LOUR before tho hour of mooting of Council last o zoning, an anxious crowd had assembled at tho City Hall to witness the entertainment expooted to come off. In general, tho crowd seemed to be in very good humor, but bore and there wer? groups of anxious faces discussing tho probabilities of a quorum and the prospects of the various candidatos for tho loaves and fishes. As on previous ocoasions, only a sufficient number were admitted to occupy the seats in the Council Ohamber. The faoes of those who were unable to gain an entrance wore a look of indescribable chagrin. In the ante-room sat ex-Mayor Clark and Mr. J. H. Jenks. A few minutes before eight o'clock, but two of the terrible ten had arrived-Aldermen Barrow and T. J. Mackey. All the seats arouud the Council Chamber were occupied, and whispers passed round that there would bo another fizzle. At eight o'olock the follow? ing additional Aldermen entered and took their seats: Aldermen E. W. M. Maokey, Greene, and E. P. Wall, L. Fj, Wall, Hampton and Small, colored. The absence of two of the faithful-Thorne and lirown-caused some consternation among the brethren, who feared a ruso by tbe minority. Their apprehensions wero allayed, howover, by tho entrance of the . Mayor at fifteen minutes past eight o'clock. On taking tho chair, tho Mayor ordered tho Clerk to take the names and report the number of Aldermen present. The Clerk announced eight members present. Alderman Barrow rose and offered the follow? ing resolution : Resolved, That Council do now adjourn to meet at eight o'clock to-morrow evening, 27th instant. Aldormar. "G. P. Wall (smiling.) That mo? tion not having been seconded, I move that wo do now adjourn. Alderman E. W. M. Mackey. I move that we do now adjourn until Tuesday evening next. The question was then put and carried. Council then adjourned, to the no small con? fusion of the expectant and hungry crowds who have been anxious to serve the city nnder the new administration. The report that Howard, one of the colored Aldermen, was one of tbe ten was incorrect. We are authoriz3d to say that he has no sym? pathy with the aims of the majority, and does not concur in their views. THE RAILBOAD QUESTION-The Augusta Constitutionalist of yesterday says: "From the most rehab le inioi mat ion and assurances gathered yesterday, we feel warranted in stating that the existing differences between the City Council of Augusta and the South Carolina Railroad are in prospect of speedy and favorable adjustment. We are not advised as to the precise basis upon wbioh the settle? ment is likely to be effected, but tho present indications are that they will transpire within the present week, as we understand that Presi dent Magrath, of the latter corporation, was expected to arrive here last night, to respond to propositions which had been made to him in the matter. Unless a settlement is effected, the injunction granted by Judge Gibson will ?o into operation to-morrow, restraining the oars of this read from passing through the city under a penalty of $200.000. " TEE PICNIC OF THE GEBMAN FIRE COUPANT, which took place yesterday at the Shuetzen plr.tz, was, like all the pastimes of our German Mends, highly successful. The members of the company left the city at 9 A. M., in Gra? ham's omnibus line, and were not long before they began their round of enjoyment. The forenoon was spent by the members of the company in target exercise, which resulted as follows: The officers' prize, a gold-headed cane, was won by Mr. Gerhard Riecke. The first privates' prize, a set of gold studs, was won by Mr. H. Benson; the second, a silver headed cane, by Mr. E. F. Torok; the third, a gold pencil, case and pen, by Mr. D. Lilien? thal. After one o'olock all hands repaired to the spacious hall, where dancing was kept up with spirit. During the day a number of in? vited guests came up and joined in the plea? sures of the occasion. STEAMSHIP MONERA-IN ADMIRALTY-APPEAL, FROM DISTRICT OOORT. Tho libel iu th?3 caso claims compensation for injuries to throe horses shipped by tbo libellant at New York for Charleston in the steamship Moneka. If the responsibility of the vessel id to bo de? termined by the Ronera! law of common carriers, it ie n Jt questioned that the libellant is entitl? ed to a decree. But it is claimed that there was a special contract concerning the shipment of these horses, which relieves the carrier from re? sponsibility. On the other hand, it is denied that there was t,ny such special contract, and it is 'resist? ed if there was that tbe injuries were caused by negligence in transportation, to which tho special contract did not and could not extend. The proof of a special contract is not alto- , gethor satisfactory; but I think the weight of evidence fairly warrants the conclusion that there was one. But the evidence does not show that the shipper took on himself anything more than tbe risks which are incident to a voyage in a sea? worthy ship, conducted with reasonable care and skill. It may bo well doubted, indeed, whether the policy of the law will permit the carrier to re? lieve himself from risk, created by his own omission of suitable provision for tho voyage, or by his negligence in tho management of the ship. Eminent and learned judges have condemned any relaxation of the common law rule per? mitting common carriers to limit their re? sponsibility by stipulation, and though this relaxation "isTiow well established, it has.never been carried by tho American courts to the ex? tent of allowiug them to exonerate themselves in this wav from the consequences of their misconduct or culpable neglect. The true rule wat stated by the Supreme Court of the United States in tho case of the York Company vs. tfie Central Railroad. It is in substance th's : "The responsibility intend? ed by the common law can only be restricted and qualified by express stipulation for the restriction or qualification. But when such stipulation is made, and it does not cover loss? es from negligence or misconduct, it must be recognized and enforced." The only quostion in tue present case, therefore, is whether or not there was misconduct or negligence on the part of the officers of the steamer. This is a question of fact, and I have carefully consider? ed it. j It is not necessary to enter apon any minute review of tho testimony. It is enough to say that the horses were shipped on the 28th of December. Stalls were constructed for them between decks at the expenae of the shipper. Alter the horses had been plaoed in the stalls, and alter the regular time of starting, the steamer continued to take in cargo till about dork. This cargo seems to have been stored between decks, and my mind cannot resist the impression that it was carelessly stowed. Cer? tainly it became loose, and portions of it, in? cluding some kegs of nails, tumbled against the stalls. A heavy piece of timber was also left loose between decks. The stalls were broken; one of the horses was killed; another so injured that he died os soon as he was laud? ed, and the third also suffered serious injury. it is a fuir conclusion from the evidence that these injuries were occasioned by the loose stick of timber and tbe loose cargo. I cannot doubt that the exercise of proper precaution in stowage would have prevented these inj u riea. Nor can I doubt that the omission to exorcise proper precaution must be. imputed as culpable negligence to the officers of the ship. I think therefore that the libellant is entitled to a decree, and as both parties have declared themselves satisfied with the estimate of damage made by the District Judge, which seems to me also perfectly just and fair, the decree of the District Court will be affirmed.
