AN ACT TO ESTABLISH QUARANTINE AT * GEORGETOWN, CHARLESTON AND HEL? TON HEAD. I. Be it enacted by die Senate and House of Representatives of the State of South Carolina, now mel and silling in General Assembly, and by the au? thority of die same, The anchorage ground for vessels at quarantine at the porta of Georgetown, Charleston and Hilton Head shall be where it has heretofore been, and shall be de? signated by buoys to b? anohored under tho direction of the health offi? cers; arid every vessel subject to qua? rantine shall, immediately on her arrival, anchor within them, and there remain, with all persons arriv? ing on her, subject to the examina? tion and regulations imposed by law. For the purposes of quarantine the port at Hilton Head shall be held to include the port of Beaufort. H. Vessels arriving at the ports of Georgetown, Charleston and Hilton Head shall be subject to quarantine as follows: 1. All vessels from any place where pestilential, contagious or infec? Vus disease existed at the tinie of their departure, or which shall have arrived at such place and proceeded thence to either of said ports, or on board of which, during the voyage, any case of such disease shall have occurred, arriving between the first day of May and the first day of November, shall remain at qua? rantine for at least thirty days after their arrival, and at least twenty days after their cargo shall have been dis J? charged, and shall perform such-fur > trier quarantine as tho health officers may prescribe. 2. All vessels from any plaoe (including islands) in Asia, Africa or the Mediterranean, or from any of the West Indies, Bahama, Bermuda or Western Islands, or from any place in America in the ordinary passage from which they pass South of Hilton Head; aud all vessels on board of which, during the voyage, or while at the port of their depar? ture, any person shall have been sick, arriving between the first day of May and the first day of November, and all vessels from a foreign port, and cot embraced in the first sub-division of this Section, shall, on arrival at the quarantine ground, be subject to visitation by the health officers, but shall not be detained beyond trie time requisite for duo examination and observation, unless tbey shall have had on board during the voyago some case of infectious, contagious or pestilential disease, in which case trioy shall be subject to sucri quaran? tine regulations AR trie health officers may prescribe. 3. III. All vessels and persons remain? ing at quarantine on tho first day of November shall thereafter be subject to sucri quarantine and restrictions as vessels and persons arriving on and after that day. IV. The health officer, Intendant and Wardens, or trie Mayor and Al? dermen, as trie case may be, when? ever in their judgment the public health shall require, may order any vessel at the wharves of either of said ports, or in their vicinity, to the qua? rantine ground or other place of safety, and may require all persons, articles or things introduced into said ports from such vessels, to hts seized, returned on board, or removed to the quarantine grouud or other pince. If the master, owner or consignee of the vessel cannot bo found, or shall refuse or neglect to obey tho order of removal, the health officer, Intendant and Wardens, or Mayor nnd Alder? men, os tho caso may be, shall have power to cause such removal nt the expense of such master, owner or consignee, and such vessel or person shall not return to tho port without the written permission ot" the health officer. V. If any vessel arriving at the quarantine ground, subject to qua? rantine, shall be bound to some port North of either of so id ports, the health officer, ofter having duly visit? ed and examined her, maj' permit her to pass on her voyngo, but no such vessel shall be brought to an? chor off of either of said ports, nor shall any of her crew or passengers land in or hold any communication with either of said ports or any per? son therefrom. VT. The master of every vessel re? leased from quarantine and arriving at a wharf in either of said ports, shall, within twenty-four hours after such release, deliver tho permit ol the health officer at tho office of the Mayor or Intendant, as tho case may be. VII. Nothing in this Act shall pre? vent any vessel arriving at quarantine from again going to sea before break? ing bulk. VIII. It shall be the duty of encl: pilot belonging to either of tho soie ports to use his utmost endeavors tc hail every vessel ho shall discover cn tering the port, and to interrogate the master of such vessel in roferoucc to all matters ueceesary to en abb such pilot to determine whether, ac cording to the provisions of tho pre ceding Sections, such vessel is subjec to quarantine or examination by tin health officer. IX. If from the answers obtuinec from such inquiries it shall appeu that such vessel is subject to quaran tine or examination by the healtl officer, according to the precedini Sections, tho pilot shall immediate!; give notice to the master of the VOE sel that he, his vessel, his cargc crew and passengers, aro subject t such examination, and that he mat proceed and anchor said vessel at th quarantine anchorage, there to awai tho further directions of tho healt officer. X. It shall be the duty of ever pilot, who shall conduct into port vessel subject to quarantine or e: animation by the health officer: 1. To bring such vessel to anche within tho buoys marking tho quarai tine anchorage. 