C..) the low was very strict against what is termed "games of chance." About a dozen of the boys were de? tected playing "seven-up" or "old sledge," for money, and the grand jury found a true bill against them. Jim Sturgis was retained to defend them when the case came up, of course. Tin more he studied over tho matter and looked into the evidence, tho plainer il was he must lose a case at last-there was no getting around that painful fact. Thoso boys had certainly been betting money on a game of chance. Even pub lie sympathy was roused in behalf o: Sturgis. People said it was a pity to sec him mar his successful career with a big prominent case like this, which must gc against him. But after several restless nights, ni inspired idea flashed upon Sturgis, auc he sprang ont of bed delighted. H< thought he saw his way through. Thi next day, he whispered around a litth among his clients and a few friends, anc when the case came up in court hi acknowledged tho seven-up and the bet ting, and, as his sole defence, had th astounding effrontery to put in the pie that old-sledge was not a game of chance There was the broadest sort of a amil all over the faces of that soph isticate audience. The Judge smiled with th rest. Bnt Sturgis maintained a count* nanoo whose earnestness was even severe The opposite counsel tried to ridicul him out of his position, and did nc succeed. The Judge jested in a pondei ous judioial way about the thing, bi did not move him. The matter was bc coming grave. The Judge lost a littl of his patience, and said the joke ha gone far enough. Jim Sturgis said he knew of no joke i the matter; his clients could not b punished for indulging in what Bom people ohoso to consider a game o chance, until it was "proven that it was game of oh ance. Judge and counsel suid that would I an easy matter, and forthwith calle Deacons Job, Peters, Burke and Jobi son, and Dominies Writ and Miggles t testify; and they unanimously and wit strong feeling put down tho legal qui! ble of Sturgis, by pronouncing old-sledf was a game of chance. In demonstration thereof, i hereby and herein stated, iterated, iterated, set forth and made mnnif that during tho entire night tho "chun men never won a game or turned a jr although both feats were common ; frequent to the opposition. And thermore, in support of this our vord wo call attention to the significant that the "chauce" men are all bus and the "science" men have got money. "That ia the way that ec ven up came to bo set apart and particularized in the statute books of Kentucky as being a game not of chance, but of science, and therefore not punishable under the law," said Mr. Knott.
