AN AOT TO AMEND AN ACT ENTITLED "AN ACT TO INCORPORATE THE GEORGETOWN BAXbBOAD COMPANY," AND TBE SEVERAL ACTS AMENDATORY OF THE SAME. SECTION 1. Be it enacted by tho Senate and Hoose Of Representatives of the State of South Oarelina, now met and sitting in General Assembly, and by the authority of the same, That the charter of the Georgetown Bailroad Company, and the Aot amendatory thereto, ratified on the twenty-eighth day of January, in the year cf cur Lord eighteen hundred and sixty-one, be, und the same are here? by, so amended as to authorize the said company to extend their road to the North Carolina line, in the direetion of Charlotte, North Carolina, by the most direct practicable route: Provided, That said road shall not be located to run pa? rallel within fifteen miles of the Sooth Carolina Central Bailroad, and that the corporate name of said company shall be "The Georgetown and Charlotte Bail? road Company," instead of that by which it ia now called. SEC. 2. That for the purpose of in? creasing the capital stock of said com puny to an amount not exceeding two millions of dollars, in shares of fifty dollars each, it shall be lawful to open books of subscription, at snoh times and places, and to keep them open for such periods of time, and under tho direction of snoh persons as may bo determined hy ??id Company. That subscriptions to said capital stock may bo mado in land, at a rate per acre to be agreed upon at the time of subscription, and that each and every person subscribing land shall execnte a deed for the same to the said company, and that all amonnts subscrib? ed, either in land or money, shall consti? tute a joint stock capital for the purpose of constructing and carrying iuto opera? tion the railroad^ provided for by this Act, and the Acts to which this Act is amendatory. SEC. 3. That the said railroad shall bo subject to the provision of an Act enti? tled "An Act to declaro the manner by which the hindu, or the right of way over the lands of persons or corporations muy be taken for the construction and uses of railways.and other works of internal im? provement;" and that nothing herein contained shall be so construed aa to ex? empt the said oompany from tho pay? ment of taxes. SEC. 4. That all the eighth seotion of the charter of incorporation of the said Georgetown Bailroad Company, after the word "provided," and including said word, be, and the same is hereby, re? pealed: Provided, That the work for the execution whereof the said company is incorporated shall be commenced within one year from the first day of January next, and be completed within five years thereafter. SEC. 5. That it shall be lawful for said company to re-organize, by the election of the necessary officers and directors. SEC. 6. AU Acts, or parts of Acts, in? consistent with the provisions of this Act, are hereby repealed.