2. To prevent any vessel or bo? from coming along side of the voss under his charge, and to prove? anything on board from being tran forred to or throwu into any otb' vessel or boat. 3. To present to tho master of tl vessel a printed copy of this Ac when such copy shall hnvo been d livered to him for that purpose. ?. XI. XII. It shall be the duty of health officer to reside within or n tho quarantine ground, ard ho si have power: 1. To remove from tho quaranl anchorage ground any vessel he r deem dangerous to tho public hot to any plaoo South or East of quarantine ground inside the bar. 2. To cause any such vessel ' i' ' * I ? ti ... ...... ..J??".?Lil< cargo, bedding, and tho clothing of porsons on board, to bo ventilated, cleansed and purified in such man? ner, and during such time, ns ho shall direct, and if ho sball judge necessary to prevent infection or contagion, to destroy any portion of such bedding or clothing; and with tho concurrence of the Mayor or In? tendant, any portion of such cargo which may be deemed incapable of purification. ?i. To prohibit and prevent all per? sona arriving in vessels subject to quarantine from leaving quarantine, or removing their goods or baggage therefrom, until fifteen days aftor the last case of pestilential, contagious or infectious disease shall have occurred on board, and ten days after her arrival at quarantine, unless sooner discharged by him. 5. To pormit the cargo of any ves? sel under quarantine, or any portion thereof, when ho shall judge the sumo freo from infection and contagion, to bo convoyed to tho landing. 6. To cause all persons nuder quar? antine to be vaccinated, when ho deems it necessary for tho preserva? tion of the public health. 7. To administer oaths and take affidavits in all examinations pre? scribed by this Act, and in relation to any alleged violation of quarantine law or regulation; such oath to have tho like validity and effect ns oaths administered by a Justice of the Peace or Magistrate. XIII. The health officer may di rect in writiugany Sheriff, Constable or other oitizeu, to pursue and appre bend any person, not discharged who shall elope from quarantine, o: who shall violate any quarantine lav or regulation, or who shall obstrue the health officer in the performance of his duty, and to deliver him ti said officer to be detained at quaran tine until discharged by said officer but such confinement shall in no casi exceed ten days. It shall bo the dut; of tho Sheriff, Constable or otho: citizen, so directed, to obey soc! direction ; and every such person s eloping, or violating quarantine ho and regulations, or obstructing th health officer, shall be considere guilty of a misdemeanor, punishabl with fino and imprisonment, in th discretion of tho court. XIV. Every vessel, during lu quarantine, shall bo designated h colors, to be fixed in a couspicuoi part of her main shrouds. XV. No vessel or boat shall pt? through the range of vessels lying i quarantine, or land at tho quarautii grounds, without tho permission i the health officer. XVT. No lighter shall be employ* to load or unload vessels at quara tine without permission of thc heal officer, and subject to such restri tions and regulations as he shall ii pose. XVII. All persons being on boa of vessels under quarantine shall provided for by the master of t vessel in which they shall have i rived; and if the master shull omit refuse to provide for them, or th shall have been sent on shore by t health officer, they shall bo ma: fained at the expenso of such vess her owners, consignees, and each a every ono of them; and the bea officer shall not permit such vessel leave quarantine nntil such expel shall have been repaid or secur and tho said health officer shall h< an action against such vessel, 1 owners and consignees, and each e overy one of thom, for such expems which shall bo a lien on si vessel, and as such may be enfori as other lions on vessels. XVIII. Tho health officer, iq the application of tho master of i vessel under quarantine, may con! in any suitable place on Bhoro i person un board of such ve charged with having committed offence punishable by tho laws of 1 State or the United States, and i cannot bo secured on board of s vessel; and such confinement i continuo during tho quarantine such person, or until ho shall bo i ceoded against in duo course of I and tho expenso thereof shall charged and collected as in thc preeeding Section. XIX. Any person aggrieved by decision, ortler or direction of health officer, may appeal theref to tho Governor, Attorney-Oon and Comptroller-Gonernl, who E constitute a Board of Appeal; said Board shall have power to ail reverse or modify tbe decision, o or direction appealed from, and decision of the Board thereon i be final. XX. An appeal to the Boar Appeal mast be made by ser upon the health officer a wr: notice of such appeal, within tv hours (Sundays excepted) after appellant receives notice of the oi decision or direction complained of. Withiu twelve hours after the health officer receives such notice (Sundays excepted) he shall make a return, in writing, including the facts on which his order, decision or direction was founded, to the Governor, who shali immediately call n meeting of the Board of Appeal, and shall bo Presi? dent of said Board; and said appeal shall be heard and decided within twenty-four hours thereafter, (Sun? days excepted;) and until such deci? sion is made, tho order, decision or direction complained of, except it refer to tho detention of a vessel, her cargo or passengers at quarantine, shall bo suspended. XXL Whenever tho said health officer, in the performance of the duties and in thc execution of tho powers imposed and conferred upon him by law, shall order or direct tho master, owner or consignee of any veusel under quarantine to remove such vessel from her anchorage, or to do any aot or thing, or comply with any regulation relativo to said vessel, or to any person or thing on board thereof, or which shall havo been brought to said ports therein, and said master, owner or consign?e shall neglect or refuse to comply with such order or direction, tho said health officer shall have power to employ such persons and assistants as may bo necessary to carry out and enforco such order or direction, and tho per? sons so employed shall have a lie J on such vessel, her tackle, apparel and furniture, for their services and ex? penses. XXII. Every person who shall op? pose or obstruct the health officers in performing the duties required of them by law, and every person who shall go on board or have any com? munication, intercourse or dealing with any vessel under quarantine, or with any of her crew or