The court oponed at ten o'clock yesterday
mor ni n pr, Chier Justice Choso and Judge Bryan
on the bench.
Tbe court resumed the consideration of tho
case of Wm. M. Ho vf land ot al, vs. Thaddeus
Kelly. Bill for foreclosarc. This was a de?
murrer on tho part of tho respondents for the
purpose of making Mr. Jervey, tbe executor of
tbe estate, a party to the cause.
Mr. Lowndes was heard against the de?
murrer, and Mr. Porter in reply.
The Chief Justioe deoided that the oxeoutor
who had token the bond was a necessary party
in the case The bond WSB taken by Mr. Jer?
vey as trustee or executor, and received for
the benefit of the grandchildren of Mrs. Mon
ereldt. The property was to be divided among
the children when they became of age. That
event did not take placo until the year 1866. I
then became the duty of the executor to divide
the estate. The proceeds of the bond were not
distributed beex-us* the executor had ivtcuived
payment in Confederate money. The most of
which that could be said would be that the
executor is accountable for the value ol the
Confederate money at the time it was received.
It also appeared that the bond had been re?
ceived from Mr. Gray, Mastor in Equity, and
was secured by a mortgage upon property on
King-street, and not as an independent debt,
but pro rata with other debts. The objeot was
to obtain control of this property for distribu?
tion, and to accomplish that, all the parties in?
terested should bo brought in before tbe court.
The demurrer was Bustsined; the plaintiff to
have leave to amend the bill by jointure of th9
necessary party, and payment of costs of the
term.

A Vax* Bonnay DZAXH-Mr. John Mehr,
tons, who died very suddenly on Wednesday
afternoon, of heart disease, was a native of
Lepe, Hanover, and oaly thirty-one year i
old. He was well and hearty a few moments
before his death, and in the City Park with his
children, when he felt indisposed and sat down,
and finally bod to be taken to his residence on
Broad-street, where he shortly expired. He
was a popular and promising young German
grocer.
