[OFFICIAL.] Acts Passed at the Late Session of the Legislature. AN ACT TO ALTER AND AMEND AN ACT ENTITLED "AN ACT TO OROANIZE THE OrRCUTT COURTS. " I. Be il enacted by the Senate and House of Representatives of the Slate of South Carolina, now met and sitting in General Assembly, and by the autho? rity of the same, The Couuties of Chesterfield, Marlboro, Marion, Dar? lington and Fairfield shall constitute the fourth Circuit. The Counties of Kershaw, Rich? land, Newberry aud Lexiugton shall constitute the fifth Circuit. II. The Circuit Courts in the Coun? ty of Fairfield shall hereafter be held at Winusboro on tho second Monday of March, July and November; and the Court of Common Pleas at Winns boro on tho first Wednesday after the second Monday of March, July and November. The Circuit Courts in the County of Kershaw shall horeafter beheld at Camden on the first Monday of Janu? ary, May and September; and tho Conrt of Common Pleas at Camden on the first Wednesday after the first Monday of January, May and Sep? tember. HI. Be it further enacted, That so much of an Act entitled "An Act to organize the Circuit Courts" as is in? consistent with this Act be, and the same is hereby, repealed. Be it enacted by the Senate and House of Representatives of the Slate of South Carolina, now mel and sitting in General Assembly, and by the au? thority of the same, That all officers heretoforeolectedbe, andar? hereby, allowed until the first day of Janua? ry, 1S69, to qualify and enter upon the duties of their respective offices; and on failure to qualify within the above specified time, their respective offices shall bo declared vacant by the Governor. II. That in all cases whoro the County Commissioners refuse to ap? prove the bonds of any County offi? cers, tho said officers may refer the same to the Attorney-General, aud if approved by him, shall bo accepted by the County Commissioners. III. That all Acts and parts of Acts inconsistent with this Act are hereby suspended until after the first day of January next, except the Act to or? ganize the Supreme Court. Be ii enacted by the Senate and House of Representatives of Hie State of South Carolina, now met and sitting in General Assembly, and by Ike au? thority of the same. The Supreme Court shall hold annually at the seat of Government two sessions; the one commonoiuflr OD th? fourth Tuesday of November, and tho other the first Tuesday- x^XpjML It shall be the duty of fill,the Justices to be present, ahdth? Chief Jnstieo shall preside. In the absence of the Chief Justice, the Justice oldest iu commission shall preside. II. If at any stated term of the Snrjromo Court, two Justices thereof shall not attend on tho first day of the term, the Justice that may attend shall have authority to adjourn said Court from day to day, for ten days after the time appointed for the com? mencement of said term, unless two Justices shall sooner attend; and the business of said Court shall not in such case be continued ovor to tho next stated term thereof until the expiration of said ten days. III. The JnBtices of the Supreme Court shall qualify in flvo months after the dato of the election, by tak? ing tho oath prescribed by the thir? tieth Section of Article IT of the Constitution, or tho office bo declared vacant by tho Governor, and shall enter forthwith upon the duties of their office; such oath of office shall be administered to tho Justices chosen at the first election, if quali? fied under tho Constitution, by the Governor of the "tate; and when such Justices shall be chosen at any subsequent eleotiou, such oath shall be administered in like manner, and nnder like conditions and limitations, by a Justice of said Court. IV. The Supremo Court shall be n Court of Record, and the books ol record thereof shall, at all times, bc subject to tho inspection of tho citi? zens of the State, or other persons interested. The Clerk of said Court shall have the custody and keeping of its records, and shall furnish certi fied copies thereof to persons desir ing the same, upon tho payment o: the fees prescribed by law. Sait' records shall bo kept in the mannei prescribed, from time to time, by th< Justice of the Court. V. AU books of record, all files and all property of tho Court of Ap peals, of Law and Equity, and of thi Court of Errors, existing under tb lato Provisional Government of Soot! Carolina, shall be transferred to tb? Supreme Court, and all causes pend ing in Courts under tho laws of sai< Provisional Government shall hav day, be heard, tried and determinei in the Supreme Court without chang of process or form of proceduro, wit all rights respected and preserved aud all processes and recognizance of every kind, whether respectin bail, bonds, costs or otherwise which relate to said canses, shall b considered as bclongiug to said Cour in the same manner, as if they ha been issued or taken in referenc thereto. VI. Each of the Justices of tl Supreme Court shall have power 1 administer oaths, issno writs of ii junction, mandamus, quo warrant habeas corpus, aud other romedi writs, according to tho principh and course of common law heretofoi existing in the State of South Can lina, which is hereby declared to 1 of force so far as applicable and ni inconsistent with the Constitutio; subject, on motion of either part to re-cxamiuation, affirmance or r versal, and final adjudication by tl proper jurisdiction. VIL Tho Sheriff of Richlar County shall attend every session the Supreme Court to perform su< official service as by the said Cou shall bo required, and he shall 1 allowed and paid therefor at the ra of five dollars per day. Said Sher shall, under the direction of the Chi Justice, secure a suitable room which to hold said Court, and offic for ?ase of tho same, and provi necessary furnituro, printing, bini books, stationery, fuol and ligh and the accounts and vouohers 1 all of said expenditure and servic? shall be certified to under oath ' said Sheriff, approved by tho Ch Justice, audited by the ComptroU General, and paid by tho Treasm of the State, out of any funds r otherwise appropriated. VIII. A special term of tho ? preme Court shall be held in the c of Columbia, on the third Monday September, A. D. 18G8, at 12 o'clc M. of that day, or as soon thereaf as practicable, at which term si Court shall have authority to trans, any business pertaining there which, in their judgment, may qniro dispatch. IX. All Acts and parts of Acts consistent with this Act, or suppl by it, are hereby repealed.
