Thc Taxation or Real and Personal Property. The reform of taxation may proceed in two directions. Either the principle at present prevailing of taring directly all property, real and personal, may be retain? ed, and reform be applied to the metcods of enforcing the principle, or the principle itself may be abandoned, and a new system sub? stituted. If the first course be pursued, there is room for improvement in the detai 3 of ad . ministration in most of the States. ID the first place the valuation of real estate may be made mach more correct. This is best to be effected by the creation of some certain authority, either a single commissioner of taxation, as in Massachusetts, or a board of commissioners as permanent and removed j from partisan influences as far as possible, and armed with authority to enforce revalu? ations in proper cases, and to prosecute assessors derelict in their duties- Experience has r,hown that there i3 no practical difficulty in assessing real property at its proper value, which for taxation should be its "fair value" on a sale on the usual terms. In Providence, R. I., a registry of all sales, witt* the true consideration, is made obligatory, and this registry affects the market value of property there. In Philadelphia, the appointment of a commission, such as is above recommend? ed, resulted in trebling the valuation of real estate in one year. In respect to personal property, the cir? cumstances are entirely different from those which obtain in the ca3e of real property. Much of the former is invisible and incorpo? real, easy of transfer and concealment, not admitting of comparison with any common standard. The assessment lists are, from obvious reasons, constantly changing. Pub? lic opinion again does not sanction the en? forcement of the tax against small owners of this species of property. Tbe uniform experience of maukind goe3 to show that oaths are comparatively worthless instru- ' menta of forcing disclosures of the personal property held by?individuals, so much so' that mach of the commercial immorality of the' country may fairly be attributed to the habit engendered by the general disregard of oaths iu matters of taxatioo. These are then the iuhereut difficulties of the subject. The oaly practical suggestions to be made, if this system of taxing all personal prop? erty directly mast be retained, and none are ? to escapb their share of the burden, are to , make the law more stringent, severe and I mandatory, to invest assessors with greater, 1 almo3t arbitrary powers to inquire, fina, or otherwise punish, (in ancient Rome they , might put to the torture;) and a central au- i tbority must be appointed to enforce from ? the assessors the performance of their duties. 1 In Massachusetts -and Connecticut, as in | South Carolina, the, taxpayer is obliged to do , what is called in the dialect of those States, i "listing his property," i. e., to make a sworn ? return of the amount of it. This provision 1 has not been universally adopted in the laws Of other Stales. . , t Brit if the principle of taxing all personal i property is to be carried out, difficulties be- l side tho3e already mentioned will be met at 1 every step. What, in the first place, is lo 1 be done as regards the debts due by the lax- , payers? In Massachusetts he is not allowed t to set it off against his property returned, I and in Connecticut only to a limited extent. 1 In the former State a merchant is toxod on ' the average of l :s stock of goods during , the precedios; year. Say that hellas a ca pi- < tal of $100.T0, and goods bought on credit to the amo. ." of $500,000, if we assume . the rate to be 2.27 be would be paying al the rale of over eleven per centum on bis capital. No trade could live under such a burden. But if the right io offset indebted? ness is allowed, so wide a door to fraud is opened that immense parts of the taxable capital of the State evades taxation alto? gether. As, for instance, a person with a capital of $100,000 buys United States bonds . to that amount, then borrows a ?ike amount on the pledge of the bonds. He returns $100,000 of capital and an offset of a like ' amount of debt, and escapes taxes alto? gether. Again, large sums evade taxation through the exemption granted to Savings' Banks. In 18G9, abad business year, the increase of their deposits, in New York, was $40,000,000, and in Massachusetts $24 000, 000. lu carrying out the principle uf levy? ing a direct tax on all personal properly the statesman has, tot?, to meet trie difficult question, whether or not mortgages are to be taxed. It seems but fair lo d;> so, and yet the result of doing so has alway? proven dis? astrous. How is he lo deal with the exemp? tion from luxation, under the Constitution, of imported goods? Is tangible personal property, belonging to a citizen of a Slate, to be taxed though actually situated in another State ? Where are chokes in action, as notes, bonds, ?fcc, to be taxed, where they are owned, where they are owed, or where they are actually existeni? The law books are full of conflicting decisions on the point. What, also, is the authority or policy of a State io respect to goods /* transitu ? These numerous, remediless difficulties, which gather around the principle of direct taxation of personal property, have led to its very general abaudootiie.'il in oilier coun? tries. What Mr. Wells has to say aoout the system which has been substituted for it consulates the most interesting pun of bis report. Special Notices. "'pS^A^TJ^ER^S^S^m^MEMORY of tbe late Rev. J. H.
