in repairing highways and bridges; and shalt, annually, on or beforo the said fifteenth day of January, make oat a tax bill for each surveyor, con \ faining the amount of tax to be laid ? out by him in his district, with the amount of each person's tax annexed to his name,., accompanied with a warrant, signed by some Justice of the Peace of tho town, authorizing suoh surveyor to collect suoh tax; and the Selectmen shall doliver tho several tax bills to tho respective sur? veyors and take their receipts for tho same. XLiVII. Each person who shall furnish work on the highways in pay? ment of his highway lax assessed by the Selectmen shali be allowed, fora good band, nt the rate of ten cents for eaoh hour; and tho several towns at the annual meeting, and in case of their neglect, the Selectmen may establish thc price to be allowed for teams, carriages and tools to be em? ployed in making repairs; and in case of the failure of both the town and Selectmen to establish such prices, it shall be the duty of the highway sur? veyor of the district to make such allowances for the uso of teams, car? riages and tools as shall bc equitable atd jost. XLVm. Tho Selectmen shall di? vide their respective towns into a Sufficient number cf highway districts to be convenient for repairing high? ways,, and may, from time to timo, alter tho same; and it shall bc thc duty bf each surveyor of highways to superintend the expenditure of tho highway' tax, and to take charge of and keep in repair at all times tho highways in his district; and ho shall bo responsible to tho town for any damages which may be sustained by tho town through fault or neglect of the discharge of his duty. XLIX. For the purpose of keeping the? highways and bridges in repair, the several towns in this State, at their annual meeting, or at any other legally warned meeting for that par? p?se, may raise by vote a tax of such a per cent, on tho list of such town as such meeting may think necessary, in addition to the tax assessed by the Selectmen, to be paid in labor and expended in the several highway dis? tricts: Provided, That if, iu the judg? ment of the Selectmen of the town, any of the highway districts of sud town shall not require tho whole amount of the tax accruing from thc list of tho highway district to bo ex ponded within itsli rnits, it shall heap propriated in any part of such distric where the Selectmen shall direct. L. Tho surveyor of the several dis triots, after receiving their severa tax bills and warrants, shall proceec to give notico to the several person: liable to pay taxes in their district of the amount of their taxes, and o the timo and placo in which, au< teams, carriages and tools with which they are required to pay their taxe in labor; but no person shall be lin ble to furnish any team, carriage o tool of which he is not the ownei except hoes, shovels or spades. LT. Such notice may be given t all persons resident in the town, eithe personally or by written notice left a their usual residence, and to non residents by a written notice left with or at the rcsidenco of, their tenants agents or other persons having th care of their property; all of whic notices shall be at least three day; aud in case of persons residing out c tho town, at least ten days, before th time appointed for them tocommenc their work; and if such non-residenl ^ shall have no tenant or agent in tb town, notice may be posted up i some public or conspicuous place i tho district; and the surveyors sha make and keep a miuute of the tim and manner in which the notice sha be given. LIL Any person, after he has con menced working in payment of h highway tax, shall bc subject to tl direction of tho surveyor, as to tl time when, and tho places where, h tax shall bo paid and laid out i labor. LIU. At least three-fourths of tl highway tax in any town, payable i labor, shall bo oollected and laid 01 between the fifteenth day of Jannai and tho first day of May, and tl remainder between tho first day < September aud tho first day of X vember iu each year, except as her iuafter provided. LIV. On any extraordinary occ sion, when any bridgo or high wi shall be destroyed or impaired so to require immediate repairs, or sh.' be obstructed so as to require imm diate labor to remove tho obstructio it shall be the duty of the survey forthwith to causo tho highway bridgo to bo repaired, or tho obstT tioa removed; and he may for th purpoao call npon and notify ai inhabitants of the District to affo him tho necessary aid, or may hi other laborers, or employ otl means to open or repair tho big ways and bridges; and in such ct tho notico shall be deemed sufficic to any person owing taxes payable ??in District, in ordor to maka h liable for r.?glect to pay his tax money, if such notice shall bo giv six hours previous to tho time wi ho is required to appear and lab If any person shall, in such cn perform labor more than sufficient pay tho taxes duo from him, or i person not indebted for taxes si perform labor, thc amount of st I labor, or the balanco, may bo credi to such person towards his highv tax the succeeding year. LY. I? in suoh casu any surveyor shall, for tho space of twelve hoars after application made to him for that purpose, neglect to call upon the inhabitants of his District, or use other proper measures to repair or open the highway or bridge which may be out of repair or obstructed, he shall forfeit and pay to the Select? men of tho town, to be oxponded in repairing highways in suoh District, the sum of ten dollars, with costs, to bo collected in tho nnmo of the town, unless snob surveyor shall show sufficient reason for such neglect. LVL If in such case any inhabi? tant of any District, whoso namo shall he on the tax bill of such Dis? trict, whether auy tax shall bo duo from him or not, shall for the space of six hours after being called on, or notified, by tho surveyor for that purpose, without sufficient reason, neglect to turn out and assist in re? pairing or opening such highway or bridge as he shall be required, ho shall forfeit and pay to tho Selectmen of tho town the sum of threo dollars, to be collected and expended as pro? vided in the preceding section. Li VII. If any persou against whom a surveyor shall havo a tax payable iu labor shall neglect, after beiug no? tified, as provided in this Act, to work ont his tax, shall be liable to pay his tax in money; aud tho sur? veyor ahali proceed to collect tho same, and shall havo all tho power which the County Treasurer has by law to collect State