XXXTT. There shall be prepared by the Commissi oners three separate lists of each statement, besides the list to be filed in the office of tho County Clerk or Secretary of ; State, and each list sball be certified to ns correct by the signatures of tho Com? missioners subscribed to such certifi XXXTTT. Within three days after the final adjournment of the Board of Connty Canvassers, the Chairman of the Board shall deposit in the nearest post office, directed to the Governor, Secretary of State and Comptroller-General, (the full post? age paid,) encl), one of the certified copies of the statement and certificate of votes, prepared as provided in the last preceding Section. OP THE FORMATION AND PROCEEDINGS OP THE BOARD OF STATE CANVASSERS. XXXIY. The Secretary of State shall appoint a meeting of the State Canvassers, to be held at his office, or some convenient place, on or be? fore the fifteenth day of December next after suoh general eleotion, for the purpose of canvassing the votes of all officers voted for at such elec? tion, except Electors of President and Vice-Pr?sident. XXXV. The Secretary of State, Comptroller-General, Attorney-Gen? eral and Treasurer shall constitute the State Canvassers, three of whom shall be a sufficient number to form a Board. XXXVI. If a majority of those officers shall be unable, or shali fail to attend, one of the Justices of the 1' Supreme Court and the Mayor of the city of Columbia, being notified by the Secretary of State, shall attend without delay, and, with the officer attending, shall form the Board. XXXVLT. The Board when thus formed shall, upon the certified, copies of the statements made by the Boar ls of County Canvassers, pro? ceed to make a statement of the whole number of votes given at snch eleo? tion for the various offices, and each of them voted for, distinguishing the several Counties in which they were given. They shall certify such state? ments to be correct, and subscribe the same with their proper names. XXXVlil. Upon such statements, they shall then proceed to determine ana declare what persons have been, by the greatest number of votes, dnly elected to such offices, or either of them. XXXIX. They shall make and sub? scribe, on the proper statement, a certificate of such determination, and shall deliver the samo to the Secreta? ry of State. XL. The Board shall have the power to to adjonrn, from day to day, for a term not exceeding five days. XLI. The Secretary of State shall record in his office, in a book to be kept by him for that purpose, each certified statement and determination whioh shall be delivered to him by the Board of State Canvassers, and every dissent or protest that shall have been delivered to him by a Can? vasser. XLII. He shall, without delay, transmit a copy, under the seal of his office, of such certified determina? tion to each person thereby declared to bo elected, and a like copy to the Governor. XLIII. He shall cause a copy of such certified statements and deter? minations to be printed in one 01 more of the pablio newspapers in each Connty, if any shall be publish? ed therein. XLTV. He shall prepare a general certificate, nuder the seal of thc State, and attested by him as Secro tary thereof, addressed to the Houst of Representatives of the United States m that Congress for whioh an] person shall have been chosen, of th< due election of the persons so chosei - at such election as Representatives o this State in Congress, and shal transmit tho samo to the said Hons? of Representatives at their first meet ing. XLV. Tho Secretary of State shal enter in a book, to be kept in hi office, the names of the respeotiv< Connty officers elected in this State specifying the Counties for whicl tiiey were severally elected, and thei place of residence, the office for whicl they were respectively elected, an< their term of office. Tho Commissioners of Elections of each County shall make four certified copies of tue statement of votes given for Electors in their County, one of which copies shall be flied in the office of the Clerk of the County, if thora bo such Clerk duly qualified by law; another of such copies thoy shall forthwith transmit to the Governor, another to tho Sec? retary of State, and deliver the other as hereinafter directed. XLVIU. Tho Commissioners of Election of oach County shall appoint a messenger, and shall deliver to such messenger the remaining certified copy of the statement of tho votes given in their County for Electors, securely enclosed and ratler seal, and such messenger shall proceed forth? with to deliver the same to the Secre? tary of State. XLTX. The Bcd of State Can? vassers shall meet at tho office of tho Secretary of State ou the Wednesday next after the third Monday of No? vember next after such election, or sooner, if nil the certified copies of tho statements of the Count}' Can? vassers shall have been received from all the Counties, to canvass tho votes given for tho Electors of President and vice-President; and in caso all the certified statements shall not have been received on that day, the Board may adjourn, from day to day, until tho same shall have been received, not exceeding five days; and if at the expiration of four days certified copies of tho statements of tho Coun? ty Canvassers shall not havo been received from any County, tho Board shall prooeed to canvass upon such of the said statements as shall have been received. L. Tho Board of State Canvassers shall proceed in making a statement of all tho votes, and determining anti certifying the persons elected, in the manner prescribed by law in re lation to thc election of other of? ficers. LT. Tho Secretary of State shall, without delay, cause a copy, undei the seal of his office, of the certifi?e determination of the Board of Statt Canvassers to be delivered to each o: tho persons therein declared to b( elected; and for that purpose he maj employ such and so many messenger; as ho shall deem necessary. LIL The determination and cer tificato of tho Board of State Can va8sers in relation to the choice o Electors shall be published in tin same manner as herein provided ii relation to the certificates of the clcc tion of other officers. LILT. If any of the messenger; shall be guilty of destroying tho cer tificates entrusted to their caro, or o wilfully doing any act that shall de feat the due delivery of them as di rected by this Act, he shall bo pun ished by imprisonment in tho peni tentiary at hard labor, for a term no less than two nor exceeding fou years; and if any person shall bi found guilty of taking away from an; of the said messengers, either b; forco or in any other manner, an; such certificates entrusted to his care or of wilfully doing any act tba shall defeat tho duo delivery thereof as directed by this Act, ho shall b punished by imprisonment in th penitentiary nt hard labor, for no less than two nor exceeding fou years. LIV. If any officer or messenger on whom any duty is enjoined i; this Act, shall be guilty of any wilfu neglect of such duty, or of any cor rupt conduct in the exeoution of th samo, and be thereof convicted, h shall be deemed guilty of a mistic meanor, punishable by fine not cs ceeding five hundred dollars, or im prisonment not exceeding one year. LV. The messengers employed o appointed under this Act shall rt ceive for their compensation twelv cents per mile for traveling, to b audited by the Comptroller-Genen npon the certificate of tho Secretar of State. LVI. Tho Commissioners of Ele< tion shall receive for their compensa tion three dollars per day for thei services while actually employed; an the Managers shall receive two do lars per day while actually employet and the clerks of the Commissionei and the clerks of tho Managers, r< speotively, shall receive two dollai per day while aotually employed. LVLT. Solicitors for the seven Circuits in the State shall be electo at the next general election provide for in this Act; also, suitable persor to fill any vacancy in any electn oflfico in any Connty, of whioh i least fifteen days' previous notic shall bo given, by the proclamntio of the Governor.
