THE VIRGINIA TO SAIL FRIDAY.-This popu?
lar iron steamship, captain Hunter, win sall for
Philadelphia on Friday, at 12 o'clock, and affords
usual weekly facilities to that port, and also to
Boston.
ANNIVERSARY MEETIVG.-The one hundred
and ninth anniversary .or.the Society ir the relief
of the widowsand orphans of the clergy of the
Protestant Episcopal Church m the State of Sooth
Carolina, occurs to-day. The annual meeting
will bje held at-1 o'clock, at the Mansion Bouse,
m Broad street.
CLUBS ANB STARS.-A single case was pre?
sented for the decision of the Mayor, yesterday
morning, m the shape of a man who was locked
np? charged with being drunk and disorderly on
the streets. The prisoner had an unpardonable
accent, and r u sentenced quickly to pay a fine
of five dollars, or spend ten days tn the House of
Correction.
BACK TO JAIL.-Joe White, Sam Robinson,
* Henry Williams and Alexander Warit-j, the col?
ored juveniles arrested for stealing cotton on the
wharves, were brought before Trial Justice Ma?
grath yesterday morning, for examination. Their
confession was sufficient evidence co establish
their guilt, and three of the young ?agabonds
were sent to JaU for thirty days. Sam ?lobins?n
proved a previous good character, and upon giv?
ing sureties for his good behavior was discharged
from custody.
THE CLUBBED MAN.-John Lewis, the young
man who was BO brutally clubbed by the police
on Saturday night, at the corner of America and
Re a streets, rallied a little yesterday, and hopes
are now entertained of his final recovery. On the
data after the occurrence Policeman Bryan, col?
orea, one of the two who arrested Lewis, was
reported ai the guardhouse for oslng unnecessary
violence to the prisoner, and weare Informed
that the case will be Investigated as soon as the
wonnded man appears. The other policeman,
McNamara, has been reported for belog absent
from his post and diunk en the nig ht of the beat?
ing. Steps have been taken to bring the matter
to a proper Investigation, before a trial justice.
Lewi^ls a slim, weak-looking youth, and without
resorting to the brutal treatment he received,
either of the two policemen coull easily 'jave
taken him to the Guardhouse.
A CHARLESTON BUILT TCO.-A neat-looking
little craft, named the "Bull River," and built for
the Marine and River Phosphate Mining and Man?
ufacturing Company, was launched on Monday,
and made several trial trips upon the Cooper
River to the general satisfaction of the bonders
and owners, she is strongly made like ail togs,
and ls intended to be used by the company lu
towing their dredges and heavy flats to and from
the varions mines of phosphates on Bull River.
The hull was buUt by S. Pregnall, ship carpenter,
in this city, near Robb's Mill, and ber engines and
machinery were designed and built at the exten?
sive shops of the Phoenix Iron Works, Messrs.
J. F. Taylor A Co., on the north side of Pritchard
street. The engines are powerful for the size of
the boar, and drive her through the water
with great velocity. The tog is aoout forty
feet long, add will con m all about thirty-five
hundred dollars. She promises to be most effect?
ive in the work she was designed for, and will
be dispatched to Bull River In a few days.

LIABILITY OF CARRIERS OF FREIGHT
Shipping Goods on Deck-Important
Case.
An action was brought a few days ago before
Trial Justice Mlnott by A. C. Leavitt, master of j
the schooner Henrietta, plaintiff against Holmes |
A Calder, defendants, for freight on certain goods
shipped on the dtck of plaintiff's vessel from
Philadelphia to the defendants in Charleston. The
plaintiff received the goods in gnod condlthn, as
shown by the oin of lading, which contained, as
usual, the clause exempting common carriers
from liability for damage sustained by goods
shipped on deck from breakage, 4 c. The Hen?
rietta arrived In Charleston In good condition,
and was roano by the portwardens to have had
her t argo properly stored and dnnnaged. Two
barr Ms, among a number or others, were found
on dick, from one of which some twenty-four
gallons and from the other about two gallons of j
oil had leaked.
Upon these facts the plaintiff based his Cairn
for freight on the entire quantity of oil shipped
on deck, without allowing, by way of set off, the
value of that lost by leakage. The defendants
set up the value of the oil lott by way of set off
against the claim for freight, and argued that the
plaintiff was responsible for the damage thus
sustained.
