THE NEWS, of Munday, gavo an account of a
model negro magistrate who committed a man
to jail because ho did not tako bia bat off, aud
now bas to record the doings or a while magis?
trate who, oombiuing both ignorance aud "puto
cuaaudutss," ha? dono au act whioh shows him
to bo a flt associate of his brother magistrate.
This man, who was a Confed?rate soldier and
is now a membor of tho Radical party, on Tues?
day last committed a citizen to the jail of this
city becaoso ho would not givo bond to pay the
sum of fifty dollars which ho did not owe.
CAUSE Or THE A RB EST.
In 1SG7 a man named Nelson planted some
cotton on tho plantation of Mr. D. Ferguson,
and being unable to attend to it offorod it to
Mr. Filaor if be would cultivate it and give
him ooo-third of tho net procoods from tho
sale of it. r Mr. Fit xor and tbroo others, includ
ingSamuel Tliouaidson, colored, consented to
tako ohargo of tho cotton. Bubaecjueuly two
of the men withdrew '?, from tho agreement,
leaving Mr. Fltzor and Biohardao&in charge of
tho colton, flo'd. These two agreed that they
should cultivate the cotton, sell it, givo Kelson
his o no-thirl, and equal ly divido tho balanco
left, aflor paying Mr. Fitter tho monay ex?
pended in tho cultivation.
* The ootton, ono bale, was sold in Charleston
by Messrs. W. 0. Bee & Co. in 1868 for ?109.
Tho expenses for cultivation, bagging, 4o" was
?02. The one-third, $38 S3, was paid to Nol?
son, whioh of ooureo left nothing to be divided,
but put Mr. Fitzer about $30 out of poe k ot. At
the timo, HioAardaon, although the matter was
folly oxplainod to him, assorted that monoy
was duo him from tho saje, and that ho would
have it out of Mr. Fitzor.

On the 7th of this mooth, about eighteea
months after tho ootton was sold, BiohardBon
shad a warrant issued by Magistrate H. W. Bls
tig, of BL John's Berkeley, living about thirty
miles from the city, for tho arrest of Mr. Fllsor
upon tho charge ot " awiudol." Mr. Fitzer,
With hts witnossos, appeared boforo th? magia
trato, who, after a brief investigation, told Mr. [
Fitzer that if ho did not give bond lo pay the
Bum of fifty dollars to lt ic h ?rds on, ba would
have to go to jail. Fitzer refused tb give the
bond required, bot offered lo give security.to
appear for trial before a higher oourt. The J
'magistrate refused to allow him lo do so, say?
ing that it would"coat tho State too much for |
tho caso to go to any other oourt. He then
wrote a commitment, and the constables
brought Mr. Fitzer to tho jail hero.

Council of Charlearen shall elect annually one

Now, if tho iuBpector-general ia a aurvoyor of

signed him by the ordinanoe ahow that he ia,
then the Cuy Counoil has not exceeded ita
authority in electing such an officer, for the
act aays it ''shall elect one or more." The du?
ties of the offioe, and not the title of the officer,
