TLED "AN A OT TO G BANT, BBNHW AND AMEND THEOHABTEB8 OF CERTAIN TOWNS AND VILLAGES THEREIN MENTIONED," COMMENCING WITH SECTION NO. 86 OF SADD A OT, B ELATING TO THE rNCOBFOBA TION OF THE TOWN OF WBIOHTSVUiLE, PASSED AT THE BBOUIiAB 8ESSION OF THE GENERAI. ASSEMBLY OF THE STATE OF SOUTH CAROLINA, 1870-71. SECTION 1. lie if enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That irom and aftor the pas sage of this Act, all citizens of this State, having resided twelve months within this State, and sixty days in tho village of Wrights ville, shall bo deemed, and are hereby declared to be, a body politic and corporate, and tho said vil? lage shall bo culled and known by the name of Wrightsville, nud its corporate limits shall include ?disto Island, to? gether with Eddiugsville. The metes and bounds of Baid town of Wrightsville will be bound on the North by North Edisto Inlet, or Uiver, on the South by South Edisto River and Saint Heleno Sound, and on the East by Atlantic Ocean, and on the West by Johnsse Island and Edisto River. SEO. 2. That the said village shall bc governed by an Intendant and foui Wardens, who shall be citizens of thc United States, and win? shall bave re sided in this State twelve mouths, anc shall have boen residents of the said vii l?ge sixty days immediately preceding their election, and who ?hull be electee on the third Monday in May, 1872, au< on the same day ip each year thereafter ten days' public notioo thereof boioj previously gi von ; and that all male in habitants, of the age of twenty-on years, citizens ci tho Sluie, and win shall have resided within the Stat twelve mouths, und in the said villag Bixty days immediately preceding th election, ?hall be entitled to vote fo said Intendant and Wardons-panpet and persons undoi disabilities for crim excepted. SEC. 8. The Intendant ai Wardons, before entering apon tho d ties of thoir ofSoes, shall respeotivt take the oath prescribed by thu Cone tution of tho State, and also the folio ing oath, to wit: "As Intendant Wardoo) of tho village of Wrightsvil I will equally and impartially, to I best of my ability, exercise the trust posed in me, nnd will uso my best i deavors to preserve tho peace aud ca into efJfeot, according to law, tho p posos for which I have been elected: help me God." Aud, if any pera npon being eleoted Intendant or Wa en, shall refuse to aot as such, he si forfeit and pay to the Council tho sun twenty dollars for the use of the o village: Provided, That no person v hos attained the age of sixty years si be compelled to serve in either of e offloes; nor shall any other person compelled to serve, either as Intend or Warden, more than one year in term of three years. That in case a vacancy s ocour in the office of Intendant or of the Wurden?, by death, r?sign?t removal, or otherwise, an election tc such vacancy shall be held by ordt the Iuteudaut aud Wardons, or a a rity of the samo, ton days' public nt beiug previously given; aud, in cai sickness, or temporary absenou of Intendant, the Wardens, forming Council, shall bo empowered toolee) cf tho number to not os Iuteudaut ing the time. SEC. 5. That the Iuteudaut and W ens, duly elected and qualified, s during their term of service, sevo and respectively, bo vested with all powor of Trial Jusbioos, or Justici the Peace, as tho case may be, iu State, within tho limits of tho sail Iago, except for tho trial of small mean onuses; aud the Intendant she may, as often as is necessary, sum the Wardens to meet in Council, three of whom, with the Intendant, constitute a quorum to transact ness, and they shall bo known ui Town Council of Wrightsville; and and thoir successors in office, here to bo elootod, may have a commou whioh may be uffixod to all of Ordinances; may sue and bo Hued, ] aud bu imploudod, iu any Court of tico in this State, mid purchase, possess and eujoy to thom and successors, in perpetuity, or for torm of yours, any estate, real, por or mixod, and sell, alien or convo; .ame: Provided, Tho sumo shull ni cood, at any ouo limo, tho sum c thousand dollars. And tho said ' Council shall have authority to upi from timo to limo, ns thoy muy sc such nud so many proper persons I us Marshals or Constables of said vi us tho suid Council may deem neet and expedient for tho proser vat i the peace, good order and police thereof; which persons, sn appointed, shall, within the corporate limits of said vil? lage, have the power and privileges, and bo subject to all the obligations, penal? ties and regulations providod by law for the office of Constables, and sunll be liable to be removed at the pleasure of said Conseil; and tho said Town Conned BIInil have power to establish, or author? ize the establishment, of a market house in said village; also, to authorize tho establishment of a guard house, and pro? scribe suitable rules and regulations for keeping and governing the same; nod until tho said guard houso be esta? blished, they shall bo authorized to use