SEO. 1. Corporations may he form? ed nnder general laws; but all such laws may from timo to timo bo altered or repealed. SEC. 2. The property of corpora? tions now existing, or hereafter creat ed, shall be subject to taxation, except in eases otherwise provided for in this Constitution. SEC. 8. No right of way j shall, bo appropriated to the ilse bf any corpo? ration until foll compensation there? for shall be first made, or secured by a deposit of money to th? owner,, irrespective of any benefit.from any improvement proposed by such cor? poration, which compensation shall bo ascertained by a jury of twelve men, in a Oonrt of Record, as shall be prescribed by law. SEO. 4. Dues from corporations shall be secured by such individual liability of the stockholders and other means, as may be prescribed by law. SEO. 5. All general laws and spe? cial acts passed pursuant to this sec? tion, shall make provisions therein for fixing the personal liability of stockholders under proper limita? tions, and yindi prevent and punish fraudulent misrepresentations as to the capital, property and resources of suoh corporations, and shall ulao regulate the public use of all fran? chises which have heretofore been or hereafter may be created or grant? ed, by or under the authority of this State, and shall limit all tolls, im? posts and other charges and demands under such laws. SEO. 6. The General Assembly shall grunt no oharter for banking purposes, nor renew any baukiug ?corporations now in existence, except upon the oondition that thc stock? holders shall bo liable to the amount of their respective share or shares of stock in suoli banking institution, for all ?B debts and liabilities, upon note, bill, or otherwise; and upon the further condition that no direct? or or other officer of said corporation shall borrow any money from said corporations; and if any director or other officer snail be couvicted upon indictment of directly or indirectly violating this section, he shall be punished by fine or imprisonment, nt the discretion of the court. The militia of this State shall consist of ul I nh lc hod i eil male citizens of the State betweeu the ages of eighteen and iorty-five years, except .such persons as aro now, or . muy horeaftor bo, exempted by tho laws of the United States, or who may bc averse to boaring arms, as provided for in this Constitution; and shall be orgauized, armed, equipped and disciplined as the Gone rall Assnmbly may by law provide. SEO. 2. The Governor shall have power to oali oat the militia to exe? cute tho laws, repel iu vas ion, represe insurrection, and preservo tho public peace. SEO. 3. There shall be an Adjutant and Inspector-General elected by tile qualified electors of the State, at the same'time and in the same manner as other State office ra, who shall rank as a Brigadier-General, and whose duties and compensation shall be prescribed by latv. The Governor, shall appoint, by and with the advice and cousent of the Senate, such other staff officers os the General Assembly may direct. ARTICLE XTV. MISCELLANEOUS. Ssc. L KO person shall be elected or appointed to any office in this State, unless he possess the qualifica? tions of an elector. SEC. 2. Lotteries, and the sale of lottery tickets, fox any purpose what? ever, are prohibited, and the General Assembly shall prevent the same by penal laws. Ssc 3. The State Library shall be subject to such regulations as the General Assembly may prescribe. SEO. 4. The Geueral Assembly may direct, by law, in what manner claims against the State may be established and adjusted, SEC. 5. Divorces from the bonds Of matrimony shall not be allowed but by the judgment of a court, as shall be prescribed by law. , SEO. 6. Nb person who denies the existence of the Supreme Being shall hold ) any office under this Constitu? tion. '. J , , BEC. 7- Tho printing of the laws, journals, tills, legislative* documents and papers for each branch of the General Assembly, with the printing required for the Executive and other departments of State, shall be let, on contract, in such manner as shall be prescribed by law. SEO. 6. The real and personal property of a woman, held at the time of her marriage, or that which she may thereafter acquire, either by gift, grant, inheritance, devise or otherwise, shall not bo subject to levy and sale for her husband's debts, but sholl be held os her separate pro? perty, and may be bequeathed, de? vised or alienated by her the same as if she were unmarried: Provided, that no gift or grant from the hus? band to the wife shall bo detrimental to the just claims of his creditors. SEO. 9. The General Assembly shall provide for the removal of all causes which may be pending when this Constitution goes into effect to courts created by the same. SEO. 10. The election for all State offioers shall take place ut the same time os is provided for members of the General Assembly, aud tho elec? tion for those officers whose terms are for fonr years shall be held at each alternate general election.
