Thc Supreme Court to-day heard thc Grape
shot case from New Orleans. The COBC Involves
the question of Ute constitutionality of Lincoln's
provisional courts In thc subjugated portions of
thc country, lt was contended that such courts
being Invalid, thc subsequent action of Congress
cannot give validity to thejr decrees.
There was a Cabinet meeting to-day, at which
were present all but Fish, Robcsou and Cress
well.
The two wings or tho tarin lobby promise to be
unusually strong this session.

It ls stated that Morton, Buller and Bingham

gold, lead, mica, gypsum, Iron, coffee, slate, gran
ite, Ac Kx-Govcrnor Bigler, of Pennsylvania, is
among thc visitors, and the Hon. Horace Capron,
tho United States Commissioner of Agriculture,

offices, schools and banks In thc city will bc
closed, and Ibo citizens generally will adjourn to

EFFORTS TO^ESCATE.

dled together on thc forecastle, n, P. Watson tho
carpenter of thc boat, endeavored to get some
or them to assist him In putting tho stage plank
overboard, lt-would have floated, lt was believed,
one hundred persons to the laud, but thc passen
gera were smirk helpless by thc prospect or thc
horrible fate staring them In tho face, and failed
to launch thu plank. Fifteen feet of ll ivas push
ed over thc side. About twenty persons got on
ll, some were pushed oil', mid about sixteen mair
aged to cling to it until they were taken on* In v
skin* which was sent from thc shore. Fulton, tin
engineer, stayed at lils post until bc was driven

Ile started to swim towards the land, but found
thc mules so numerous tn thc water that ho
could make no progress, and so swam Into thc
wheel-house. He clung here in fancied security
until thc lines holding thc levers burned mr and
the wheel commenced to revolve. It made three
revolutions, and he was caught by lt and con
siderably bruised.

sengers from the burning wreck, lt inndc seve
ral trips from thc boat to tho laud, besides tic
ing thc means or iseape for those on thc stage
plank, lt was used to take Fulton from lils peril
Ions position. He was tho last brought away; af
ter that no one escaped from thc boat. It was
feared that some, hemmed In by thc Hames, were
burned to death, ami ! um.., had it that some met
with such a dreadful fate In the cabin. How
ninny, will never bo known, lt cnn only he
hoped that they all succeeded In Jumping Into thc
river and got to shore. The coal oil-fortunately
not a large quantity-and thc bacon burned very
fiercely. Thc Stonewall wns burned to the wa
ter's edge tn about one hour and a half after tho
fire was discovered. Hut long before this there
wan no living soul lu it.
A TEHP.IDLE SCENE.
Tho scone was a terrible one-ono never to bo
forgotten by thc survivors. The lamen tat ions,
groans and shrieks or dying men and women,
mingled with thc noise of thc cracking timbers,
and, to Intensify thc horror of the moment, burn
ing spars, fenders mid beams, fell over Into thc
water, where nearly two hundred human beings
were trying to save themselves from tho jaws of
death.
Atn FROM TOE SHORE.
There were numbers of pcoplo on thc shore
who hud Hocked from thc houses In thc neighbor
hood of thc landing, but they wera unable to
give any assistance except what a few could
render with-the tiny ekiir before meal toned.
They saw many an unfortunate passenger taking
his Inst leap, and, aa some who had managed to
get hold or a spar or piece of timber drifted from
the wreck, they eagerly sought to give a helping
hand to some poor fellow as he neared the shore.
The people did all they possibly could to mitigate
tho horrors or tho night, and at dur rent points
of thc river, for a mlle below, assisted persons to
get on shore. Tho number so saved, lt ls regret
ted, was but small.

lt. A. Phelps, Ksti., of Shreveport, La., states
that there were a largo mun her or laborers aboard
os deck passengers, who wero en youle to labor
on a Som hem railroad. When Mr. Phelps il rsi
heard the alarm and saw tho indications ol fire,
lt was In thc rear of thc lodles' cabin. He ran up
to thc Texas and communicated thc alarm to cap
tain J. C. Duty, or lttipldes Parish, Louisiana, and
.when he returned immediately to the cabin thc
Hames hud mado fearful headway, and the ex
citement amt confusion was unparalleled. Ile at
once threw orr his coat and boots, put on a lire
preserver and leaned into the rlvcrTfom the boil
er deck. At this tl ne tho boat, bc thinks, v,as not
more tiian two hundred yards from tho Missouri
shore, and when ho jumped over his feet touched

shore more dead than alive. An old farmer, who
among others had been attracted there by thc
light from tho burning boat, pulled orf lils cont

