Ba it enacted by the Senate and House of Representa tiros of the BUte of Sooth Carolina, now met and sitting in General Assembly, aud by the authority of the same. That Trial J es? li?os shall have and exercise within their respective Counties all the powers, su thority and jurisdiction, in criminal cases, hereinafter set forth. SEO. 2. Trial Justices shall have juris* diction of all offences whioh may be sub? ject to the penalties pf either flue or for? feiture not exceeding one hundred dol? lars, pr imprisonment in the Jail or Work Hones not exceeding thirty days,.and may impose any sentence within those limits, Singly or in the alternative. SEO. 3. Thoy rimy punish by fine not exceeding one hundred dollars, or impri? sonment io the Jail or House of Correo trttn not exceeding thirty days, all assault and batteries,.and other breaohes of the peaoe, when the offenoe is not of a high and aggravated nature, requiring, in judgment, greater punishment. SEO. 4* They muy cause to be arrested all affray ors, rioters, disturbers and breakers of the peace, and all who go armed offensively, to the terror of the people, and such as utter menaces o? threatening speeches, or otherwise dan? gerous and disorderly persons. Persons arrested for any of said of? fences shall be examined by tho Tria! Justice before whom they are brought, and may be tried before him, and, ii found guilty, may be required to tine Bureties of the peace, and be punisher! within tho limits prescribed in Section 2 or, when the offence is of a high and ag gravated nature, they may be committee or bound over for trial before the Cour of General Sessions. SEO. 5. They shall have jnrisdiotioi of larcenies, by stealing of the propert of another, of money, goods or chattels or any bank note, bond, promissor note, bill of exchange, or other bill order, or certificate; or any book of nc counts for br concerning money or good due, or to become due, or to be de livered; or any deed or writing contain ing a conveyance of land or any othc valuable coutraot in force; or any re ceipt, release or defeasance; or any writ process or public record, if the propert; stolen does not exceed twenty dollars i: valne. SEO. 6. They shall have jurisdiction c the offenoes of buying, receiving or aid ing io the concealment of stolen good or other property, where they would hav jurisdiction of the larceny of the sam goods or property. SEO. 7. They shall have jnrisdiotion < the offences of obtaining property b any false pretence, or by any privy e falso tokon, or by any game, deviot slight of band, pretensions to fortuu telling, trick or other means, by the m of cards or other implements or instri meute, where they would have jurisdii tion of a larceny of the annie propert; and may punish said offences the snu as larceny. SEO. 8. They shall cause to be arrest? all persons, found within thoir Coontie charged with any offence, and persoi who, after committing any offence with the County, escape out of the same; e amine into treasons, felonies, grand lu comes, high crimes and misdemeanor and commit or bind over for trial tho who appear to be guilty of crimes or c fences not within their jurisdiction, at punish those guilty of such offene within their jurisdiction. SEC. 9. All proceedings before Tri Justices, in criminal cases, shall be coi menoed on information, under oat plainly and substautiully setting for the offence charged, upon which, ai only which, shall a warrant of arrest sue. The information may bo amended any time before trial. All proceedings before Trial Jnstic shall be summary, or with only such c lay as a fair and just examination of t Oase requires. SEC. 10. SEC. 13. All Act3 or parts of Acti consistent or supplied by this Act hereby repealed. Approved March 1, 1870. AN ACT TO AUTHORIZE TRUSTEES TO IN FUNDS IN THE BONDS OP TUE STAT! SOUTH CAROLINA. SECTION 1. Be it enacted by tho Se nod House of Represeutatives of Stuto of South Carolina, now met sitting in Geuerul Assembly, and by authority of the same, That Guard Trustees, Administrators, Exeou Probate Judges, and Clerks of Co and all other persons holding fun ! trust for investment, are hereby autho? rized to invest the Bame in bonds of the State of South Carolina. And they are hereby relieved from all responsibility for said investment, except for the safe keeping of the bonds; Provided, That as to officers of the Court, there be no order of the Court'directing a different investment. : Approved March 1, 1870. Be it enacted by tho Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of tho same, That the mem? bers of the next General Assembly shall receive tho same mileage and per diem as now allowed the members of the pre? sent General Assembly by the provisions of the Constitution of this State, as rati? fied by the people on tho 11th, 10th and lGth days of April, 18G8. Approved March 1, 1870. AN AOT TO AMEND AN ACT ENTITLED ' 'AN ACT TO INCORPORATE THE DARN WELL RAILROAD