THE LE?:- GRAHAM CASE.
Convenient Ignorance of an Inferior
Judge.
Judge Lee'e return to the mle made by
Judge Ggaham a lew dayB ago, restraining
him from Issuing an order of commitment in
tbe McLaughlin case until be should show
cause why a writ of prohibition should not be
Issued, waa made at 10 A. M. yesterday by
Solicitor Whipper. The return sets forth that
Judge Lee Is judge of the Criminal Court,
over which Judge Graham has no Jurisdiction,
and therefore denies the right ot the latter to
interfere in the case. The return was over?
ruled and the writ of prohibition issued,
whereupon Solicitor Whipper gave notice of
his intention to appeal to the Supreme Court.
Judge Graham then announced to the so?
licitor that Judge Lee had rendered himself
liable to attachment for contempt of court,
but as Chief Justice Moses had given an
opinion that Judge Lee's action was attribu?
table to Ignorance, he was willing to over?
look the offence upon that ground.
In the case of Sheriff Mackey, who was like?
wise to have answered to a similar mle, Solici?
tor Whipper, at the suggestion of Mr. G. W.
Dingle, deputy sheriff, Informed the judge that
the sheriff was absent from the city, and
asked that further indulgence be granttxi until
Monday next. The Indulgence was granted,
but Judge Graham declared bis intention to
attach Mackey for contempt of court.
Notwithstanding the decision of Chief Jus?
tice Moses as to the illegality of Judge Lee's
proceeding? Io the McLaughlin case, and
Judge Graham's writ of prohibition, Judge
Lee issued another order on Wednesday after?
noon requiring McLaughlin to produce
' certain county checks in bis possession.
McLaughlin being absent from the city the
order could not be served
The Criminal Court
Was opened by Judge I ee at nine A. M.
yesterday.
A nol. pros, was entered in the case of J. P.
Horbach, charged with conducting a lottery.
H. T. Peters, Fenn Peck and James Gllllland,
Indicted for keeping and abetting a lottery,
were ordered to enter a recognizance of one
thousand dollars each for their appearance at
the October term of the court.
Jerry Coleman, couvloted of assault and
battery, was granted a new trial.
The following sentences were passed:
Shradrach Smith, assault and battery, ten
dollars flue and cost of court, or thirty dayB
1 n Jail.
Edward Bay, assault and battery, sixty days
in Jail.
E. F. Benedict, doing business without a
license, ten dollars and cost of court.
F. P. Chap?ala and J. T. Heffron, doing bu?
siness without a license, thirty dollars and
costs of court.
G. Arnett, doing business without a license,
ten dollars and costs of court.
I. W. Kayne, doing business without a ll
cense, twenty dollars and costs of court.
R. Graham and F. F. Chapeau, doing busi?
ness without .a license, two hundred and
twenty dollars and costs of court.
8. Elvers, convicted of doing business with
out a..license, being absent from court, no
sentence waa passed In his case.
The court then adjourned until ten A. M.

CRUMBS.-The steamship Sea Gall, Captain
Hunter, sails for Philadelphia, this afternoon,
ot five o'clock.
A small colored boy was painfully bitten In
tbe cheet by a dog on the battery, yesterday.
The dog belonged to Joe Magill, a colored
nra.
CLUBS .uro STABS.-John Heffron, an escap?
ed prisoner from the House of Correction, re?
captured and lodged in the upper Guardhouse
on Wednesday afternoon, was returned for
thirty days.
William Simons, a colored husband of irri?
table temper, beat his better-half, and thereby
raised a disturbance In Ainley street on Wed?
nesday. He was fined one dollar and made
to five a peace bond of one hundred dollars.
John Brown, colored, stole a number of
pieces of railroad Iron from the South Carolina
Railroad Company. He was turned over to a
trial Justice.
Andrew Rafferty, found lying down drunk
lo State street, near Broad, was carried to the
main Guardhouse. Penalty, one dollar.
John Hardgrave found some difficulty in
avoiding a door step lo Broad street, and cat
down thereon. As his stay seemed likely to
be prolonged indefinitely, Clubs and Stars
came to his assistance. He paid one dollar for
his night's lodging.
John O'Neill kicked up a "general row lu
Beaufaln street, abused the police and pum?
melled one of his fair companions." He was
turned over to Trial Justice O. R. Levy for a
hearing. # .
William Swinton, for being disorderly in
State street, and Interfering with Clubs and
Stars In the discharge of duty, was sentenced
to pay two dollars or spend twenty dayB in the
House of Correction.
One cow found at large In Cannon street,
and four -lu Market street, were fined one
dollar each, and returned to their owners

TUB CHOPS.-There were heavy showers during
i part of this period reported In the interior of
the State, which, In some cases, had cn unfavor?
able act inn, and complaints of too much rain are
frequent, with reports or injury to the plant m
consequence. These statements, and Indications
of the appearance of the worm, causes anxiety,
?nd lt la feared that this destructive insect wUl
somewhat later come forth in numbers, as
showery weather la promotive of their In?
crease. The cotton crop is now at a very
critical time of its growth, and propitious c'ori
iJ I tiona ars necessary to a good yield. The week
m this vicinity closed dry, with full summer heat.
The first bale of new cotton from" the Interior of
Texas was received at Galveston on the 16th Inst.
THE RECEIPTS. - The arrivals at the cotton
ports for the week up to Friday last, were 3267
bales against 4673 bales thc week before, and
16,886 bales for the contrasting time of the year
previous. At New Orleans the supplies were 470
ba es against 6900 for the week lara year. The
total receipts at the cotton ports from September
li 1871, up to the latest dates were 2,697,603
bales, la contrast with 3,941,771 bales the previ
