SECTION 1. Be it enacted by the Seriate and House of Representatives of the State of South Carolina, now met and sitting in General As? sembly, and by the authority of the same, That no Sheriff, Constable, or other officer whose duty it- is to enforce executions, shall pro? ceed in any other manner than that pre? scribed by Sections 1 and 2 of the Act enti? tled "An Act to determino and perpetuate the homestead." SEC. 2. Sbonld any officer sell any real estate, without complying with Section 1 of said Act, or sell or remove any pertional property of the head of any family, whether th? head of such family is a freeholder or not, without bis or her consent, or first de? ducting the amount exempted by Section 32 of Articlo TI of the Constitution of the State of South Carolina, in tho manner provided by Section 2 of the Act referred to, and Section 1 of this Act, ho shall bo deemed guilty of malfeasance in office, and, on conviction thereof, shall, for the first offence, be fined in a sum not less than five hundred dollars, nor more than one thousand dollars, and for the second offence shall be dismissed from office; and, in either case, shall bo liable to the parties for all in? juries by reason of his wrongful levy or nal e. SEC. 3. AU Acts, or parts of Acts, incon? sistent with this Act, ure hereby repealed. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That if, iu any Counties of the State, the grand and peut jurors have not been drawn at the regular terms of tho Courts of Gene? ral Sessions and Common Pleas for this State, the Circuit Judges are hereby author? ized to order the Clerk and Sheriff, at any time not less than seven days preceding the next sitting of said Court, to draw from the jury box grand and petit jurors for the en? suing term of said Court; and the jurors so drawn shall be summoned to attend the same by the Sheriff, as is now provided by law. SEC. 2. This Aot shall continue in force until the Act entitled "An Aot to regulate the manner of drawing jurors," passed Sep? tember 26, 1868, shall take effect. Be il enacted bu the Senate and House of Representatives of the Stale of South Carolina, now met and sitting in General As? sembly, and by the authority of the same, That capital punishment, except in the caso of wilful murder, is hereby abolished. SEC. 2. Manslaughter, or the unlawful killing of another without malice, express or implied, shall be punishable by hard la? bor in tho Penitentiary, not exceeding thirty years nor lesa than two years. SEC. 3. Tho crime of burglarv shall bo punishable by hard labor in the Penitentia? ry for a period not exceeding thirty years nor less than one. The crimes of rape and arson shall bo punishable by hard labor in the Penitentinry for life, or for a period not less than ten years, according to the aggra? vation of these offences. SEO. 4. The benefit of Clergy is hereby abolished. In the Senate House, the third day of Feb rnary, in the year of our Lord one thou? sand eight hundred and sixty-nine. CHAS. W.
