Thc Taxation or Real and Personal
Property.
The reform of taxation may proceed in
two directions. Either the principle at
present prevailing of taring directly all
property, real and personal, may be retain?
ed, and reform be applied to the metcods of
enforcing the principle, or the principle itself
may be abandoned, and a new system sub?
stituted.
If the first course be pursued, there is
room for improvement in the detai 3 of ad
. ministration in most of the States. ID the
first place the valuation of real estate may
be made mach more correct. This is best to
be effected by the creation of some certain
authority, either a single commissioner of
taxation, as in Massachusetts, or a board of
commissioners as permanent and removed j
from partisan influences as far as possible,
and armed with authority to enforce revalu?
ations in proper cases, and to prosecute
assessors derelict in their duties- Experience
has r,hown that there i3 no practical difficulty
in assessing real property at its proper value,
which for taxation should be its "fair value"
on a sale on the usual terms. In Providence,
R. I., a registry of all sales, witt* the true
consideration, is made obligatory, and this
registry affects the market value of property
there. In Philadelphia, the appointment of
a commission, such as is above recommend?
ed, resulted in trebling the valuation of real
estate in one year.
In respect to personal property, the cir?
cumstances are entirely different from those
which obtain in the ca3e of real property.
Much of the former is invisible and incorpo?
real, easy of transfer and concealment, not
admitting of comparison with any common
standard. The assessment lists are, from
obvious reasons, constantly changing. Pub?
lic opinion again does not sanction the en?
forcement of the tax against small owners
of this species of property. Tbe uniform
experience of maukind goe3 to show that
oaths are comparatively worthless instru- '
menta of forcing disclosures of the personal
property held by?individuals, so much so'
that mach of the commercial immorality of
the' country may fairly be attributed to the
habit engendered by the general disregard of
oaths iu matters of taxatioo. These are
then the iuhereut difficulties of the subject.
The oaly practical suggestions to be made,
if this system of taxing all personal prop?
erty directly mast be retained, and none are ?
to escapb their share of the burden, are to ,
make the law more stringent, severe and I
mandatory, to invest assessors with greater, 1
almo3t arbitrary powers to inquire, fina, or
otherwise punish, (in ancient Rome they ,
might put to the torture;) and a central au- i
tbority must be appointed to enforce from ?
the assessors the performance of their duties. 1
In Massachusetts -and Connecticut, as in |
South Carolina, the,taxpayer is obliged to do ,
what is called in the dialect of those States, i
"listing his property," i. e., to make a sworn ?

they are owned, where they are owed, or
where they are actually existeni? The law
books are full of conflicting decisions on the
point. What, also, is the authority or policy
of a State io respect to goods /* transitu ?
These numerous, remediless difficulties,
which gather around the principle of direct
taxation of personal property, have led to
its very general abaudootiie.'il in oilier coun?
