the watchman at the mill. A search, resulted In

leg and hip. The ?bot lodged In his hip was drawn
out'wlth' a piece or his shirt; which bad -been
driven la the wouad made by the missile. The
other shot had not been extracted pp. to Sunday
night Too wounds are regarded OS serious,
though not necessarily .fatal. The party who nred
upon Powell had made good his escape when as
sistance reached him, so that it la not positively
stated who commute! the deed, except by Pow
ell, who claims to be able to Identify the person.'

The action was" brought by the Harbormaster,
O. B..8toddard, against Captain, Van/ Gelder,?br
the schooner D. V. Streaker, for tonnage duties
under the ordinance of lftll. The defence reUed
.noon the loth section 1st article or the eonsfl
tutlon, which forbids any Sta.e without the
consent of congress from laying any dnty on
tonnage. The plaintiff contended that auch con
sent bad been given. - The case was elaborately
argued, and tbe magistrate reserved his decision.
Alderman T. J. Mackey appeared for the Bar
bdrmaater. Messrs. Slmonton 4 Barker repre
sented the vessel. 1 ' "
During the trial Mr. Thomas, Olty Treasnrer,
testified that tho amount resolved by the city
fronveonnage duties averaged three hundred and
fifty dollars per month. We. have no doubt that
tho case will rle carried to. the highest court.

good-bye, Baying that If any one bought him
(Hunter) for a fool they woundn't sell him as such.

Uar with the recent nil ventures of w. I?. West
lake and J. Bergman, who swindled the mer
chants of Savannah, came bore and attempted
the samo game, were arrested and discharged
upon a writ of habeas corpus, handed their
counsel a package of mouey marked $60, which
contained only $37, then fled to Wilmington,
where they wore again arrested, and again
sued out a writ of habeas corpus, bat did not
get off upon It, and gave tholr counsel
a gold watch, so-called, but which was braaa.
The Judge beforo whom the writ was returned
in Wilmington ordered thorn to bo held for four
teen days, In order to give the deputy sheriff of
Savannah, Mr. George s. Hurt helm ess, time to
get a requisition from Governor Bollock, or Geor
gia, upon Governor Holden, of North Carolina.
Mr. Barthelmeas Immediately went to Atlanta,
procured the requisition, and started for Raleigh,
telegraphing to Lieutenant Phlllppy, or the
Charleston detective force, to Join him at Wil
mington, which he did. Night before last Mr.
BarthelmcsB returnud from Raleigh to Wilming
ton, met Lieutenant Phlllppy, and made arrongo
mentB for leaving on the evening train.
The sheriff of Wilmington promised to send the
prison era to the depot. They were started from
the Jail about dark, both In charge or two police
men. One or them, Westlake, when at the cor
ner of Mulberry and Front streets, broke away
from the guard and ran for dear life. Seeing
that he was abont to succeed In making his
escape, one of the officers, Nash, a negro, fired at
him with a pistol, striking him In the back, bat
not hurting him vcfv badly. Ho was thereupon
secured and, with his companion, delivered to
the officers waiting at the depot. These- officer?
seeing that the wounded man was not much hurt,
and rearing that IT they remained muoh longor
they would loao thelt prisoners, determined to
come straight along, watch they did, and arrived
here yesterday afternoon.
Woatlake, who was quite weak from the effects
of his wound, was, with Bergman, carried Into
the detective office and Dr. J. Bornera Bulst sent
for. He came in a fewnv monta a?-rowed tho
wound.. He found that the bap, a 1 '. |>ao, had
entered the right side and glanced alferrg the ribs,
and remained In tho flesh. He advised that It he
allowed to remain, to which Westtakt, who didn't
fancy the probing, agreed.
About 6 o'clock last night the prisoners were
placed aboard or the steamer Dictator, for Sa
vannah, In charge or Mr. Dartholmess and offlcor
[ TruaU.
Both prisoners take their arrest very coolly,
especlaUy Bergman. Both expressed tho opinion
that.they were on the road to the State hotel at
I Millejgeviue, Georgia; that ir tho officers had al
lowed them to remain In Wilmington twelve
hours longer, they would have gotten off under a
writ of habeas corpus, as--everything was ar
ranged for It. Bergman saya that ho was very
I much surprised when Westlake was shot; that he
cursed the negro policeman, which made tho
negro mob that had collected 'very mad, and
they-wanted to mob him; that be wouldn't have
minded Westlake's being shot so much "If It
