SECTION 1. Be if enacted by the Senate and Bouse of Representatives of the State of South Carolina, now mel and silting in General As? sembly, and by tile authority cf the same, That William M/8bannon, Joseph B. Kershaw, John M. DeSaussnre, James Dunlap, Jamos A. Young, James M. Davis, and their asso? ciates and successors, are hereby constituted a body politic and corporate, by the name and style of the Wateree and North Carolina Bailroad Company. SEO. 2. That the said company is hereby authorized to construct a railroad from tho town of Camden to .some point on the North Carolina lino, as nearly on a lino between Camdon and tho town of Goldsborough, North Carolina, as may bo practicable; and also a railroad from tho town of Camden to the North Carolina line, in tho direction of Charlotte, North Carolina. SEC. 3. That for the purpose of raising tho capital stock of tho said company, it shall be lawful to open books in the town of Camden, under the direction of James Dun? lap, James A. Young and James M. Davis; at Lynobwood, Kershaw County, under the direction of L. W. R. Blair, John lt. Shaw, B. S. Lucas and Daniel Bethune; at Cheraw, nuder the direction of Henry Melva, Alex? ander McQueen, Lt. S. Prince and Thomas E. Rowe; at Flat Rook, Kershaw County, nuder the direction of J. Ross Dye and Lemuel B. Stephonson; at Lancaster, under the direction of Jamos L. Reed, John D. Wylie, William A. Moore and W. M. Con? nors, for the purpose of receiving subscrip? tions to an amount not exceeding two mil? lions of dollars, in shares of ono hundred dollars each, for the purpose of construct? ing the railroads provided for by this Act. SEC. i. That tho amounts subscribed at the places at which books aro opened along the proposed lines towards Goldsborough and Charlotte, respectively, shall only be called in, the parties required to pay the same or regarded in any way as stockhold? ers in the said comapny for tho purpose of building, and in connection with tho rail- j road along the line where such subscriptions are made. SEC. 5. That the times and places for re? ceiving such subscriptions shall be Gxed by the Commissioners in the town of Camden, or a majority of them, and shall be adver? tised foi thirty days in ono or more news? papers in this State, aud tho books for re? ceiving such subscriptions shall be kept open for sixty days at each of the places where the same shall be opened. SEC. G. That on each share of tho stock subscribed, tho subscriber shall pay to the Commissioner receiving such subscription the sum of five dollars, end no subscription shall be valid without such payment; aud at the expiration of the time hereby proscribed for keeping open tho books, the said Com? missioner shall make a return of the sub? scriptions takon by them, and the sums paid thereon, to tho Commissioners in the town of Camden. SEO. 7. That when the sum of three hun? dred thousand dollars shall be subscribed in the manner herein prescribed, the said com? pany may meet and organizo at such timo and place as tuny be designated by a ma? jority of tho Commissioners herein named for tho town of Camden, due notice having first been given. SEO. 8. That for the purpose of organiz? ing and forming this company, all the powers conferred by the charter of the North-eastern Railroad Company on the Commissioners therein named shall be vested iu tho Commissioners named in this Act: Provided, The Commissioners named nt any point shall only have any power or bo called into the exercise of any such power in tho event of subscriptions taken and steps instituted towards building the road along tho route where such Com? missioners were required to open books; and all the powers, rights and privileges granted by the charter, aud the amendments thereto, of tho North-eastern Railroad Com? pany, to that company, shall be, and the same are hereby, grauted to tho Wateree and North Carolina Railroad Company, subject to the conditions therein named, ex oept as to tho atnonnt of capital stock, the sum necessary to authorize organization, and except so far as the special provisions of this Act maj' otherwise require tho same to be modified or varied: Provided, That nothing herein contained shall be construed so as to exempt the said company from the payment of taxes: Provided, further, That said road shall bo subject to tho provisions of an Act entitled "An Act to declaro the manner by which the lands, or the right of way over tho lands, of persons or corpora? tions may be taken for the construction and uses of railways and other works of internal improvement," ratified September 22, A. D. 1868. 3EC. 9. That this Act shall be deemed a public Act, and continue in force fifty years: Provided, That the work for the execution whereof the said eompany is incorporated shall be commenced within ono year from the first day of January next, and bo com? pleted within five years after its commence? ment Approved March 26, 1869. An Act to repeal the tenth Section of an Act entitled ''An Act to appoint a Board of Commissioners for the city of Charleston, reith porcer and authority to declare in what cases thc streets, lanes atid alleys shall he widened, and to provide for carrying into execution the objects of the said Board, and for other purposes therein mentioned." SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General As? sembly, and hy the author ty of the same, That Section 10 of an Act entitled "An Act to ap? point a Board of Commissioners for the city of Charleston, with power and authority to dcolaro in what cases tho streets, lanes and alleys shall bo widened, and to provide for carrying into execution tho objects of said Board, and for other purposes therein mentioned," be, and tho same is hereby, repealed.