passengers, without the permission of the health officer, or who shall, without such permission, invado the quarantine grounds or anchorage, shall be gnilty of a misdemeanor, and shall be puni3hed by a fine of not less than one hundred nor more than five hun? dred dollars, or by imprisonment not less than three nor more than six months in the Penitentiary. XXIII. Tho Governor may issue his proclamation declaring any place where there shall be reason to believe a pestilential, contagious or infectious disease exists or may exist, to be au infected place within the meaning of this Act. XXIV. Such proclamation shall fix the period when it shall cease to have effect; but such period, if he shall i judge the public health require it, j may from time to time be extended, and notice of tho same shall bo pub? lished in all tho newspapers of said ports. XXV. After such proclamation shall have boen issued, all vessels ar? riving iu either of tho said ports from such infected place shall be subject to the same quarantine laws and re? gulations as the vessels embraced in the first sub-division of the second Section of this Act, and shall, to? gether with their officers, crews, pas? sengers and cargoes, be subject to all tho provisions, regulations and pe? nalties of this Act, in relation to ves? sels subject to quarantine; but such quarantine shall not extend beyond the period when such proclamation shall cease to have effect, as provided by the last preceding Section. XXVL Every master of a vessel subject to quarantine or visitation by the health officer, arriving in either of the said ports, who shall refuse or neglect either: 1. To proceed with and anchor his vessel at the place assigned for qua? rantine at tho timo of his arrival; 2. To submit his vessel, cargo and passengers to tho examination of tho health officer, and to furnish all ne? cessary information to enablo that officer to dotermino what length of quarantine and other regulations they ought respectively to bo subject; or, 3. To remain with his vessel at quarantine during tho period assigned for her quarantine, and while at qua? rantine to comply with the directions and regulations prescribed by law, shall be guilty of a misdemeanor, and bo punished by fine not exceed? ing two thousand dollars, or by im? prisonment not exceeding twelve mouths, or by both such fine and im? prisonment. XXVII. Every master of a vessel hailed by a pilot, who shall either: 1. Give false information to such pilot, relative to the condition of his vessel, crew or passengers, or of the health of the plaee or places from whouce he came, or refuse to give such information as shall be lawfully required: 2. Or, land nny person from his vessel, or permit any person exoept a pilot to come on board of his vessel, or unlado or tranship any portion of his cargo before his vessel shall havo been visited or examined by tho health officer; 3. Or, shall approach with his ves? sel nearer to tho wharves in said ports than tho place of quarantine, to which they may bo directed, shall bo guilty of the like offence and sub? ject to tho like punishment; and any person who shall land from any ves? sel, or unlado or tranship any portion of her cargo under likecircumstances, shall bo guilty of tho like offence and subject to tho like punishment. XXVIII. Any person who shall violato any provision of this Act, or neglect or refuse to comply with tho directions and regulations which any of tho health officers may prescribe, shall bo guilty of tho Uko offence, and bo subject for each offence to tho like punishment. XXIX. Thero shall be ono health officer at the port of Georgetown, ono at Charleston, and ono at Hilton Head, respectively, who shall bo ap? pointed by tho Governor, and who shall hold their office for tho term of two years, unless sooner removed: said officers shall keep a faithful record of all their doings under tho provision of this Act, and report tho same to tho Governor at the end of each month. XXX. Said health officers shall each receive an annual salary of twelve hundred dollars, except tho health officer at tho port of Charleston, who shall receive an annual salary of fif? teen hundred dollars, payable quar? terly, out of the Treasury of tho State; and they each shall be allowed an additional sum of fifteen dollars per month for boat hire and other incidental expenses. Be it enacted by the Senate ano House of Representatives of the Statt of South Carolina, now met and sitting in General Assembly, and by the autho? rity of the same, The Electors of Pre sident and Vice-President sha! convene nt thc capital, in some con venient place, on the day preceding the first Wednesday in Decembei after their election; and those o them who shall be so assembled at i o'clock in the afternoon of that da; shall immediately after that hon proceed to fill by ballot and b; plurality of votes all vacancies in th< Electoral College occasioned by tin death, refusal to serve, cr neglect t< attend at that hour, of any Elector or occasioned by an equal number o notes having been given for two o more candidates. IL The Electoral Collego beini thus completed, they shall thei choose a President and Secretar, from their own body. III. IV. On tho said first Wednesda in December, the Electors shnll mci at some convenient placo at tho cap tal, and then and there voto by balle for President and vice-President, or of whom, nt least, shall not be a inhabitant of the samo Stato wit themselves. They shall name in the ballots tho persons voted for as Pres dent, and in distinct ballots tho pe sons voted for as vice-President. V. Every Eleotor of this State for the election of a President and vice President of the United States, who shall attend at any election of those officers and give his vote at the timo and place appointed by law, shall be entitled to receive for his attendance at such election, and for traveling to and from his place of residence, by the most usual route, the same sum os shall at the time be allowed by law to members of the General Assembly for their attendance and travel, to be paid in like manner.
