No stamp duty shall bo required on pow? ers of attorney or any other paper relating to application for bounties, arrearages of nay, or pensions, or to tho receipt thereof from timo to time; or upon tickets or con? tracts of insurance, when limited to injury nf persons while traveling; nor on certifi? cates of tho measurement or weight of animals, wood, coal, or other articles, nor nu deposit notes to mutual insurance com? panies for tho insurance upon which poli? cios subject to stamp duties have boon or are to bo issued; nor on any warrant of attorney accompanying a bond or note, when such bond or note shall have affixed thereto the stamp or stamps denoting the duty required; and whenever any bond or note shall bc secured by a mortgage, but noe stamp duty shall he required to be placed on suck papers; nor on any certifi? cate of thc record of a deed or other in? strument in writing, or of tho acknowledg? ment or proof thereof bj- attesting witnesses; nor to any endorsement of a negotiable instrument. Receipts Ly express companies for the delivery of any property for transportation are exempt from stamp duty. PENALTIES. Penalty for making, signing or issuing any instrument, document or paper of any kind whatsoever, or shall accept, negotiate or pay, or cause to bo accepted, negotiated or paid, any bill of exchange, draft or order, or promissory noto for the payment of money, without thc same being duly stamped, or denoting the duty hereby im? posed thereon, i">0; and the instrument shall bc deemed invalid and of no effect; or lor counterfeiting stamps or dies, $1,UOO, and imprisonment to hard labor not ex? ceeding five years. For making, signing, issuing, accepting or paying any bill of exchange, draft, order or noto without stamp, $200. For selling proprietary cos? metics, matches, meats, fish, fruits, sauces, jollies, Ac, without proper stamps, $50. OTHER 1'BOVISIONS. Instruments arc not to be recorded unless properly stamped. No instrument is invalid for tho want of the particular kinds of stamps designated, provided a legal stamp of equal amount 'except proprietary stamps) duly affixed. All official instruments, documents and papers issued or used by officers of the United States Government or by the officers of any Stato, County or other municipal corporation, are exompt. In cases where an adhesivo stamp shall bo used for denoting any duty imposed by this Act, tho person using or affixing tho same shall write thereon thc initials of his namo and date upon which thc same shall be attachodor used, so that tue same may not again bo used, under a penalty of $50. Instruments heretofore issued without stamps, not to bo void, where stamps are subsequently affixed. Postage st amps can? not bo nseda8 revenue stamps. Any person mav present to the Commis? sioner of Internai Revenue any instrument and requiro bis opinion whether the same is chargeable with any duty, and if tho said Commissioner shall bo of opinion that it is not chargeable with any stamp duty, ho is required to impress on it a partkular stamp, with words to signify that it is not chargeable with stamp duty; and every in? strument on which said stamp is impress? ed shall ko received in evidence in all courts, notwithstanding objections on the ground of such instrument being without thc proper stamp. Tho party to whom a document is issued from a foreign country, or by whom it is tobo used, shall, before using tho same, affix thereon tho stamp or stamps indicat? ing tho duty required.
