND THE CHABTEB OF THEVHJC/AOE OP BOCK HILL, IN THE COUNTY OP YORK. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That, from and after- the pai Ire of this Act, all citizens of this ite, having resided twelve months thin the State, and sixty days in the l?ge of Kock Hill, shall be deemed, d aro hereby deolared to be, a body lit ic and corporate, and the said vil jo shall be called and known by the me of Hock Hill, and its corporate nita shall extend over an area of a uare, each side whereof is one mile, d the centre whereof is "Gordon's otel." SEO. 2. 'ont for tho preservation of the pei good order and police thereof, wit I persona so appointed shall, within corporate limits of said village, have 1 power und privi'oje?, and be aubjoe all the obligation?, penalties apdr? r iU tiona provided Dy law for the office of Constable; and shall bo liable to be ro? mo Tod at tho p? easaro of Baid Town Council; sud the said Town COD noil shall have power to establish, or au? thorize the est il lis'in ont of a market house in said, village; also, to authorize the establishment ot a guard house, and to prc BC ribo HU i table rules nnd regula? tions for keeping and governing the eame; and the said Town Connell, or the said Intendant and Wardens, in person, * any ono or more of them, may authorize and require any Marshal of the town, or any Constable especially appointed for that pnrpose, to arrest and commit to the said guard house, for a term not ex? ceeding twenty-four hours, any person or persons who, within the corporate limits of said town, who may be engaged in any broach of the peace, riotous or disorderly conduct, open obscenity, pub lio drunkenness, or any conduct grossly, indecent or dangerous to the citizens of said town, or any of them; and it shall I be the duty of the Town Marshal or Constable to arrest and commit all such offenders, when required to do so; and who shall have power to call to their as? sistance the posse comilatus, if need be, to aid in making such arrests; and upon the failure, of such officers to perform such duty as required, they shall several? ly be subject to such fines and penalties as the Town Council may impose apon them; and all persons so imprison td, ?lall pay the costs and expenses incident to their imprisonment, whioh said costs and expenses shall be oolleoted in the same manner as is provided for the col? lection of fi Ll CO imposed for the violation of ordinances, rales and regulations: Provided, That such imprisonment shall not exempt thu par1 y f:oru the payment of any fine the Council may impose for the offence which he, she or they may have committed; and the said Town Council shall have fall power and autho? rity, under their corporate seal, to mako all such rules and regulations, by-laws and ordinances, respecting the streets, roads and business thereof, as well as the police system of the said town, as shall appear to thom necessary and proper for the security, welfare and convenience of the inhabitants of said town, and for preserving health, order and good go? vernment within the said town; and the said Town Council may impose fines for offences against their by-laws, roles, re? gulations and ordinances, and appropri? ate the same to the public ase of said town ; and the said Town Council shall have the same power that Trial Jue tices or Justices of the Peace now have, or may hereafter have, to compel tho at? tendance of witnesses, and requiring them to give evidence upon the trial be? fore them of any person or persons for a violation of any of their ordinances, by? laws, rales or regulations; bnt no fine above the sam of twenty-five dollars shall be oolleoted by said Council, ex? cept by snit in the proper Courts of Jnr tico in this State, and also that uorhiDg herein contained shall authorize) mid Connuil to make any ordinance or by? laws inconsistent with or repugnant to the laws of tho State. That the said Intendant and Wardens, or a majority of them, shall have power to abate and re nun o all nuisances in said town; and it shall be their duty to keep all roads, ways, bridges and streets within the corporate limits of said town open and in good re? pair, and for that purpose they are in? vested with all the powers of County Commissioners, for and within the cor? porate limits of the said town; and they may lay out new streets, close up, alter or widen those now in use; and shall have full power to olassify and arrange the inhabitants or citizens of said town liable to street, road or public duly therein, and to force the performance of such duty, under snob penalties as ara now, or shall hereafter be, prescribed by law; aud they shall have power to compound with ali persons liable to work the streets, ways and mada in said towns, upon such term? as their ordi? nances or by-laws may establish, or their rules ami regulations may require-; the money so received to be applied to the public use of said town; und ail persons refusing to labor, or failing to pay such commutation, shall be liable to such fine, not exceeding ten dollars for any one year, as the said Tonn Council may impose; and they shall hnvu the power to enforce the pay meut c?f such fine in tho Ramo manner us is now, or may hereafter, be provided for the eoUeeticn of County taxes. And the said Town Council shall have power, with the con? sent of the adjacent land-owners, to close nil such roads, streets and ways, within tho said town, ns they may deem neces? sary, by the salo of thu freehold therein, either at private or public sab?, ns they may adjudge beat for tho interest of the said town; and they shall koep in repair all snell new streets, roads und ways, as thoy may, from time to time, deem : necessary for tho improvement and con ! venience of said town: Provided, That j no ht reef, rond or way shall be opened j without first having obtained tho c-on i sent of tho land-owner or owners there? of, through whoso premises any such new street, road or way may pass. SEC. 7. The said Town Council may have power and authority to require ail persons owning a lot or lots in said town to closo in, and to make and keep in good repair, side-walks in front of said lot or lots, whenever the samo e-hall front or adjoin any public street of said town, if, in tho judgment of the Council, such side-walk shall be necessary, the width thereof, and tho manner of con? struction, to bo designated and regu? lated by tho said Town Counoil; and for default or refusal, after reasonable no? tion, to make and keep in good repair such side-walk", and to close suoh lots, j tho said Town Council may cause tho ' same to bo made or put in repair, and I require the owner to pay the price of I making or repairing; and tho said Town !
