disabilities for Che reasons above named,
and, therefore, Cannot take the oath of
July 2, 1862; and, fonrtb, that being a
British subject, he is disqualified under
the Constitution from holding the office
aforesaid.
In answer to the above notice of con?
test, DeLarge. specifically denies thc
charges made. He states that he was
simply a hired servant on board of a
blockade-runner, by which menial ser?
vice he escaped from forced labor on the
defences of Charleston; thut he did not
yield a voluntary support to the Confed?
erate' Government; and, furthermore,
that ir he bad done so, being of the
negro race, the United States vested in
him none of tbe rights of an American
citizen. He also denies that he took an
oath of allegiance to the British Crown,
hut did hold British protection papers,
purchased to protect him from seizure as
a slave. In regard to his political disa?
bilities, DeLargo avers that under the
fourteenth amendment, ratified in 1868,
lie eau take the . oath of July, 1862, that
he has not voluntarily giveu aid, com?
fort, Seo,, since he was made a citizen.
Furthermore, thut as a native born resi?
dent of South 'Catolina, his original
right of citizenship would have reverted
to kim. tue instant he returned to the
State, even though ho might have taken
au oath of allegiance to Great Britain,
and that in 1864, the American Govern?
ment had not acknowledged the right of
a ci ti zo u to expatriate himself. Finally,
that by the fifteenth amendment his cit?
izenship became fixed and established by

FATAL. SHOOTING ?FFBAYS IN CALIFOR?
NIA.-The business manager of the Sac?
ramento Haily Reporter, Mr. Charles E.
Fisher, was shot dead in his own home,
on Weduesday evening, by Charles Dell,
? suitor of his daughter, whom ho had
ordered to leave the house.
At Collina, California, yesterday,
"Dad"- Shepardson, a farmer, aadiLen.
Stevens, an employee, had a fight. Ste?
vens attacked with a pitchfork, and
Shepardson endeavored to defend him?
self with a rev?lver, firing four shots,
two of which went through the lungs of
Stevens, and the others went through BIB
own thigh and body. The two men
were wounded mortally.
Jack Bell, an old resident of Los An?
gelos, was murdered yesterday by Miguel
Laohenas, who claimed the land that Bell
was ploughing. After shooting Bell,
Laohenas went to the city and gave him?
self up. Lachenas is known to have
committed three murders previously,
and tho citizens are terribly incensed
against him.

were thirty-nine known victims to
Lynch law in tho United States for the
year ending October 81,1870. Ot these,
ten were colored, fifteen ouffered for
murder, nine for rape, niue for robbery,
one for mutillation of a child, and five
for assault and battery. Let there be
the proper effort to enforce our statute
laws, and we may escape tho disgrace of
the return of Judge Lynch.

at bis home in Galveston, of the Hon.
David G. Burnet, whose life'contained
more adventure and romance than can
bo found grouped about , the career of
any living American. He was born in
Essex County, N. J., in 1790, and while
yet young, began his life of astonishing
vicissitude.
James Conlan, a brakeman on a
freight train on tue Hartford and New
Haven Railroad, was blown from the
top of the train, by tbe heavy wind on
the 16th, while adjusting the brake, and
killed. James MoHale, a slate roofer,
was blown from tue roof of a ohureh ip
Brooklyn the same morning, and in
stonily killed.