The Hon. C. H. Simonton appeared as counsel
for the defendants, and the Hon. M. P. O'Connor
for the plaintiff, and no Issue of facts being le?
vo ved, the counsel confined the'r argument
let. As to the extent of the liability of ship?
owners or masters for damage sustained by
goods shipped on deck, and
2d. As to the validity of exceptions of risks or
liabilities made In bills of lading In favor of such
\ persons as common carriers.
Arter hearing the argument in the case, Justice
Mlnott decided
let. That the plaintiff, SB a common carrier and
by the terms or his contract, as set forth in the
bill of lading, was bound to deliver the goods in
the same good cosdi?op that he received them,
and ls therefore liable for all damage sustained
by them while under his charge, except such as
results from the act of God, a common enemy, or
from fraud on the part or the c nslgnees, or from
! Inherent weakness of ihe packages in which the
goods are shipped. That no legal or sufficient
evidence having been introduced to show that the
damages resulted from any or the causes above
cited, the law presumes that they resulted from
the negligence of the common carrier, and he ls
therefore liable to th. . x ten: of the loss sa stained.
That in attempting to establish the fact that the
damage alleged resulte J from causes other than
those for which the common carrier ls held liable
at common law, the onus probandi rests npon
the common carrier, and that the plaintiff in this
case has failed to rebnt the presnmptlon of law
thus raised against him.
2d. That exceptions of any risks or liabilities tn
bills of lading or other commercial paper are not
valid or binding In law where they tend to
exempt the carrier from his common law dabin
ties, .and that such ts the tendency of the excep?
tion in this case.
Decree for the plaintiff for the amount of freight
claimed, less the value of the oil lost by leakage.
Costs to be paid by the defendants.
RECOVERED.-The trunk stolen from the
steam tug Relief, by John Lawrence, colored, was
recovered yesterday by Officers Borke and Davis.
The trank was the property of captain R. Sass ard
and bas been returned ti the owner. The con?
tents were all right with the exception of a few
pieces of underclot hing.
THE BLACK MAILING AT CASTLE GARDEN.
Mr. Reenttjerna, whom the Castle Garden offi?
cials m New Tork lately tried to impose upon, ex?
plains to os that their refusal was either to allow
an express wagon, which he had engaged, to
enter the enclosure, cr to allow his baggage to be
carried to the entrance. Their object was to force {
Lim to employ their own wagon, at their own
price._
THE "PROTEST."-Nothing cf any importance
has transpired concerning this matter since the
service of the writ of mandamus upon t ie Alder?
men In the city, and the parties seem to be
awaiting the issue of to-day, when the Connell
have been directed by the jnandamus to meet
and entertain the protest. The prospects of a
quorum to-day seems still uncertain.
Yesterday Major G. L. Buist, chairman of the
Executive Committee or the citizens, and Alder?
man V ?gt, called upon Mayor Pillsbury and
asked for a copy of the protest, or to be allowed
to see the same. The Mayor, arter some hesita?
tion, declined to accede to this request un ti: he
could have an opportunity of consulting his
Council. _
THE .ETNAS PREPARE FOR THE VISITORS.
An extra meering of the .?Etna Steam Fire Com?
pany was held last evening, at which a commu?
nication was considered from Chief Nathan and
AsBtBtantBAlexander, Almar and O'Neil), requeu?
ing the co operation of the officers and members
of the iEtna, In the reception of the Washington
Fire Company, of Wilmington, Delaware, on the
nth of next montb. The above-mentioned gen?
tlemen were appointed a committee at a meeting
of the President's of the Steam Fire Companies,
to make arrangements la which the whole or the
Steam Fire Department will participate. The ne?
cessary committees were appointed by the Jttnas,
and every step taken to maintain the well known
courtesy of this spirited company la the reception
ot the visitors._
THE OUTRAGE IN BEAUFORT COUNTY, of
which three citizens of Savannah were the vic
tims, seems to have been lesB serious in Its re
snits than at first reported. A detachment of
Cnited States soldiers repaired to the scene of the
affair on Monday, and learned that Mr. DeMont
mollln and party had been arrested by a posse
and taken to Blanton, upon warrants issued by
the negro magistra.e having jurisdiction in that
district. Aftt r becoming satisfied that none of
the party were killed, the military and civilians
both returned to that city. An "Intelligent con?
traband" reports having met the posse on the
road to Blanton, that Mr. DeMontmollln was bot
Blight y wounded in the thigh, Mr. Kent in the
wrist. Mr. Slayer being the only one anyways bad?
ly hurt, and that all three were riding In buggies.
