Be it enacted by the Satiate and House of Representantes of the State of South Carolina, now met and sitting in General As? sembly, and by the authority of the same, That all the banks iucoxporated by authority of this State, and which have, by Bnid authori? ty, issued bills of credit known as bank bills, and have failed to comply with said corporate privileges by refusing to pay their bills of credit, and arc now tims failing to comply with the provisions of said Act of incorporation iu this particular, and shall so continue to violate said Act uutil tho 1st day of Deoetnber, 1869, shall forfeit nil cor? porate rights and privileges, and are forbid? den to transact any business us banking in? stitutions: Provided, That the redemption of their bills in United States currency I shall be deemed the fulfillment of their obligations to the holders of said bills. SEO. 2. That it sholl be tho duty of the Comptroller-General, immediately after thc ratification of this Act, to furnish each of the said banks of the State with a copy thereof, and they shall report thereon to tho Comptroller-General, giviug a full state? ment of all tho property, aud assets and liabilities of the bank, and shall furnish a full statement of all their transactions every thirty days thereafter; and for every case of failure or neglect to so -eport, the officers of the bank shall forfeit and pay twenty five dollars for each duy so failing, to bel collected by tho Sheriff of the County on the order of the Comptroller-General, ap? proved by the Governor, to bo appropriated to the uso of the State; aud if uny of the banks agree to redeem their bills, the Comptroller-General shall give notice of said agreement in one or moro of the news? papers of this State, and shall notify the Judge of the Circuit in which such bank or j hanks maybe situated, of each and ivory bauk failing to comply with the require-] monts of the first Sectiou of this Act, whose duty it shall be to appoint a suitable person as receiver of each of the aforesaid banks, who shnll, aftor haviug filed a bond, with good und sufficient security, to be ap? proved by the said Judge, take charge of tho property nnd assets of the bank. SEC. 3. That tho said receiver shall fur? nish the Comptroller-General with a full statement of all the property and asset? be? longing to the said bunk, immediately after ? receiving the same, and shall proceed to ] the final settlement of the accounts of tho bank, in conformity to such rules as the Circuit Court may direct. SEC. 4. Any of the banks rcdeemiug their bills in conformity with the provisions of the second Section of this Act, and are able to redeem the same, and have remaining in their possession assets of the market vulno of fifty thousand dollars, may resume busi? ness as a banking corporation, after satisfy? ing the Governor aud the Coinptroller Geuerul that they arc possessed in fact of the said amount; and the Comptroller Goneral shall make known tho same by public notice iu ono or more newspapers of tho State. SEC. 5. Thc banks resuming business, in accordance with tho provisions of this Act, shall report to the Comptroller-General ns now provided by law, and their charters shall be deemed as redeemed for the amount so advertised bj- the Comptroller-General: Provided, That no bank shall bc so rechar? tered with a capital of less than fifty thou? sand, nor more thuu one million dollars: Provided,further, That all banks rechar? tered aud recommencing business under this Act shall be subject to taxation SEC. 6.
