Be it enacted by the Sonate end-House of Bepresentotives, of the State of South Carolina, now mot and sitting in GOD eral Assembly, and by the authority o? the same, That from and after tho paean ga of this Act, all o i tizona o? .thia State Having resided sixty days in tU? town of York vi Ho, shall bo deemed, and are hereby declared to be, a body politic and corporate, and the enid town shall bo called and known by the name otc Yorkville,- and its corporate limitB shall extend ono .milo in eaoh direction from tho Court Hon HO in said town. SEO. .2. That tho said town shall be governed by an Intendant and four War ens, who shall be citizens of tho United States, and shall have been residents of the said town for sixty days, immediate? ly preceding their election, who shall bo elected on tho second Mouday of Janu? ary in every year, fifteen days' public notice thereof being previously given; and that all malo inhabitants of the age of twenty-one yours, citizens of the State, and who shall have resided in thc said town .for sixty dayB immediately preceding the election, shall bo entitled to vote for .said Intendant and Wardens. SEO. 3. That tho election for Intend? ant and Wardens of the said town ahull be held in tho Oourt House, or some other convenient public place in the said town, from nine o'clock in tho morn? ing until five o'clock in tho afternoon and when the polls shall be closed, tin Managers shall forthwith count the votci and proolaim the eleotion, and give no tice in writing to the persons elected The Intendant and Wardens shall ap point three Managers to bold the en su mg and any subsequent election. When ever there shall not be an Intendant ant Wardens, or Intendant and Warden from any oause whatever, it shall be tin duty of the Clerk of tbe Court for Yorl County to order such election forthwith and appoint three Managers for th same, The Managers in each case shall before they open the polls for said elec lion, take an oath fairly and impartial!; to conduot tbe same. And tho Intend ant and Wardens, before entering upoi th? duties of their respective offioef shall take .the oath prescribed by tb Constitution of this State, and also tb following oath to wit: "As Intendant (o Warden) of the town of Yorkville, I wi equally and impartially, to the best c my ability, exercise the trast reposed i me, and will use my beat endeavors t preserve"the peace and carry into effeo accordiug to law, tho purposes for wbio I kavo boon elected: So help rae God. The said Intendant and Wardens sha hold.their offices from the time of the eleotion until tbe second Monday i January ensuing, and until their sui oeBSors shall be elected and qualified. SEO. 4. That in oase a vacancy shoul occur in tho office of Intendant oran of the Wardens, by death, resignatioi removal, or otherwise, or in case of a, t in said eleotion, an election to fill su( vaoanoy shall bo held, by the appoin ment of-the Intendant and Wardens, j Warden, as the case may be, or the Clo: of the Court of York County, if the should be no Intendant or Wardens, t< days' notice thereof being previous given; and in oase of the sickness or tei porary absence of tbe Intendant, tl Wardens, forming a Council, shall empowered to act in his stead durii the time. SEO. 5. That the Intendant and Wt dens duly elected and qualified abo during their term of service, several and respectively, bo vested with all t jurisdiction and powers heretofore gnu ed to Magistrates in this State. And t Intendant shall and may, as often aa may deem necessary, summon the Wi denB to meet in Council, any two whom, with the Intendant, may com tute a quorum to transaot business; a they shall bo known by the name of I Town Council of Yorkville; and tl and their successors hereafter to eleoted may have a common soul, wb shall be affixed to all the ordinanc And the said Town Council shall bi authority to appoint, from time to til as they may see fit, such and so mi proper persons to act as marshals constables of said town as the said Tc Council may deem necessary and exp? ent for tbe preservation of the pef good, order and police thereof, wb persons sa appointed shall, within corporate limits of said town, have Eower, privileges aud emoluments, ; e subjeg^to all the obligations, penal and regulations provided by law for ornoo of constable, and shall bo li ubi be removed at tho pleasure of Bald Cc oil; and the said Town Council s have power to establish or ant ize the establishment of the mn boase in said town; and tbe said T Council shall bnve full power and thorifcy\ under their corporate seal make all suoh rules, by-laws and c nances respecting the streets, rc market house, and tho business thoi and the jpolice system of said to wi shall.appear to them necessary and per for tho security, welfare and co nienoe, and for preserving health, c and good govern mont within tho s. And the said Town Council may im fines for offences against their by and ordinances, and appropriate same to the public OBS of said town tho said Council shall have tho power which Trial Justices have to compel tho attendance witnesses, and require thom to ovidenoo upon the trial before of any person for a violatio any of