Railroad Accioent.?Yesterday thonorthward
bound express train of the Northeastern Railroad
ran off the track a few miles above the city, by
which the express car and a freight car were
smashed. No one was Injured.. Tola train and
the down train also were delayed several hours.

nightly hove the effect of making our snug little
Theatre, at Hibernian Holl, a more popular resort
than hitherto. The bin for to-night comprises the
dramatic version of Mrs. Southworth's famous
story, "The Hidden Hand," and the laughable
afterpiece called, "A Conjugal Lesson." The con

Man Shot at Kalmia.?The Angnata Constitu
tionalist, of yesterday, suya : "We learn that
Freeman, otherwl.-? 'Spunk' Powell, .was shot
In tho vicinity of Foster' --mis, at Kalmia,. s..c,
on Saturday night. Oar- Information is that, two
reports of a shot-gun -viWe- heard,after witch
groans were heard issuing from the bushes! in the
neighborhood, which attracted the attention oi
the watchman at the mill. A search resulted in
the discovery of Powell, with six buckshot In his 1
leg and hip. The shot lodged in his hip was drawn
out with a piece of his shirt, which had been
driven In the wound made by the mlaalle. The
other shot had hot been extracted pp to Sunday
night. The wounds are regarded" as serious,
though not necessarily fatal. The party who tired
upon Powell had made good his escape when as
sistance reached him, so that It la not positively
slated who commltte l the deed, except by Pow
ell, who claims to be able to Identify the person."
Crumbs.? The old engine house in rear of the
Guardhouse Is being repaired and fitted up for an
office, for the Inspector General of Timber and
Lumber.
The one hundred and seventh anniversary of I
the Society for the Relief of the Widows and Or-j
phans of tho Clergy of the Protestant Episcopal
Church in Booth Carolina, will bo held at the
Mansion House, atl o'clock to-day.
There was no meeting of Council last night

during hta absence by Mr. E. P. Butts, Deputy
United States Marshal.
Thomas Rodney was caught while attempting
a burglary night before last.
W. H. Millar, who strayed from the Almshouse
a few days ngo, wos fouud yesterday and return
ed to his old quarters.
The flues imposed by the Mayor yesterday,
amounted to two dollars.
Harbormaster's Fees.?A case of Importance
to that portion of our Community who aro In-,
torcsted In shipping was tried yesterday before
Magistrate J. O. Maokey.
The action was brought by the Harbormaster,
O. B..8toddard, against Captain Vau Gelder, 'or
the schooner D. V. Streaker, for tonnage dutlea
undor the ordinance of 1841. The dcrenco relied
.upon the 10th section lat article of the consti
tution, which .forbids any Stn.n without the
consent or congress from laying any duty on
tonnage. The plaintiff contended that auch con
sent had been given. The caso was elaborately
argued, and the maglstrata reserved his decision.
Alderman T. J. Mackny appeared for tho Har
bormaster. Messrs. Slmonton A barker repre
sented the vessel.

testified that the amount received by the city
from tonnage duties averaged three hundred and
fifty dollars per month. We. have no doubt that
tho case will lie carried ta the highest court.

terday. Officer Nlpson carried htm to the vessel,

good-bye, saying that If any one bought him
(Hunter) for a fool they woundn't sell hint as such.

liar with the recent adventures of W. D. West
lake and J. Bergman, who swindled the mer
chants of Savannah, came here and attempted
the samo game, were arrested and discharged
upon a writ or habeas corpus, handed their
counsel a package or monoy marked (50, which
contain:'d only fCT, then fled to WUmlngton,
where they were again arrosted, and again
sued ont a writ of habeas corpus, but did not
gel off upon It, and gave tholr counsel
a gold watch, so-called, but which was brass.
The Judge before whom the writ was returned
In Wilmington ordered thorn to bo held for four
teen days, in order to glvo tho deputy sheriff or
Savannah, Mr. George S. Bartbclmoss, time to
get a requisition rrom Governor Bollock, or Geor
gia, upon Governor Holden, or North Carolina.
Mr. Burthclmcss immediately went to A'lanta,
procured tho requisition, and started for Raleigh,
telegraphing to Lieutenant I -Hippy, or the
Charleston detective force, to Join him at Wil
mington, which he did. Night before last Mr.
Barthclmcsa returned rrom Raleigh to Wilming
ton, met Lieutenant Philtppy, and made errango
ments Tor leaving on tho evening train.
The sheriff or Wilmington promised tosend the
prisoners to the depot. They were started rrom
the jail about dark, both In charge or two police
men, one of them, Westlakc, when at the cor
ner of Mulberry and Front streets, broke away
rrom the guard and ran for dear life. Seeing
that ho was about to succeed In making Ills
escape, one of the officers, Nash, a negro, fired at
him with a pistol, striking him in tho back, but
not hurting him vesy badly. Ho was thereupon
secured and, with his companion, delivered to
tho officers waiting at the depot. These officer ?
seeing that the wounded man was not much hurt,
and fearing that if they remained much longer
they would loao their, prisoners, determined to
como straight along, wTilch they did, and arrived
here yesterday afternoon.
Wesllake, who was quite weak from the effects
or bis wound, was, with Bergman, carried Into
the detective office and Dr. J. Somers Bulst sont
for. He came In a few moments a - - - *sed tho
wound.. He found that tho ball, at . L? |>a'o, had
entered tho right side and glanced awrg the ribs,
and remained In the flesh. He advised that It be
allowed to remain, to which Westlakc, who didn't
fanoy the probing, agreed.
About 8 o'clock last night the prisoners were
placed aboard of the steamer Dictator, for Sa
vannah, In charge or Mr. Bartbelmess and officer
Truall.
Both prisoners take their arrest very coolly,
especially Bergman. Both expressed tho opinion
that-they were on the road to the State hotel at
MlUedgcviUe, Georgia; that If the officers had al
lowed them to remain in Wilmington twelve
hours longer, they would have gotten off under a
writ or habeas corpus, as everything was ar
ranged for it. Bergman says that ho was very
much surprised when Westlakc was shot; that he
cursed tho negro policeman, which made the
negro mob that had collected -very mad, and
they wautcd to mob him; that he wouldn't have
minded Weatlake's being shot so much "Hit