taxes; and shall proceed in the same manner iu the collection, and shall havo tho same foes. LVIII. It shall be the duty of each surveyor to lay out, in such mannet as ho may think beneficial, in making and repairing highways in his dis? trict, all moneys collected by him iii his tax bill, or received in any other way for that purpose. LIX. Each surveyor shall koot fair and regular accounts of all laboi performed and all moneys receivec and expended in his District, and of the labor that may have been per? formed by any persons over and above their taxes, and make return of hi; accounts to the Selectmen annually iu the month of December. And il shall be the duty of such surveyor t< pay over to the Selectmen any money which may remain in his bauds nu expended; and any moneys whicl may be so received from tho surveyo shall be paid over by tho Solcctmoi to the succeeding surveyor, to be ex pended in the same District; an< when any persons shall have over paid their taxes, in labor or other wise, the balance shall be credited b such persons ou their taxes for th succeeding year. LX. If any surveyor shall hov failed to collect the taxes cou tai nc< in his tax bill, as required by law or if he shall fail to \)ay over an moneys which he may have collecte and not expended, the Selectme may proceed against him in thc sam maimer, as provided by law, in th case of delinquent County Treasui ers or collectors of taxes. LXI. If any person receive or su fer bodily injury or damago in hi property through a defect or want c repair or of sufiicient railing in c upon a highway, causeway or bridge ho may recover in nu action of tori of the Couuty, Town, Village or Cit by law obliged to repair the samt the aruouut of damage sustaine thereby, if such Count}-, Town, Vi Iago or City had reasonable notice < the defect, want of repair or of sufi cient railing, or if thc same had OJ isted for tho space of twenty-fot hours previous to occurrence of tl: injury or damage; but no such dan age shall be recovered by a perso whose carriage and load thereon e: coeds the weight of six tons. LXII. If before the entry of a action provided for in thc precedin Section, tho defendant tenders to tl: plaintiff the amount which ho won! bo entitled to recover, together wit all legal costs, and the plaintiff doc not accept the same, and does in recover upon the trial more than tl sum so tendered, the defendant sha recover his costs. LXIII. If a town neglect to repa any of the ways or bridges which is by law obliged to keep in ropai or neglect to make the same; safe ai: convenient, such town shall be liab to indictment and line as tho Cou in its discretion may order; aud tl fine imposed in such case shall 1 certified to tho County Cominissio ers by tho Clerk of tho Court, wi shall assess the same upon tho list such town, and the same shall bo cc lectod in tho same manner ns pr vided by law for State or Coun taxes; and tho samo, when collecte shall bo laid out under tho directi< of tho County Commissioners in t repair of highways and bridges in t County. LX?V. LXV. lu tho construction of t or any other statute, the follow: rules shall bo observed, unless st ?construction Bhnll bo inconsistent 1 with the manifest intent of thc L?gis? lature, or repugnant tc tho context of the same, that is to say : 1st. .The word "town" may be con? strued to iuoludo tho word "town? ship." 2d. Tho word "highway" may in? clude "bridges," and shall be equiva? lent to tho words "County way," "County road," "State road" and "common road." 3d. The word "oath" shall include "affirmations," in cases where bylaw an affirmation maybe substituted Tfor an oath, and in liko cases the word "sworn" may include the word "ainrm." I 4th. Tho words "preceding" and following," when used by way of re? ference to any section of statutes, shall mean the section next preceding or next following, unless some other section is expressly designated in such reference. 5th. Words purporting to give a joint authority to threo or more pub? lic officers, or other persons, shall bo construed as giving such authority to a majority of snell officers or per? sons. Gth. The word "sworn," when ap? plied to public officers, shall bo con? strued as referring to tho oath pre? scribed by tho Constitution. . LXVI. This Act shall not be con? strued to interfere with the char? tered rights of any city or villago heretofore existing in this Stato; but all chartered cities and villages, ex? cept tho city of Charleston, shall bo included in and form a part of the townships established nuder Sections ll and 12 of au Act entitled "Au Act to defino tho jurisdiction and duties of County Commissioners." LXVII. That so much of tho first and tenth Sections of tho Act entitled "An Act to define the jurisdiction and duties of County Commissiou ors" ns rolatcs to roads, highways and bridges, shall bo construed as giving authority to County Commissioners to exercise alli tho powers herein given to towns or town officers over the same, when such towns or town I officers cannot or unreasonably ne? glect or refuse to excrciso such pow? ers. LXVin. This Act shall take effect as to each township on and after completion of tho duties assigned to County Commissioners, under Sec? tions ll and 12 of an Act entitled "Au Act to define tho jurisdiction and duties of County Commission? ers." LXIX. All Acts and parts of Acts inconsistent with this Act, or sup? plied by it, are hereby repealed; and all offices, by whatever namo known, tho functions and powers of which are conferred upon officers or per? sons named in this Act, shall, upon the same going into effect as herein provided, be abolished. ATLANTA, October 16.-Tho Demo? cratic Executive Committee of Geor? gia issued tho following to-day: It having been represented by the Republican speakers iu the present canvass, that the Southern people favor tho re-establishing of slavery in their respectivo States, depriving them of the right of suffrage; for the purpose of mooting this allegation and giving it a positive denial, it is resolved by the Central Committee of tho Democratic party of Georgia, representing the people of tho State, that the charge is unequivocally false; and for tho evidence that they do not desire tho re-establishing of slavery, aud could not effect it if they would, they refer to the fact that this State has ratified tho amendment to thc Constitution of tho United States forever abolishing slavery and in? voluntary servitude, except for crime, whereof tho party shall bo legally convicted.
