warr anio writs, made on the 38th ultimo, in
behalf of the relators. Wil i i am N. Hughes, C.
P. Fraser and P. O. Querry, against tho Mayor

Addison, for mandamus, and of U. N. averill,
rotator, against Martin Caulfield for quo war?
ra i ito, was heard before Chief Justice liosos at
Sumter on Tuesday with tho following result:
Tho rotators wero represented by Mr. H. D.
Lososne, and tho respondents by Mesuro. D. T.
Corbin and R. 8. Tharin.
The ploa to the jurisdiction offered by Mr.
Tharin on the 801 h ult. was argued by that
gentleman, and the decision reserved.
After argument on the rule ior mandamus,
whioh waa the motion ia all the oases except
that ot Mr. Averill, flour inspector, the Chief
Justice stated that since the first argument,
bo bad looked carefully into tho points made
and tho argumenta quoted; that the affidavits,
While stating that the relators, being offioers
of, the corporation, had been ousted by
force, did not affirm that those who cjectrvd
them wero acting as o Alcorn defacto in the ucv
oral offices, or stood in auy other light than
mere trcspsssers. That tho mere fordable
tabing of the respective places of business did
not oust the rotators from their offices. That
if they were, as claimed, offioers de jure, they
otfuld still exeroise their functions at any other
location. That the affidavits mids out no more
than an obstruction or interference. He took
occasion to express the opposition of tbe osurt
to anything that looked like a resort to foroo
orvOpBoo.'and the efforts of'the law, properly
directed, would be strenuously interposed to
proven t the results whioh would follow from an
attempt to substitute force in the place of legal
authority. The remedy sought did not apply,
and the motion was refused.
The affidavits in the flour inspector's oase
was sufficient to authorise tho writ olttmed, to
wit: Quo tsarranlo, and it was accordingly or?
dered. .. ,
Tho o i un Bel for the relators stated that the
affidavits, could be submitted in lbs : other
oases, whioh would authorise the same writ
against the respondents, It was, agreed that,
on thia being done, tbe argument fer the quo
warranta in all th? cases would be heard on
the 15th prox. The main paint in issue will
then bo beard and decided.
The following is an extract from the opinion
of the Chief Jus tico on the plea to tho Jurisdic?
tion:
A preliminary ob) oct ion is interpoied against
the mot on whioh. as it denies jurisdiotion to
the court in the matter before it, mast be first
determined.

Company, va. Columbia and Augusta Railroad
Company, heard at January term 1869, it waa
olaimed on th* sam argument made here,
that the 8tate Conn had not the power to
grant a writ of prohibition, as tbo authority
was excluslvolv, under the constitution, in tho
Criminal Court.
Tho objection waa not sustained, and re tor?
rin < to that decision, wo will now inquire
whether it was competent for ono of the
juitlooa of tbo court to issuo the writ. The
point bas been argued with ability by Mr.
Tnarin for the rSapuiflknte.- and it is due that
tho question should be fully examined.

Tho testimony was substantially that tho de?

The verdict of the jory was that "the de?

charge of a pistol while examining the samo,
said pistol having fallen on the floor, on tho
morning ot tho 36th of August, 1869."
