State Taxes. Under tho Tax act passed by the Lcgislu ture lu September, 1868, all merchants aro taxed upon the average monthly valuo of tho property pertaining to their business In the year .ending September 1, 1868. Tho merchants had already paid during the year 1868, as in 18C7, a tax on their sates, ac? cording to the then existing rule of taxa? tion. The tax for,1868 was especially heavy, and when the Legislature passed a law that another tax should be paid, in another shape, for thc same period, lt was thought, by many merchants that the last nam ed os aessment would, in reality, represent their taxation for 1869. They are informed, how? ever, that tho tuxes assessed last spring aro for the year ending" September 1, 1868, and are called on to make new returns for tho year ending September 1, 1869, tho new tux being payable in March next. This ls, to all Intents and purposes, a double tax. . Thinking that the Legislature, at tho time of jthe enactment of the present law, was ignorant o? tl?e fact that the merchants of the State had already paid n tos? on the ope? rations of the year 1868, and with thc hope of'obtaining some relief for himself and lits friends, ono of our leading merchants made application, in person and by lotter, to tfio State Auditor, to know whether those who hod previously paid should not he exempt from the new tax, or bo credited with tho amount already paid ; and asking, further, whether the payment of the tax of 1869 could not bo postponed until tho meeting of the Legislature, if thc State Auditor could not himself decide tho question. C.: DEAR SIR-I have carefully considered yours I of 16th Instant, and al-o tho statements mndc by you in your interview with me, relative to your exemption from thc tax assessed against you and other merchants for the fiscal year 18C8. You claim Inasmuch as you paid a quarterly tax upon your sales during the year 18G8, although sold tax was for the fiscal year 18G7, that thereforo thc tax now charged and to bo collected on thc average value of your stock for^ thc year preceding September 1, 1808, ls a double tax, and therefore illegal, and should not bc collo;.ted. You also ask that if I do not feel at liberty to decide thc question of the legality of this law, that I will postpone ita collection until the Legislature meets, and huvo au opportunltjaof acting lu thc premises. When tho present law was passed, although lt was known that thc quarterly tax rcforrod to was being collected, no oxcoptlon was made In favor of those who were then paying that tax. Eqidty might re? quire that such an exception should be made, but the L?gislature having failed to make lt, lt ls certainly out of my province to do so. Willi regard lo tho postponement of the col-, lection of this tax, I would say, that In my opinion, thc law doc's not, and did noMnlend lo, confer upon me thc authority to postpone thc collection ol' taxes In individual cases. It is manifest that such a power would bi Hablo to great abuse, and defeat Ute very object of the law, which ls to secure nu equal, uniform and prompt collection of the taxes. Without conceding Hitit your view of the question ls correct, I am willing to admit thal there ls much to be said In Its favor; and In accordance with my desire to help you all I can, and with thc view ol' bringing the question before the Legislature lu thc most favorable and practicable way, I will Instruct the audi? tor of each county to make out a Hst of tho merchants In his county who have paid the quarterly tax referred to, with thc amount thereof in each case. This statement will bu laid before thu Legislature, anti I haw no doubt that the subject will receive the consid? eration it deserves. If the Legislature grants relief, lt will bc perfectly practicable to refund the amonnt overpaid, Or to deduct lt from thc next; tax to bo collected. If the Legislature should not "grant relief, it must be clear to you that any action of the kind you propose would not only fall of lis object, bot would ex? pose mo to the Just censure of Ititi body.
