That in case a vacancy sha oconr in the office of Intendant or au of the Wardens, by death, roBiguatioi removal from the State, or from nt other cause, an election shall bo held I the appointment of the Intendant ni Warden or Wardens, as the case may b ten days' notice thereof, as aforesai being given; and in the ease of sick ne or temporary absence of tho Intendau the Wardens, forming a Council, shi be empowered to elect one of themsely to act as Intendant during such sioku? or absence. SEO. 4. That the Intendant and War ens, duly elected and qualified, sha daring their term of service, several and respectively, be vested with all t powers of Trial Justices or other inferi Courts in this State, in matters civil a criminal, within tho iimits of said tow That tho Iutendant shall, as often occasion may require, summon 1 Wardens to meet him in Counoil, a n jority of whom shall constitute a qi rum for the transaction of business, a shall be known by the name of tho To Council of Midway; and they and tb successors in office shall have a ooma seal, and shall have power and author to appoint, from timo to time, such i so macy persons, to act as Murshals i Constables, as they shall deem cxpodi and proper; which officers shall have the powers, privileges and cmolumoi be subject to all tho duties, penni and regulations provided by tho law? this Stuto for tho office of Constab and tho Intendant aud Wardens Council shall havo power and author under their corporate seal, to ordain establish all such rules and by-laws ordinances respecting the streets, wi public wolla and watering places, mai and police of tho said town, and for ; serving health, peace, ordor and g government within tho same, as t may deem expedient nod proper; the said Council may affix fines offences against snob by-laws aud c nances, and appropriate tho samo to ase of the corporation, but no Coe ? exceed fifty dollars. That the said Council i have to abate and remove uuisa withiu tho limits of said towu, aud to classify and arrange the inhabit liablo to police duty, and to ref them to perform such duty as occu may require, and to enforce tho formuuee theroof, under tho same pi ties as aro now, or may hereaftei established by law: Provided, alu nevertheless, That the said Town Coi shall have power to compound with sous liablo to perform suoh duty, i such terms os they shall,.by ordinal establish. SEO. 6. That it shall be the du the Intendant and Wardens to kee streets and ways whioh may be n sary for publio uso, within tho bini the said town, open nod in good re and for that pnrpose they are ht vested with all the powers, rights privileges granted by law to the Ce Commissioners within tho limits of town; and for any neglect of duty shall be liable to tho pains and pom imposod by law upon County Coo siooors for liko neglect, and the] hereby, individually, exempt froii performance of road and police and tho inhabitants of said towi boreby exempt from road aud p duty without the limits of said cor tion. SEC. 7. That tho said Intondan Wardens shall havo power to comr with persons liablo to work on streets and ways, and to release persons as may desire it, upon th? ment of snqh som of money aa they may deem a fair equivalent therefor, to be applied by them to the nae of the said corporation. SEO. 8. That the said Town Council of Midway shall also bu empowered to re? tain, possess and enjoy all suoh property as they may now be possessed of, or en? titled to, or which shall hereafter be given, bequeathed to, or in any manner 'acquired by them, and to sell, alien, or any way transfer the same or any part thereof: Provided, Tho amount of pro? perty HO hold or stook invested shall in no case exoeed fifteen thousand dollars. SEO. 0. That the said Town Council of Midway shall have power to impose an annual tax on all real and personal pro? perty within the corporate limits of said town : Provided, Said tax does not ex? ceed ten cents ou tho ono hnndred dol? lars. SEO. 10. That the Intendant and Wardens of the town of Midway shall have power to regulato sales at unction, within the limits of said town, and tc grant licenses to auctioneers: Provided That nothing herein contained shall ex tend to sales by Sheriffs, Clerk of Court Judge of Probate, Coroner, Executors Administrators, Assignees, or by an] other person under, the ,,order of an; Court or Trial Justice. SEC. ll. That the Intendant ao< Wardens of the town of Midway shal have power and authority to require al persons owning a lot, or lots, in sait town of Midway, to koop in repair side walks adjacent to their lots, respectively and for default in tbis matter, shall hav power and authority to have the wor done at tho expense of such lot owner. SEO. 12. That the power to grant o ref UBe licenses to keep a tavern, or to rt tail intoxicating drinks, be, and the san. is hereby, vested in the Town Counoil t the town of Midway, and that they b also invested with ail necessary powei by ordinance, or ordinances, to supprei or regulate the sale of intoxicatirj drinks to be drunk at tho place whei sold, or in or upon any of its appurt nances, or in or upon any of the higl ways, streets, lanes, alleys, common kitchens, stores, shops, public building booths, stalls or out-houses, of the sa town, or within one-fourth of a mile the present railroad depot, in the to? of Midway, in the County of Burnwe Provided, That no rule or regulatic shall be made inconsistent with tho Co stitution and laws of tho State. ? Be it enacted by the S> and House of Representatives of (he of Soutli Carolina, now met and sittii General Assembly, and by thc anthon (he same, That so much of tho chart tho towu of Ooorgotowti as deter a tho day of election bo, and the san hereby, amended so as to fix the di election of Intendant and Warder tho town of Georgetown on the Monday in April, eighteen hundred seventy-two (1872), and on tho first ] day of thc same month in overy thereafter. Said election to be held in | soino convenient public place in said town, from eight o'olook A. M. until five o'clook P. M. ; and when the polls shall I be closed, tho managers shall forthwith count the votes, and declare the election, and give notice thereof, in writing, to | the Intondant therein being, who shall, within two days thereafter, give notice, or cause the esme to be given, to the I fersooB duly elected: Provided, That the ! ntendant and Wardens now ia office shall continue until their socoossors a elected aud qualified. Georgotown, which, by the law, now be? long, or may hereafter belong, to the County Commissioners of Georgetown County over tho poor of said County; and, for the purpose of raising fonds to pr?vido for the comfort and support of the Baid poor, tho said Intendant and Wardens may assess and collect a poor tax on tho taxable property of tho said town, in the eame manner as they assess and collect taxes thereon for the support of tho government of the town: Pro? vided, That said tax shall not exceed ten (10) per cent, on the amount of taxes therein paid to the said town: Provided, further, That the tax-payers of the said town of Georgetown ahull not be taxed for tim support of tho poor outside of the corporate limits of said town. Dronnecke, S. S. Smeltzer, Martin Ansel, P. Iloyto, H.