He feels assn rod that Captain Holy was lost, also
a North Missouri railroad conductor named black
burn. A Mrs. Gregg, of Louisiana, on her return
from a visit to a sister In St. Louts, was likewise
lost, as wero two other lady passengers that were
aboard. There won a bm band, wife and their
two small children, who woro dock passengers,
that were nlso lost.
PURTIIER PROM TUB DISASTER.
The SL boals Republican of tho .101 h ult. has a
dispatch from Captain Taylor, ono or thc com
mittee that left here last night for tho wreck of
the steamer Stonewall, lately burned In tho Mis
sissippi, which states that no bodies were found
to-day. Three were burled yesterday, names un
known. Several persons were picked np below
hero yesterday alive, but their names are not as
certained. The wreck was still haming. Tho
freight In the hold Is uninjured, but being stolon
rapidly. If tho board of underwriters had sent a
tug down $60,000 worth of propcrtv would have
boen saved. Tho safo of tho boat hoi been taken
out. and ls now in tho keening of Henderson, a
justice of the peace.

peaceable life, trying lo provide for my family in
un honest though humble sphere of life. lu the

pieces lu such a shocking milliner that thc most
barbarous savage would have blushed to have
been gtilllv or the deed. His body was then
thrown inti) a mineral hole ill ty reel deep, and left
lo rot.

Thc next outrugc committed on my kindred
and family was thu murder of my brother, licurgo
Wasp I tig i on, and a Canadian named Hus! ache
Laudusky, who was engaged to be married to my
Bister Mary, "these last murders were perpetrat
ed by men In Union uniform, and who were sol
diers iii the Federal army. Two weeks after these
tragedies my sister Mary died of trouble und a
bretton heart.

erty, drove off all our cattle and set fire lu her
house, the best stone dwelling In thc settlement.

Not dreaming of harm to thc little tender boy,
what can express her horror and agony when
these demons shot my little brother, not twelve
years old, through Hie bowels, and a fiend theil

were these atrocious leeds ot blood and cruelty
and robbery committed on my kindred and fam
ily. Let any niau put thc question to his soul,
whether such outrages would not havo aroused
him to desperate retaliation, nt a Hmo when thc
law no longer hail power to avenge a man's
wrongs for him mid for thc sake or Justice ! And
yet, even then, 1 liorc these accumulated outrages
without lining a hand to avenge my brothers'and
sister's blood.

go in thc Southern urmy, nor to meddle In thc

to Flat Woods", distant twenty-live miles, hoping

neighborhood ot those who hud murdered aud
outraged my family.

men, all well armed.

their capture, and I knew there was no hope of
mercy or Justice from such demons; no help ex

given me.

I met my pursuers at the door. I shot own

woods, and escaped. Finding lt Impossible to live
at OP near home, 1 went to Arkansas, and after
ward got my wire and four children. The two
men killed lu my door was thc first blood ever
shed by mc. Then, when a price was set on my
head, l determined to revenge tho death of my
brothers. 1 rode several times from Arkansas
bern re I could get to shoot McElvanc, thc Infa
mous butcher, who had murdered my brothers
and sought my lire. Then I meant to hann no
one else IT they would leave mc undisturbed; but
some of the soldiers, piloted by Jim Craig, a very
meddlesome spy, undertook to have me killed.
In self-defence 1 turned loose on them and
mude many of those who sought my lifo bite thc
dust. I orien met them lu tho woods. They ntl
knew me, and would oifer to assist me. They
would make un appointment to bring mc provi
sions to my hiding places, aud then would pilot
soldiers thereto try to have mc raptured. I al
ways killed that kind or men. I havo cammed
many Union soldiers, but I never treated theni
unkindly unless il was one who lind brutally
treated Southern pilsoucrs, and 1 kuew lt.

way County lu my lire. It also charges mc with
cruelty to a lillie boy. That ls also tulse. 1 never
harmed a woman or child In my life. I warred
only with men who had made war on me. I was
also accused of taking stock or Jim Mcbain to
thc amount of seoo. Thc neighbors nil know
that Jim Mcbain always lived from hand to
mouth, and never had any Hiing lo be stolen or
taken from him.

heal over past sores, tn tho spring of 1808, I caine
back to St. Francois County ami talked lo many
of thc good people ot thc county concerning tho
propriety or returning to my old home. AU I

I came back tn good faith. I moved to my mo
ther's old placo and lived there six months. 1
then moved to Hillsboro1 and stayed there until
last fall. Finding lt hard to make a living thcre.l
moved on tho Mississippi River, nenr Rush Tower,
and chopped wood nil last winter. I then moved
back to tho Three Rivers, on tho Sam Herd place,
tn raise a crop. There I lived and worked until
thc 4lh or June last, when I was waylaid and shot