a room in the common jail in tho Coun? ty of Charleston, for tho confinement oi all who may be subject to be committed for a violation of any Ordinances, rules and regulations of said town ; and the said Town Council, or tho said Intend? ant and Wardens, in person, any one oi more of them, may authorize any Mar? shal of the town, or any Constable, specially appointed for that purpose, tc arrest and oommit to the suid guare houso, or jail of Charleston County, ai the case may be, for a term not exooed iug twenty-four hours, any parson 01 persons, who, withiu tho corporati limits of said town, may bo engaged ii a broach of tho peace, any riotous o disorderly conduot, open obscenity publio drunkenness, or any oouduo grossly indooeut, or dangerous to th citizens of said town, or any of them and it shall be the duty of the Tow Marshals, or Constables, to arrest an commit all such offenders, when rc quired so to do. and who shall hav power to call to their assistance t'ieposj comital us, if need be, to aid in makin suoh arrest; and upuu the failure of sue officers to perform suoh duty ns requiret they shall, severally, be subject to sue fines and poualties as tho Town Counc may impose upon them; and all persoi so imprisoned shall pay the costs au expenses incident to their imprisonmeu which said costs and expenses shall I collected in the same manner as is pr vided for the oolleotion of lines impose for the violation of Ordinances, rul and regulations: Provided, That sui imprisonment shall not exempt the par from the payment of any line tho Cou oil may impose for tho offence which 1: she, or they may have oommitted. Tho Bftid To wu Co ii uni 1 shall have pr ver and authority to require all person owning a lot or lote io said town to olos in, und to make and keep in good repair side-walks in frout of said lot or lots, whenever the same shall front or adjoin any publia street of Hiiid town, ir, in tho judgment of tho Council, such side-walks shnll bo necessary; tho width thereof, aud the manuer of con? struction, to be designated and regulated by the said Town Council; and for de? fault or refusal, after reasonable notice, to make and keep in good repair such side-walk, und to close such lot or lots, the Town Council may cause the sumo to be made, or put in repair, aud require the owner to pay tho price of making or repairing; and the said Town Council are hereby empowered to sue for and re? cover the samo by notion of debt in auy court of competent jurisdiction: Pro? vided, That suoh contract for making or repairing is to be let to the lowest bidder. .The said Town Council shall appoint three discreet persons, who shall form a board of supervisors of tho health, who shnll have power over the ways and water courses, ditches and stagnant water ponds, and take such other sanitary measures as the publia health require, giving twenty days' notice to the occu? pante of enid premises, where tho said nuisance Ho, and in default of non-com plianoo with tho ordor of said board, the parties so offending shall be lined in a sum not loss than twenty dollars, 01 thirty days iu the County jail, for ead: and every offence, the said Complaints tr be brought before any Trial Justice, 01 Justice of tho Peace, in aud for tin County of Charleston. The Intendant, and Warden of the said town, or a majority of them shall hovo full power to grant or refus liceuses to tavern-keepers, or retail spi rituous liquors within tho corporal limits of tho said towu, upon such condi tion und under such circumstances ns t thom shall seem proper aud right: Prc vided, That in no instance shall th price of a license to a tavern, or to rc tail spirituous liquors, bo loss than th amount that is established by tho Stat? aud all motleys paid for licenses and f( fines and forfeitures ahull bu uppropr ated to the publio unes of said towi Provided, That the Iuteudaut aud Wan cns, duly olectod, shall not, havo pow? to grant any licouso to koop tavern < retail spirituous liquors to extend b youd the term for wbich they havo bet. elected. Each Town Council Khali, within one month after the expiration of their term of office, make out and return to their successors in office, a foll acoount of their receipts and expenditures during their term, which account shall bo pub? lished in ono ur moro papers of the Couuty; and shall pay over all moneys in their possession belonging to the cor? poration, and delivor np all books, re? cords and other papers iuoident to their office to their successors; and on faillite to do so, they shall be liable to be fined in a sum not exceeding five hundred dollars, to bj collected by any proper action of tho Town Council. SEO. 10. That all Ordinances or by? laws passed by tho Town Council of Wrighlsville shall bo binding upon tho citizens of said town tho same as tho laws of tho Stato. SEO. ll. That all Acts, and parts of Acts, inconsistent, with, or supplied by this Act, be, and tho same are hereby, repealed. SEC. 12.
