LorriciAJj.] ,: ACTS AND JOINT RKSOJLVTIONS Passed by the Legislature-Session 1870 and 1871. AN ACT TO AJVTER AND RENEW THE OHAIt TEB OP THE TOWN OF MANNING. SECTION .1. Be it enacted by the Senate and Hope?. of. Representatives of the State of South Carolina* now met and sitting in General Assembly, and by the authority ?? th?.??uie, Thal HU A?? UUL tled "An i Act to incorporate certain towna and villages," approved on the 28th day of January, A_l). one thousand eight hundred ana sixty, be, and the same ie hereby, altered and amended as followa, to wit: That from and after the passage of this Aot, all and every person or persons, who shall bavo resided in the corporate limits of the village of Man? ning for two months, aro hereby de? clared to be members of the corporation hereby to be oreated. SEO. 2. That tho said person shall, from and after the passage of this Act, become a body pol i tia and corporate, and shall be known and called by the name of the "Town of Manning," and * its corporate limits shall extend ono-bolf mile in every direction from the Court House, as a centre, except on tho side next to Blaok River, the line of which, formed at high water, shall constitute its boundary in that direction. SEO. 3. That tho said town shall bo governed by an Intendant and four Wardens, who shall have resided in the State for one year* and within the limits of the corporation for sixty days imme? diately preoeding tfieir election. The said Intendant and Wardens shall be elected on the second Monday of the month of April in eaoh year, ten days' notice being previously given, and shall continue in office one year, and until thc elect iou ?nd qualification of their suoces Bors, and all mole inhabitants of the said town, who shall have attained the age o i twenty-one years, and resided therein two months immediately preoeding the election, shall be entitled to vote for said Intendant and Wardens. SEO. 4. That the said oleotion shall be held in some convenient publio place in said town, from eight o'clock in thc morning until four o'clock in tho even? ing, and when the polls shall be closed, the managers shall forthwith count the votes and declare the eleotion, giving notice tin writing to the persona eleotcd. The Intendant and Wardens, for thc time being, shall always appoint thc managers to conduct the election, who before they open the polls fer. the said eleotion, shall take an oath fairly anc impartially to oondaottbe same; and thi Intendant and Wardens, before on tor inf npon the daties of their offices, respect ively, shall take the' oath prescribed ty the Constitution of this State, and th" following oath, to wit: "As Intendant (o Warden) of the town of ManniDg, I xvii equally and impartially, to the beat o my ability, exercise the trust reposed ii me, and. will nse my best endeavors b preserve the peace and carry into effect according to law, the purposos for whid I have been eleoted: So help roe God. And if any person, upon being ole?te Intendant or Warden, shall refuse to ac as Buoh, he shall forfeit and pay to sai Town Goa noil the sum of twenty dollai for the use of said town: Providec That no person, who has attained th age of sixty years, shall be compelled t serve in either of the said offices, nc shall noy other person be compelled t servo more than one yoar in any term < three years. SEO. 5. That the Intendant and Wi dens duly eleoted and qualified sha during their term of service, several and respectively, bo invested with the powers of a Trial Justice or other i ferior court. RSEO. 7. That the Intendant and ' dens of said town shall have full only power to grant or refuse linens keep taverns, or rotail spirituous lit within the corporate limits of said t upon suoh conditions, and under Oircumstinocs, as to them shall proper and right: Provided, That instance-shall the prias of a license to keep tavern or to retail spirituous liquors be fixed at a IOBS Burn than is established by the laws of this Stato; and jill moneys paid for licenses, and for fines and for? feitures, for retailing spirituous liquors, keeping tavern and. billiard tables within the said limits without licenses, shall be appropriated to the public uses of said town: Provided, That the Intendant and Wardens duly eleoted and qualified Bhall not havo power to grant any license to keep taverns or retail spirituous liquors to extend beyond tho term for which they have been elected. SEO. 8. That it shall bo the duty.of the Intendant and Wardens to keep all roads, streets and ways within