Be it enacted by the Senate awl 7/0 ?se of Representatives of the State of South Carolina, now mei and sitting tn General Assembly, and by the autho? rity of the same, In pursuance of Sec? tion 18 of Artiolo Iv Of tho Consti? tution, the State is hereby divided into eight ircuits, as follows: 1. The Counties of Charlestor. and Orangeburg shall constitute the first Circuit. 2. Tho Counties of Edgefield, Barnwell, Oolloton and Beaufort shall constitute the second Circuit. 3. The Counties of Sumter, Cla? rendon, Williamsburg, Georgetown and Horry shall constitute the third Circuit. 4. Tho Couuties of Chesterfield, Marlboro, Murion, Darlington and Kershaw shall constitute the fourth Circuit. 5. XL Should tho business before tho Court of General ?Sessions, at any term, not bo completed on tho arrival of the day fixed by law for the hold? ing of tho Court of Common Pleas for said County, the Judge presiding may, in bio discretion, adjourn said Court of Common Pleas until the said business of tho Court of General Ses? sions shall have been concluded. XII. Tho several Circuit Judges shall have power to hold special ses siuns within their respective Circuits at any time in their discretion, or a tho discretion of tho Chief Justice, o which the Judge presiding shall givi such notice as the Chief Justice ma; direct, or as may, in his judgment be necessary, should no directions b given. XV. The Judges elected and qun lied by taking tho oath prescribed tho thirtieth Section of tho soco Article of tho Constitution, whi oath, to tho Judges under the fi election, shall bo administered by t Governor of the Stato of South Ca lina, who is hereby empowered administer tho same, aud to 1 Judges under any subsequent el tion by ono of the Justices of 1 Supreme Court, shall forthwith en upon their duties; and all cases beg aud pending in the Courts of Cc mon Pleas and Sessions of tho Prc sional Governmentof South Carob at the expiration thereof shall be, a the same aro hereby, transferred the County Courts having jurisi tiou of the same, established by t Act, with all files, rocords aud rj porty pertaining thereto and to s Courts; aud all processes, writs t recognizances of every kind, whet respecting juries, witnesses, bail otherwise, shall bo considered as longing to tho Courts herein est lashed, in tho sumo manner as if t had been issued or taken with ro enco thereto: Prodded, That no cu shall be transferred as aforesaid cognizable in tho Circuit Courts nc tho Constitution on original pro? or appeal. XVI. The- Circuit Courts he established shall be Courts of record, and the books of record thereof shall at all times be subject. to the inspec? tion bf any person interfudWl therein : XVII. The Clerk elected in eaoh County under the n rn visier; 5 of Sec tion 27 of Article IV of the Constitu? tion shall be Clerk of the Courts of General Sessionsand Common Pleas, and may appoint a deputy, who may perform the duties of Clerk, for whoso aots such Clerk shall be responsible, and a record of whose appointment shall bo mado in the Clerk's office; and such appointment maybe revok? ed at tho pleasure of the Clerk; and in case no Clerk exists, the Judge shall have authority to appoint a per? son, who shall perform tho duties of Clerk, and said Deputy Clerk, or the ono appointed by the Judge, shall be required to give tho usual bond be? fore entering upon the duties of tho office. XVIII. All suits in Equity depend? ing in the Courts of Chancery, and not finally disposed of, and tho pro? perty and records relating thereto, on tho first day of January, A. D. 1869, shall be transferred to the Courts of ? Common Pleas in and for their re 1 spective Countios, and shall bo enter? ed upon the dockets of said Courts for the stated term thereof next ensu? ing, and thereupon shall be heard, tried and determined, with all rights respected and preserved, in the same manner asif originally brought there: Provided, That no cause shall be transferred to the dockets of the Courts as aforesaid not cognizable therein under the Constitution: Pro v ided, fur titer, That all causes depend? ing as aforesaid, and the property and records pertaining thereto, cognizable under the Constitution in the Courts of Probate, shall be transferred to said Courts. XIX. All books of reoord, all files, and all property of whatever kind, of tho Courts of Chancery, except as hereinbefore provided, shall, on tho first day of January, A. D. 1869, be transferred to the Courts of Common Pleas for the Counties having juris? diction of Uko causes; and the seve? ral Clerks of the Circuit Courts shall receive tho same from the outgoing Clerks and Masters of said Courts and receipt therefor, and also enter said receipts upou the records of their respective Courts. XX. All writs heretofore issued (or which, before the ratification of this Act, shall havobeen issued) and made returnable to tho terms of the Courts of Common Pleas, as heretofore established by law, shall be returna? ble to the terms of the said Courts which shall first issue in each Coun? ty, respectively, under tho provisions of this Act. XXL At tho term of the Court of Sessions and Common Pleas which shall first ensue in each County after the ratification of this Act, it shall bo the duty of tho Judge presiding to call tho docket of tho late District Court, and to pass such orders, pro? posed by the Solicitor on the Ses? sions, or by tho plaintiffs' attorneys in civil causes, ns in the judgment of the Court may be proper, to.transfer the unfinished business to its proper tribunal for adjudication.