COMPANY. ?ECTION 1. Be il enacted by the Senate and House of Representatives of the State of South Caroliun, now met and sitting in General Assembly, and by thc authority of the same, That Geo. D. Chapman, H. H. Boody, Wm. H. Thorp, Henry Budge, John D. Mills, A. W. Greenleaf, W. W. Dechalt, C. P. Leslie, Charles R. Abbott, Willis Gaylord, S. C. Pomeroy, and their associates, now form? ing and constituting the Barnwell Rail road Company, be, and they and theil successors are hereby, authorized anc empowered to extend the said railrbat from a point nt or near Blackville-ti Sumter Court House, in n Hue as nearly straight as may be practicable or con venient, so as to form a direct line fron Sumter Court House to the Savaonal River. . SEC. 2. That the capital stock of th said company may be increased at pies sure to a sum not exceeding three mil lions of dollars, to bo divided into share of ono hundred dollars each. SEO. 3. SEO. 8. That tb.e said "Enterprise Railroad Company, of Charleston," shall be able and capable,.by its corporate nome, to boy property and to sell, for the parp?se of its business, to sne and be sued, to plead and be impleaded, in any Court of Law or Equity in this State, to have succession of officers and members, and shall have power to make I by-laws, nob repugnant to the lawsof the land, for the government and good order of its members, as shall be deemed expedient by a majority of the stock? holders, and to have a common seal, and to alter and make new the same. SEO. 4. That the said "Enterprise Railroad Company, of Charleston," ebal! have power and authority to issue bomb to au amount equal to one-half of theil capital subscribed, the same to ba re deemable at such time, nob exceeding twenty (20) years, as may be agreed upoi by the said Company, and to bear inter?s at seven per cent, per annum, payabh semi-annually. SEO. 5. That this Act shall remain ic force and continuo for tho term of thirty (30) years. SEO. G. That all Acts or part? of Aot inconsistent with thia Act are hereby re pealed. Approved March 1, 1870. AN AOT TO BEQUIiATE THE ASSESSMENT AN! TAXATION OF PERSONAL PR0PERT1 IN TH OIT? OF CHARLESTON. SECTION 1. Be il enacted by the Senat and House of Representatives of th State of South Carolina, now met an sitting in General Assembly, and by th authority of the same, That tho Act ei titled "An Act providing for the asses: ment and taxation of property," ai proved the 15th day of September, I D. 1868, be, and the same is hereby, e: tended, so far as tho same is applicabl to tho city of Charleston, for the purposi of assessment and taxation of the pe sonal property, taxable in said city fi municipal purposes, rind tho same shu be tho rule of the City Council of Charle ton in assessing personal property, ai levying a tax thereon in said city, wi! snob modifications ns aro hereinafter pr vided. SEO. 2. Such returns of personal pr perty for taxation as are in said Aot i quired to be made to tho State ai County Auditor, shall bo mado at sm times, and to euch officer or office rs, the City Council by ordinance shall < reot. SEO. 3. The ossesment of personal pi perty, pursuant to said Act, aud the le of taxes thereon, shall bo mado by so officer or officers, and at such time times, as the City Connoil shall by or nance direct. SEC. 4. The penalties for negleot make returns, for false returns, and : non-payment of taxes, denounced in BI Act, and tho mode of procedure to < tain returns, and correot false retur shall be enforced by such officer or o eera, and at each time or times, as I City Council shall direct. SEO. 5. The sale of property for nup taxes, real or personal, shall bo made such times and such places, aud by si officer or officers, as tho City Council u direot. SEC. G. Tho collection of all taxes lc levied, and licenses imposed, by thoC Council of Charleston, for mnnici purposes, shall be made by such ollicei officers, and at such time or times, ns City Council may direct. SEC. 7. The City County of Charles is hereby authorized to reciuire tho r ment of such sum or sums of mon not exceeding five hundred dollars, license or licenses, os in their judgm be just and wise, by any person or ? sons engaged, or intending to bo gaged, in any calling, business or ] fes8ion, in whole or in part, within limits of the city of Charleston, ex< those engaged in the calling or prof es: of teacher of pnblio or privnte sch and ministers of the Gospel; Provi That no distinction shall be made or oount of race or color. SEC. 8. The City Council of Cha ton shall appoint a Board of Equa tion, consisting of five citizens, to tinue in office during pleasure, or itself aot as such, for the purpose eqnalizing the personal property, mo: and credits in said city, pursuant tc said Act. SEO. 9. Au appeal from any asi ment, made by any officer or officeri thorized to make the same, may be within such time as may bo preset by the City Council of Charleston, to said City