GUILTY OR NOT GUILTY.
In my earlier years I studied for a ses?
sion at Edinburgh. It was in Burke's
year, not that of Edmund Barke, but of
another countryman of the same name,
and not less celebrated. The number,
the atrocity, and the cool speculative
motives of this fiend's misdeeds, ap?
proached genius in their way, and in tho
excitement of his trial and execution all
other topics were forgotten. I shall not
easily forget the singular fever of the
publio mind during these few weeks. I
was myself present at the trial, and wit?
nessed the spectacle of the greatest crim?
inal of the century being defended by
the first counsel at tho bar of Scotland.
A rumor had gone abroad that no coun?
sel could be found to appear for such a
monster; and as a testimony to tho duty
of counsel under all circumstances, tho
most celebrated advocates of the day,
without fee or reward, defended this
gang of murderers in the face of a tor?
rent of public prejudice.
The afternoon of tho day on which
Barke was cxeoated was distinguished by
a first-rate college row. The students at
Edinburgh, like its mob, have, when
roused, always been a formidable and
dangerous body; and on this occasion,
the police having intruded into the quad?
rangle to preserve order among the crowd
which hurried to the dissecting room, a
battle royal had ensued, attended by
some severe injuries, and resulting in a
triumphant and glorious defeat of tho
authorities.
To celebrate this propitious event a
Klipper party assembled that evening in a
tavern called the "Rainbow." The chair
was occupied by tho bard and satirist of
the college, a fellow of influite jest, who
made bis mark in the world afterwards,
but who at tUis time was mainly famed
and feared for tho sarcastic and biting
power of his humor. Opposite bim sat
the prince of students-tall, handsome,
reckless, Hashing with the exuberance of
youthful spirit, and a flow of convivial
fancy that I have never known equalled.
Among the others were two, who figure
in my story. Ono was a student named
Johnstone, the Thorsites of the circle
a disagreeable specimen of a stamp of
man which is generally to be found in
every circle, without either wit or talent,
excepting tho wit or talont to make others
feel uncomfortable. Bold and un?
scrupulous, and quick to see and sei?.o
on the weaknesses of others, bo was a
flagellum, a fly-blister; people feared to
make him their friend, and still more to
make bim their enemy, and so he ex?
torted from bato what he never would
have obtained from love, and was ad?
mitted to tho most select coterie of the
University.
The other was a stalwart, handsome
young Irishman, who had done mighty
execution in the middle of tho day; car?
ing but little, after tho temperament of
his nation, about tho merits of tho con?
flict, but hitting right and left as his
leader told him. He was an open-browed,
Spanish-looking BOU of Erin, half-rollick?
ing, half-sad in expression, who was
winding up a happy day with a happy
night; he had had a fight in the morn?
ing, and had a frolic in tho evening. His
name was Power, a medical student, who
had been but a week or two in Edin?
burgh. Ho was consequently an entire
stranger to tho others, and had been in?
vited to make ono of tho party, solely ou
tho strength of his fist.
Tho chairman, after many a gibo and
anecdote had gone round, roso to pro?
pose tho toast of tho evening-"Con?
fusion to tho police, anti bad dreams to
Bailie Rintoul." (In those days tho town
council ruled over tho collego, and the
obnoxious Bailie had given tho orders to
the police.) "As to tho first part of tho
toast," ho said, "it was superfluous, a
pleonasm, for tho police wcro in such
confusion already, that nothing the com?
pany could drink could add to it. As to
tho Bailie, tho seutimeut expressed in j
thc toast was suitable. His normal state
was slumber. He slept on the bench of j
justice, for he saw him in that state, on I
a solitary and melancholy episode in bis,
the chairman's, otherwise blameless lifo.
He slept in church, for he heard him on

"Another solitary andjmelancholy opi
sode," suggested tho vice.
"Order there! Ho heard him snore,
and from its vigor and constancy, the
occupation was manifestly habitual. But
if Homor sometimes slept, tho Bailie
sometimes awakes; as he did to shame
and defeat to-day. He is asleep again
by this time. Bad dreams to him-with
all the honors."
The vice thereon rose to propose a
contrast, os he called it, the Principal of
tho University, and tho Lord Provost of
tho City; and this he did in the style and
with tho accent of a very celebrated Pro?
fessor of Divinity. It was a great Phi?
lippic; and if words that burned could
havo withered and caloined a civio func?
tionary, tho unhappy Provost must havo
ceased from his troubling. He thus con?
cluded: "I propose that wo shall dedi?
cate thia flowing bowl to execrations and
exorcisms of that malignant star, which,
moving iu tho firmament amid tho
worlds of light, yet throws tho whole
universe out of gear by its ill-omened
aberrations, and propitiate and do ho?
mage to that bright particular luminary,
around whose beneficent and mellow ra?
diance, revolve tho planets of our hearts
and hopes."
Power, who had onco heard tho cele?
brated orator himself, was charmed and
delighted with the copy; and warming
with tho wino and tho excitement, added
his full share to the evening's amuse?
ment. Every one was cordial and cour?
teous to him, excepting Johnstone, who
seemed rather jealous of his popularity,
all tho moro that one or two shafts, le?
veled at Power, without tho latter per?
ceiving thom, had been rather roughly
warded off by tho vice. At last, ho also
roso to proposo a toast. "It was," ho
said, "tho Sister Isle, aud our gallant
allies, among whom," said he, breaking
into n racy brogue, of which ho was quito
a master; "I need not particularizo our
friend, over tho way. Who ho is, I do
not profess to know. He carno to us
suddenly, and like most of his country?
men, will probably so depart; whero ho
lives, I do not know, for his countrymen
seldom disclose their habitat; but if pug?
nacity and muscle-tho fruits of that
choico esculent of his nativo land-will
make a mau famous, famous ho will be.
May his hat never bo shabbier, bo his
coat never more thread-baro. May tho
rats fly his garret, tho mice leave bia sau?
sages in peace, and may his tick bo ex?
tended to a week."
Tho undisguised insolence of John
stone's address did not detract from its
vivacity, and tho audience laughed aud
applauded. Power rose to return thanks
with unruffled mien, and spoke with far
moro accent than before. "Ho was
proud and plased, he was, at tho kind?
ness of that jintlemnn. If he wore his
coat till ho was tired of tho company, it's
j littlo but threads would bo left of it; and
if he could listen forever to such elo?
quence, tho mice wero welcome to bia
dinner. He was proud of tho notico of
tho company. Long lifo to them, and
tho more shindies the better, if they nl
waj's ende-d in a blow-out, or whether
they did or not. As to thu worthy gos
sou who had proposed his health, ho had
mado his acquaintance under circum?
stances which bound thom together, for
ho (Power) caught him in his arms when
Sergeaut Macbean, (Cromwell's curse
upon him!) with ono hand on collar, nnd
tho other on croup, dropped him over
the balustrades like a half-quarter of
corn."
The shouts which greeted this allusion,
which was literally true, stung Johnstone
to tho quick. Seizing his tumbler, ho
flung its contents in tho speaker's face,
and then rushed from the room.
