An Act to amend an Act entitled ''An Act to define the jurisdiction ar.d duties of County Commissioners. " SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now mel arid sitting in General As? sembly, and by the authority of the same, That an Act entitled "An Act to define tho juris? diction and duties of County Commission? ers," passed tho 26th day of September, A. D. 1868, bo amended ns follows: At the end of Section 29 add: "Provided, That com? pensation s?mil not be allowed to any mem? ber of the Board of County Commissioners for exceeding one hundred days in any oue year, except to tho members of the Board of County Commissioners for tho County of Charleston, who shall not bo allowed compensation for exceeding one hundred an? fifty days in any one year. Compensa? tion for double this number of days may be allowed to County Commissioners during the first term of office, ending the third Monday in April A. D. 1870, but in all cases during said period, as well ns there? after, under the limitations, and in the manner following, to wit: An account shall be made ont in items, with dates prefixed, accompanied with an affidavit of the num? ber, stating that the items of Bitch account ar? correct and just, and that the services therein mentioned have been reudered ns stated, and no part of suid account has been paid. Tho accounts shall bo presented to the County Treasurer, who shall audit, and, if correct, pay the same ont of funds accru? ing from taxes laid and collected for County purposes. SEC. 2. That Section 27 of said Act shall be amended by tho addition of the follow? ing at the end of the Section: Tho County shall alBO pay 1. The fees of grand, aud petit jurors while in attendance upou the Circuit Court. 2. Witness fees in State enses, at tho rate of one dollar per doy for actual attendance on the Circuit Court, and seventy-five cents per day for actual attendance on a Magis? trate or Justice of the Peaoo Court, and five cents per mile for actual aud necessary travel. 3. Fees of physicians and surgeons testi? fying as experts beforo a Coroner's jury, or at the Circuit Court, after a post mortem ex? amination, ten dollars, and fivo cents per mile for actual aud necessary travel. gr?4. For dieting and keeping persous confined in the County jail, at tho rate of fiftycents per day. 5. Fees of the Circuit Solicitors for ser? vices in the County, when not collected from the defendant, at the following rates: In a trial before a jury in civil aud criminal cases, or before referees, a docket fee of ten dollars; in cases at law, where judgment is rendered without a jury, seven dollars and fifty cents-said fees to bo iu lieu of all other compensation whatever. 6. Fees of the Clerks of the CircuitCourts in State coses, at the rate now allowed by law. 7. 'Foes of the County Coroners, at tho rate now allowed by law. Before tho ac? counts of Sheriffs, Circuit Solicitors or Clerks shall bo presented to tho County Treasurer for payment; they shall be sworn to by said officers, examined and certified to by the Judge presiding in the Circuit Court in the County, approved and ordered to be paid by the County Commissioners. SEC. 3. Section thirty-four of said Act shall be, and tho samo is hereby, amended, sq as to read as follows: Tho County Com? missioners Bhull assess all taxes for County purposes upon the then last State valuation, and for this purpose shall, on or before the first day ol January in each year, obtain .from tho Auditor of the County, (who is hereby authorized and required to furnish the same,) a certified copy of the County dnplioate, as prescribed in Section 75 of the Act entitled "An Act providing for the assessment and taxation of property," and shall, on or before the fifteenth day of Jan? uary tbpreafter, pursuant to authority given by the General Assembly, nako out and de? liver to the County Treasurer, with their warrant to collect a tax bill for County purposes. Said tax bill and warrant shall be signed by the County Commissioners, or arnajority of them, sealed with their seal, and certified to by their olerk. Said tax bill and warrant DUUU be the Treasurer sufficient authority, and he shall proceed thereon to collect the taxes therein laid, in tho eorne mininer as provided hy law for the collection of State tuxes: Provided, That tho County duplicate, upon which to levy the tax for the year 1869, for County pur? poses, may be obtained as soon as practica? ble, after the same is completed by the County Auditor; and the tax assessed and all subsequent proceedings for the collection of the same bo hud in the same manner ns Stato taxes for said year are completed. SEC. 4. The County Commissioners of thc several Counties are hereby authorized to levy a tax of three mills on the dollar, if so much, iu their judgment, be uecessary, for County purposes, for the year 1869, to bo expended according to law. SEC. 5. It shall bo the duty of the County Commissioners to furnish the County Au? ditor and Troasurer of their respective Counties, office room, together with the ne? cessary furniture, stationer}*, ka., for the same. SEC. 6. If the County Commissioners of any County shall fail or neglect to perform the duties imposed upon them by Sections ll and 12 of said Act, by the 1st day of Juue, A. D. 1809, tho Judge of the Circuit iu which said County moy bc, be, and ho is hereby, authorized and required to make all orders and direct all measures necessary to forthwith accomplish the division of said County into townships and the organization of said townships. lu tho Senate House, the twenty-fourth day of March, in tho year of our Lord om thousand eight hundred and sixty-nine.
