citizens of Texas regardiug the re?
storation of Judges Bacon and Strib
liug, reinstated by Sheridan after
deposition by the Legislature. The
memorialists say the military cora
tnnuder at El Paso disregarded the
laws of Texas, denied County ollicers
the right to execute Stnto laws, re?
fused to recognize the officers ap
poiuted by Gov. Hamiltou, and that
ho appointed magistrates,' with au?
thority to render judgments and
issuo executions, without allowing
debtors the stay provided by law.
Also, they state that Bacon is unfit?
ted by lack of learning for tho posi?
tion; also, that tho property ol the
citizens of El Paso County, Texas,
has boen confiscated mid sold since
thc closo of the war, uuder proeosses
issued by tho Federal District Court
of New Mexico.
It is understood in official circles
that tho Attorney-General, in his
opinion just prepared, holds that
the reconstruction Acts pr?vido for
two governments-military and civil;
that both aro provisional and to be
obeyed; but to cease when the re?
organization of the Stato Govern?
ments takes place. Ho .also takes the
position that the military is only to
protect all in their rights of personal
property, and for thc preservation of
order and tho suppression of vio?
lence mid crime. There is no au?
thority iu the law for removal, by the
military commander, of tho poper
officers of tho State, neither execu?
tive nor judicial, or the appointment
of their successors. Tho military
commander is not authorized to de?
stroy; but ia bound to protect, civil
officers-a military commander being
regarded as conservator of tho peace,
and not an abrogator of the laws.
A jury was obtained in Surratt's
ease to-day, which will secure the
trial of tho accused, beginning on
Monday.
Tho amount of gold in the Trea- |
surv of tho United States to-day was
$103,000,000, of which sum $18,000,
000 have been deposited by parties
who hold certificates thereof, and
$S5,000,000 belong to tho Govern?
ment.
Tho Louisiana National Bank, of
New Orleans, on its voluntary appli?
cation, has been discontinued as a
depository for public moneys and a
financial agent of the United States.
