Be Ht enactei by the Senate and House of nepreeentativee of the United States of Ame? rica, in Congress assembled, That all par? son* born in tho United States, and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States; and such citizens, of eveTy race and color, without regard to any previous condition of slavery or involuntary servitude, except as a punishment for crime, whereof tho party shall have keen duly convicted, shall nave tho same right, in every State and Terri? tory in the United States, to make and cn forco contracts, to sue, -be parties, and give evidenco. to inherit, pmchase, lease, sell, hold, and convey real and personal property, and to fall and equal benefits of all Taws and proceedings for the security of person and property, as is enjoyed by white citizens, and shall be subject to like punishment, pains and penalties, and to none other, any law, statute, ordinance, regulation or custom, to the contrary not? withstanding. That any person wno shall knowingly and wil? fully obstruct, hinder or prevent any officer or other person charged with the execution of any warrant or process issned under tho provisions of this Act, or any person or persons lawfully assisting him or them, from arresting any person for whose appre? hension such warrant or process may bave boon iasued, or shall rese?e, or attempt to rescue, such person from the custody of tbe officer, other person or persons, or those lawfully assisting as aforesaid, when so arrested pursuant to the authority herein given and declared, or shall aid, abet or assist any person so arrested as aforesaid, ! directly or indirectly, to escape from the 1 custody of tho officer or other person legally authorized as aforesaid, or shall harbor or conceal any person for whose arrest a warrant or process shall have been issued as aforesaid!, so as to prevent his discovery and arrest, after notico or know? ledge of the fact that a warrant has been issned for tho aoprehonsion of such person shall, for either of said offences, bo subject to a fine not exceeding one thousand del ! lars, and imprisonment not exceeding sb months, by indictment and conviction be fore the District Court of tho United State, j for the district in which said offence ma; have been committed, or before tho propel cqnrt of criminal jurisdiction, if committee I within any one of the organized Territorio of the United States. 8EC. 7. And be it further enacted. Tba tho district attorneys, the marshals, thei deputies and the clerks of the said distric and territorial courts, shall bo paid fo their services tho like fees as may bo allow ed to thom for similar services in ollie cases; and in all cases where the proceed ings are before a commissioner, ho shall h entitled to a feo of ten dollars in full fe his sorviccs in each case, inclusive of a services incident to such arrest and exam nation.