Council, or to such Boa they may appoint for that purpose, shall hear aud determine the appeal whoso decision shall he final. SEO. 10. The City Council of Cbc ton is authorized to pass any ordii: necessary to carry the intent uud pm of this Act into full effect. Approved March 1, 1870. AN ACT TO INCORPORATE A HOME FOR LID CLERGYMEN. SECTION 1. Be il enacted by the 8 and House of Representatives o State of South Carolina, now met sitting in General Assembly, and b authority of the same, That Join Cornish, Wm. H. Clark, M orelle Fe Amory Coffin, M. D., H. W. Rat George W. Rose, and their suooe are hereby constituted a body cori and politic, by the name and titlt Homo for loralie! Clergymen, and by that name may BUO and be sued, plead and be im pleaded, in all Couria of Law and Equity ia thia State, have a common seal, and tho same, to alter at pleasure, and may have and enjoy every right and privilege incident to corporations, ac? cording to tho laws of South Carolina. The business of said corporation shall be the constructing, keeping and maintain? ing a Home for Invalid Clergymen of the Protestant Episcopal Church, and others, in the town of Aiken, or in such other location in the State of South Carolina as they may select, and to do generally all such business as said corporation may deem necessary and requisito iu conduct? ing a Homo for Iqvalid Clergymen and others; and that the said corporation shall have por,er uni capacity to take, purchase, hold and convey property, real and personal, not exceeding in value ono hundred thousand dollars. SEO. 2. The members of said corpora? tion, for the time being, or a majority of them, shall have power to AU any va? cancy which may happen by death, resig? nation er otherwise, to appoint a Secre? tary and Treasurer, and such other offi ceia as may be necessary; and may re? quire tho Treasurer and other officers to give bouda for the faithful discharge of their trusts and duty as said corporators may deem proper; and also to make and establish such by-laws, rules and regula? tions as they shall deem expedient for the management of the affairs of said corporation, aud the same to alter and repeal ; Provided, The same be not in? consistent with the laws of this State and the United States. SEO. 3. The books of said corporation, containing their accounts, shall at all reasonable timen be open for the inspec? tion of any of the Bishops of tho Pro? testant Episcopal Church, or any persons appointed by them or any one of them for that purpose. SEO. 4. This Act shall continue and be in force for the term of ninety-nine years. Approved March 1, 1870. AN ACT TO ENFORCE A UNIFORM SYSTEM OF ASSESSMENT ANO TAXATION BY MUNICIPAL BODIES. Whereas, it is provided by Section 1, Article IX, of t li o Constitution, that the General Assembly shall provide by law for an uniform and equal rate of assess? ment aud taxation, and shall prescribe such regulations as shall secure a just valuation for taxation of all property, real, personal and possessory, except mines and mining claims, tho proceeds of which alone shall be taxed, and also excepting such property as may be ex? empted by law for municipal, education? al, literary, scientific, religious or chari table purposes; and Whereas, it is provided by Section 8, of tho same Article, that the corporate authorities of Counties, townships, school districts, cities, towns and villages may bo vested with power to assess aud collect taxes for corporate purposes; such taxes to he uniform, in respect to per? sons and property, within the jurisdic? tion of the body imposing tho same. And the General Assembly shall require that all the properly, except that hereto? fore exempted with tho limits of munici? pal corporations, shall bo taxed for the paymeuts of debts contracted under au? thority of law; und Whereas, it is further provided by Section 2, Article XII, of the Constitu? tion, that the property of corporations now existing or hereafter created, shall be subject to taxation, except in cases otherwise provided for in this Constitu tion; therefore. SECTION 1. Be il enacted by tho Senate and House of Representatives of the State of South Carolina, now met aud sitting in General Assembly, and by tho authority of the same, That all munici pal corporations creatod under oj by the laws of this State, and vested with power to lay and collect taxes, are hereby au thorized and required to assess all pro porty, real and personal, within thei corporate limits, at its actual value, aud lay nil taxes thereon at a uniform aud equal rate; Provided, That all property aud no other, exempted from taxation by the third Section of tho Act entitle "An Act to provide for the assessmen and taxation of property," ratified the 15th day of September, A. D. 1868, shall be exempted from taxation by municipal corporations. SEC. 2. That all Acts or parts of Acts inconsistent with this Act be, and are hereby, repealed. Approved March 1, 1870.