their by-laws or ordinance uo flue above tho sum of twenty d shall bo collected by said Council, c by suit in tho Court of Common 1 Provided, That no fine shall cced fifty dollars; and, also, tbt thing herein contained shall anti the said Cot?noil to moko any by-lu ordinances inconsistent with, or repug? nant to, tho laws of this State; and nil the by-laws, rules and ordinances tho said Council shall make shall, at all times, bo subject to r?visai or repeal by the General Assembly of this Slate. SEO. G. That tho said Intendant and Wardens Bhall have full power to abato and removo all nuisances iu tho said town; nud it shall bo their duty to keep all road?, ways and streets within tho corporate limits of tho said town, open and in good repair, aud for thnt purpose they aro invested with all tho powers heretofore granted to Commissioners of Roads; and shall have full power to classify and nrrange tho inhabitants of said town liable to street, road or other public duty therein, and to force thc per? formance of suob duty under such pe? nalties as are now or shall hereafter bo prescribed by law: Provided, That tho said Town Council may compound with any persons liable to perform such duty, upon such terms, and on the payment of such sums as may bo established by laws or ordinances: And, provided, also, That tho individuals who composo tho said Town Council shall bo exempt from thc performance of road and police duty, and tho inhabitants of said town aro hereby exempt from road aud polico duty without tho corporato limits of said town. SEO. 7. That tho power to grant or re? fuse licenses for billiard tables, to keep tavern, or to retnil spirituous liquors within thc limits of the snid corporation, be, and tho same is hereby, vested in the Town Council of Yorkville, and tho said Council may grant licenses to retail spirituous liquors to such persons, ned iu such quantities, at such rates, and upon such terms and conditions, as tho said Council may deem ht and proper; and tho said Iutcndant nndWar ileUB shall bavo tho full aud only power to impose a tnx on all shows, or exhibi? tions for gain or reward within the limits, and all tho money puid for li? censes for retailing spirituous liquors, keeping tavern and billiard tables, and the tax on all shows for gain or roward within said limits, shall bo appropriated bo the public use within said corpora? tion. SEC. 8. That the said Town Council o? Yorkville shall have power and inthority to require all persons owning i lot or lots in said town, to make and ceep in good repair sidewalks in front of said lot or lots, when sver the same shall front or adjoin any }f the public streets of said town, if, in ;he judgment of tho Council, such side? walks shall be necessary, tho width '.hereof and the manner of their con? duction to be designated and regulated uy the Town Council; and for default or refusal to make and keep in repair such nde-walks, the Town Council may causo ike same to bo made or put in repair, ind require the owner to pay tho price >f making or repairing: Provided, That mch contract for makiug or repairing 30 let to tho lowest bidder. SEC. 9. That tho said Town Couucil of Yorkville shall have power to arrest and commit to jail, for a space of timo not jxcecding twelve hours, and to rino not exceeding twenty dollars, any person or persons who shall be guilty of disorderly conduct in said town, to tho annoyance }f citizens thereof; and it shall be di? duty of the Marshal of the town to nuke such arrests, and to call to his as listunce the posse coinilatus, if necessary; ind upon failure to perform such duty ie shall bc fined in a Bum not exceeding ano hundred dollars for eajh and every offence. SEC. 10. That the said Town Council jf Yorkville shall have power to jrant licenses to pnrtics within the i mi ts of said town; and the parties .o whom said licenses aro grunted shall pay a sum not oxeoodiug two bem? ired dollars. Thoy shall also bavo power to impose and collect au an? nual tax upon tbe assessed property of ?aid town: Provided, No tax shall be levied in any ono year to exceed the rate af twenty cents on encb hundred dollars jf such assessed property, and that tho money BO raised shall bo applied to the uso of said town. The said Town Coun? cil shall bave the power to enforce thc payment of all taxes levied by tho said Town Council to tbo same extent and in the same manner ns is now or hereafter shall bo provided by law for thc collec? tion of tbo general State faxes. SEC. ll. That tho said Town Council of Yorkville shall bavo power to re? gulate sales at auction within the limits of said town, nud to grant licenses to auctioneers: Provided, That nothing heroin contained shall oxtend to sales by a Sheriff, Clerk of Court, Judge of Probate, Coroner, Executor or Administrator, As? signee in Bankruptcy, or by any other person ont of tho order, decree of any Court, Trial Justice or any other inferior Court. SEO. 12. That this Act shall bo deemed a public Act, and shall continue of force for fourteen years, and till the end of tho Geuoral Assembly then next follow? ing, and all Acts of incorporation or amendments thereof, repugnant hereto, nro horoby repealed.