their cor? porate limits open and in good repair. They shall have power to compound with all persons liable to work tho streets, ways and roads in said town, upon such terms as they by ordinance shall estab? lish, the moneys so received to be ap? plied to the public use of said town ; and all persons refusing'or failing to pay such commutation shall be liable to such fine, not exceeding twenty dollars, as the Town Council may impose. SEO. 9. Tho said Town Council shall havo power to*regulate sales at auotion within the limits of said town, and to grant licenses to auctioneers: Provided, That nothing heroin contained shall ex? tend to sales by Sheriff, Clerk of Court, Tadge of Probate, Coroner, executor or ldministrator, assignee in bankruptcy, ar by any Trial Justice or other inferior jourt. SEO. 10. They shall also have power to impose au annual tax, nob exceeding ;wenty cents on every hundred dollars )f the assessed value of real and per? sonal estate lying within tho corporate imits of said town, the real and personal '.state to churches and school associatious ixcepted, and to reg?late th e pr ico of li? censes upon all publia shows and exhi? bitions in the said town, to erect a pow? ter magazine, and compel any person loldiog more than twenty-five pounds of >owder to store the same therein, and to nuke regulations for.the rates of storage hereof, and for keeping and delivering besame. SEC. ll. SEO. Ki. SEO. 13. SEO. l i. That the said Town Council shall have the power collect the taxes from'all persons representing publicly, within the corporate limits, for gain or reward, any plays or shows, of any kind whatever, to bo used for tho purpose of said town. . SEO. 15. That all the fines which shall hereafter be collected for retailing with? out license within the corporate limits of tho said town, shall be paid, one-half to the informer, and the other half to tho Council, for tho uso of tho said town. SEO. 10. That the said Town Council shall have power to abate all nuisances within their corporate limits, and also to appoint a Board of Health for said town, and to pass such ordinances as may be necessary to define the duties and powers of said board, and to imposa fines and penalties upon the member." of the said hoard for neglect of duty or refusal to serve: Provided, That no fine hereby lulborized to be imposed shall exceed Ibo sum of twenty dollars. SEO. 17. That tho snid Town Council shall havo power to borrow money for tho public use of the corporation, by is ming, from time to time, ns occasion ?nay require, the bonds of the corpora? tion, bearing interest at a rate not to ex? ceed seven per centum a year, to be paid semi-annually, for an amount not to ex ioed five thousand dollars; and for the payment of tho interest and the ultimate 'edemption of tho principal, according ;o the terms of the loan, the said corp o .?.tion shall ut nil times be liable: Pro lided. That tho private property of the nhabitants of the said town shad be mund for the redemption of said loan in io other way than by the imposition of in annual tax, according to the provi lions of this Act. SEO. 18. That the Intendant and bardens eleot shall, during their term of >ffice, be exempt from street duty. Each Down Counoil shall, within one month itter the expiration of their term of ?t? ico, make out and return to their suc ?essors a fall account of their receipts md expenditures daring their term, and mall pay over all moneys in their posses don, belonging to the corporation, and lol i ver up all books, records and papers ncident to their office, to their aucoes lors, and on failure to do so they shall JO liable to be fined in a sum not excoed ng one hundred dollars, to be collected n any proper action by the Town Conn )U. SEO. 19. That for any'wilful violation >r neglect of dnty, malfeasance in office, ibuse or oppression, the Baid Intendant ind Wardens, jointly and severally, shall JO liable to indiotment in the Court of Sessions, and, upon conviction, to pun shment ns proscribed in the preceding lection, besides being liable for damages :o any person or persona injured. . SEO. 20. That all ordinances heretofore passed by tho Town Council of Mau? ling, in conformity with the authority ?ranted by such tx isling lavis as do not conflict with the Constitution of tho State, shall be, and they aro horoby de dared legal and valid. SEO. 21. That all Acts and parts of inls heretofore passed in relation to in? corporation of the village of Manning, ie, and the same are hereby, repealed. SEC. 22.
