A reign of terror in those Counties pf the State where habeas corpui 'has'been suspended; people no tn ally flying from their homes to the mountains; nearly overy prominent man, the telegraph states, in the alleged insurrectionary dis? tricts arrested by the military ana im prisono?; cavalry making raids->and seizing captives as in a timo of war. Why is this? On the 17th r6t October the President issned his proclamation suspending the privilege of the writ of hijeas corpus in divers Coun ties of Sooth Carolina. He issued that proclamation nnder a law which gives him power to suspend the privilege of the writ in any State where; in his-opinion, the public safety shall require it, and in bia procla-i mation he assumes that tho Coupties named in his proclamation are in a state of rebellion. This assumption is, no doubt, .made; to bring the suspension bf the writ within Section 9 of the first ar? tie! o of the Constitution, which declares that "the privilege of the writ of habeas corpus ehall not be .suspended unies* when in ?asea iii rebellion or invasion the publio safety may demand it." The Constitution thus clearly specifies what are the oases in which the "publio safe? ty" justifies h suspension - of the .writ, and to those oases it ia strictly confined. Rebellion or invasion are facta which do' not depend npon "the opinion" of any onoi but aro matters of absolute kjuprv Tedge and certainty as opon-armed jrosist ance to tho Government or invasion must necessarily be. Correspondents writing from different neighborhoods in Sooth Carolina state-that tba white male popu? lation, remembering that- in the judicial proceedings in North Carolina accusa? tion waa equivalent to conviction, and that if the policy of pucking j n ries sue ? coeds in South Carolina as in North Ca? rolina, the same results<may be expected there, are leaving, excepting a few'old and infirm men, or others whose families are in such condition that they cannot be abandoned. It is said that even men fifty and sixty years of age-some of them grandfathers-left on horse-back with such bagenge only as they could oarry in a pair of saddle-bags. The jails are said to ho already Ailed to over? flowing with miserable men arrested an? der the arbitrary provisions of the Eu Elex law. The most petty,cases of as sault have been magnified into organized combinations to overthrow the Govern? ment of the United States. Equally frivolous arrests havo been made in all directions. . .? ? Any? where, nt any time, where; tn his opinion, Bu?h combinations' exist aa are described in his proclamation, ho may take away from the most virtuous and ree peo ted citizens of any State the privilege that the laWjjqwarda ^q.^ho.meanest felon. Upon bis opini?n, not upon the fact of such combinations, the liberty of every oitizeu of the American repnblio I? fon pended; an opinion which cannot be in? fallible, for not long ago it waa boldly expressed in' favor* of the loyalty and good dispositions of the very section whioh he is now declaring in rebellion. The experiment now being tried npon ? Southern State may not arouse much ?y iii ?J ailiy '?u eec i. io n'a wuioti think no curse undeserved that may desoend upon Southern heads, but as the publio mind becomes accustomed to the practical workings of this unconstitutional law it may be less difficult to bring it into re? quisition in other sections.
