WASHINGTON, August 7.-The fol?
lowing is the summing up by Judge
Fisher, to the jury in the Surratt
case:
From the observations which I have
addressed to you, you will infer:
First. That a conspiracy formed in
time of war to, take the life of the
President and Vice-President of the
republic, and the head's of the Execu?
tive Departments, for the purpose of
adding the enemies of tho Federal
Government, by throwing it into
anarchy and confusion, is treason as
heinous and as hurtful to the people
of this country, as the compassing
the death of a. King or Queen of I
Great Britain As to the subjects of
that realm. ?Second. That every per?
son engaged in such conspiracy, as
long as he continues a member of it,
is responsible; not ouly for the act of
treason, but for any murder or less
crime which may flow from it Third.
That the Government may waive the
oharge of treason against any or all
the conspirators, and proceed against
them for the smaller orime of murder,
included in the granter crime of trea?
son. Fourth, That under on indict?
ment for murder, resulting from the
prosecution of snch conspiracy, evi?
dence of the entire scope of the con?
spiracy may bo considered in esti?
mating the heinous character of the
offence laid in the indictment. Fifth.
That it waa not necessary to aver in
the indictment the fact that Abra?
ham Lincoln, the victim of the mur?
derer, was, at the time of its commis?
sion, President of the United States,
or to prove it, in order to allow the
jury to take that fact into the ac?
count, in determining the heinous
character of the crime;, it being a fact
of whioh the courts will take judicial
cognizance. Sixth. Tb at he who does
an act by another does it by himself,
and is responsible for its conse?
quences, in criminal os well os civil
cases. Seventh. That although an
alibi, when clearly established, forms
complete and unanswerable defence,
the mere absence from the immediate
scene of crime, resulting from a con?
spiracy unrepented of and nimban?
do ned by the party charged, it will
not avail him if he were at some
other place assigned him, performing
-. his part in the conspiracy. Eighth.
That this plea is, unless clearly made
oat, always regarded with suspicion,
and a circumstance weighing against
him who attempts it, because it im?
plies an admission of tho truth of the
foots alleged against him, and the cor?
rectness of the inference drawn from
them. Ninth. That flight from the
scene of crime, the fabrication of
falso accounts, and the concealment
of instruments of violence, are cir?
cumstances indicating guilt. Tenth.
Although a confessiou, in the slight?
est degree tainted with tho promise
of favor, or by duress or fear, is not
admitted as evidence against him who
makes it, yet if made freely and vo?
luntarily, is one of the surest points
of guilt.
The foremau of the jury request*?
a copy of tho recorded evidence, but
Judge Fisher said it was unusual.
The d?fonce was willing, but the pro?
secution objected.

crew of nino persons, all were lost
except the captain, who was picked
up from a raft. Every arriving ves?
sel brings reports of the severity of
tho gale. Many noticed unknown
vessels in tho distance.
WASHINGTON, Augnst8.-It is said
that tho President has directed his
subordinates to hold no couihiunica
tion with Stanton as Secretary of
War.
Tho Surratt jury still disagree, and
stand, it is asserted, 10 to ii for ac?
quittal. Considerable interest is at?
taching to the commission's recom?
mendation of Mrs. Surratt to mercy.
The fact cannot be doubted that the
President never saw the communica?
tion. He reiterates his previous as?
sertions to that effect. The President
also says that the documents were
not arranged, when presented to him,
as now. They were in loose sheets.

blacks. This is tue first practical en?
forcement of the jury order in this
immediate section.

field, to-day, issued au order that,
after the 20th instant, all the desti?
tute in tho State be turned ovor by
the military authorities to the over?
seers of the poor in the respective
Counties and cities. The Freedmen's
Bureau rations will no longer be
issued.
CHARLESTON, August 8.-Sailed
Steamer Moneka, New York.
Gen. Sickles hos issued an order in
relation to certain moneys advanced
by South Carolina bauks, during the
war, for tho purchase of horses for
the Confederate service, but which,
not being expended, had been distri?
buted since tho war, under a chancery
decree, among banks aud other claim?
ants. The order annuls tho decree as
a fraud against the United States,
and appoints a receiver, on the part
of the Government, to whom the
funds distributed, including costs
and fees of counsel, are to bo repaid.
The receiver is directed to report
promptly any delinquency or obstruc?
tion, on the part of individuals or
corporations, in the way of the exe?
cution of the order.
