Sectios s ol the "Act to proVdc rer the asscsF

The petitioners claim that the tax paid under
the net or September, 180$, aud Hint paid under
Henel al Orders 139, arc upon the same articles,
ami that therefore they have been double taxed,
la making this claim they overlook, In my judg?
ment, a very evident distinction; tito lax paid
under General (miers 130 was upon thc value ol
their sales; while that paid under thc uctofisei
was tipou the average value or the stock after-de?
ducting Hit sale.
It docs not appear that the petitioners have
be.-n. iu a legal sense of thc term, "double taxed."
nie military government or the State round ll

and because it was thought those tutcrests were
best able to bear tt, as well as ror the convenience
or collecting ll, a special quarterly tax was laid
upon merchants' sales, railroad companies, and
express mid telegraphic companies, lu my
opinion, there can lie no doubt us lo the right ol
the government to collect that tax which was Iniil
ror thc llscal year 1807, or that thc present gov?

ott thc same business tor thc liscsl year 18SS
That the tax to wkich the merchants have been
